FWIW, I tend to side with you, matt. The possibility of O-care exploding on the launch pad goes up every day. Be a crying shame if the conflagration takes out a few dozens of dem congresscritters. The bottom line is that government does poorly in just about every aspect of its functions. One of the reasons the colonists rebelled and believed that government should be held to a minimum. They were frugal bastids.

The military is one of the most truly wasteful organizations we have. It has a function and must be so, but the waste is beyond belief. The Post Office? HUD? Homeland Security? DO Energy? DO Education?

DO Commerce hinders commerce while DO Labor is a gravy train.

Some functions of government are necessary evils, but few are efficient in any sense of the word.

Health care is already a bloated monster and now government will become deeply involved?

The cronies are a bunch of remoras. GE gets huge subsidies while employing evasive tax planning and not paying a penny. And the beat goes on. Wall Street is largely intact with our children's children's money.

Does this delay give the some of the 17 states which are operating their own exchanges the opportunity to create an insurance marketplace geared to small businesses?

Anyone delving into the whole issue of states that don't make exchanges, where the feds come in and set up their own, the law says those people don't get the subsidy, but the Obama adminstration is basically saying, screw the law, we are going to hand out money anyway.

If no state health care exchange is set up, does that mean there will be no health care subsidies under Obamacare? If so, it seems pretty clear that without subsidies there is no employer mandate. The Hill newspaper on Sunday described this whole debate this way:

The push to resist state exchanges is driven in part by the hope that a long-shot lawsuit will derail federal subsidies to help people pay for private insurance. Oklahoma filed the suit, which argues that subsidies can only flow through state-based exchanges, not a federally run fallback. If that argument succeeds in the courts, only a few states will have functional exchanges and the law’s coverage expansion will be eviscerated. . .

Anne, I'm not sure what you mean about Greene, he lost big to DeMint, 62-28. As for O'Donnell, we've been through this a dozen times here. I think that if you want to blame anyone, blame the moderate Rs who abandoned O'Donnell and Angle.

And the fact is, blame O'Donnell all you want, but the Republicans were four seats from a majority. Even if O'Donnell and Angle had been replaced by nice squishy moderate Rs and won, the Repubs would have been two seats shy of control.

Yesterday on a 2nd or 3rd tier National Talk Show we get out here, the host was convinced that ObamaCare was in the process of being struck down because of some new challenge to the Law in a story he had read in the Washington Times. The story's point is that since Justice Robert's decided Obamacare is a Tax, it is now unconstitutional because it did not originate as a Tax in the House per Constitutional wording and interpretation.

The hosts reasoning sounded delusional to me, since he expected that John Roberts would agree and overturn it, after having just pretzeled himself some months back into deciding it was a Tax. Whatever.

Anyhow, Randy Barnett of Georgetown Law was on to discuss it and he thought it would not be overturned, unlike the host, but he thought it an interesting question.

All that said, here is the story, if JOM's Legal Team wants to comment for the Peanut Gallery: Lawsuit over health care tax could kill ‘Obamacare’

My bet is ObamaCare will get overturned by the Supreme's around the time we Impeach Obama for not releasing his transcripts.
