"When you take Constitution 101, do also receive credits in English Common Law?"

No. But through the use of Google you can learn a great deal about English common law and its relationship to American law and the cobstitution.

I saw that story about Lerner on Megyn's show and immediately thought that, if true, Lerner had waived the privilege.

Issa appears lost. Perhaps there are political timing issues. Otherwise, it's just unvarnished incompetence.

MarkO

"When you take Constitution 101, do also receive credits in English Common Law?"

Yes.

But, there is no Constitution 101. It's like Fight Club.

Account Deleted

Yeah, there might be political issues. Maintaining a 64% support level with 71% wanting more investigation (only 60% of Dems want it) is difficult. That Issa sure is a knucklehead.

Issa is tenacious and aggressive, but he's kind of a bull who carries his own China shop with him. That dustup with Cummings was entirely unnecessay, and has become the focus of the story instead of, say, Lerner's waiver.

But the real problem is, I don't think he has any practicable remedy.

Issa-- he should get a Lerner contempt resolution passed. Send a referral to Holder demanding an indictment based on probable cause. Let Holder have to stonewall. All for show, and that's fine between no and November. This is part the Abuse of Power Meme that should be used nationwide against the Dems.

MarkO

Cumming's stunt was intended to be the story no matter what Issa did. And, it would have been.

Issa's remedy should lie with the DOJ prosecuting her for contempt. Nixon was a piker compared to Obama. His motto? Who's going to stop me.

If anyone wants to go into the weeds on the House Oversight Committee's options for holding Lerner in contempt, check out the Congressional Research Service's recent report on the subject:

http://www.fas.org/sgp/crs/misc/RL34097.pdf

Of particular note is the description in the Report (at pp 45-49) of the proceedings surrounding the pending civil action against Tremblechin in the United States District Court for the District of Columbia, filed in December 2012, resulting from his failure to produce documents in the Fast and Furious investigation.

Bottom line:

Issa and his Committee have been through this movie before. Their options are limited.

Scene: an unusual Italian funeral procession approaching the nearby cemetery.

A black hearse was followed by a second black hearse about 50 feet behind the first one. Behind the second hearse was a solitary man walking a dog on a leash.

Behind him, a short distance back, were about 200 men walking in single file.

A man respectfully approached the man walking the dog and said: “I am so sorry for your loss, and this may be a bad time to disturb you, but I’ve never seen a funeral like this. Whose funeral is it?”

“My wife’s.”

”What happened to her?”

“She yelled at me and my dog attacked and killed her.”

He inquired further, “But who is in the second hearse?”

“My mother-in-law. She came to help my wife and the dog turned on her and killed her also.”

The man then asked, “Can I borrow the dog?”

The Italian man replied, “Get in line."

Well it seems to me that if Lerner is talking to the Justice department she has either waived the 5th or they are on the same side and justice has taken up her cause.

Very cold winter here, coldest since 1977-78, which I do remember since I am older than dirt.

This colder weather means the soil will warm later, so a later spring planting season, which is not good for crops or my garden. Plus I think I have lost some roses this year.

What Plamegate and Armitage have to do with Lerner is totally beyond me. Those are old news as far as I am concerned, and have nothing whatever to do with oversight of the IRS. Nor do they have anything to do with the post that we ostensibly are commenting on.

In the immortal words of Perry Mason, the questions directed at me are "incompetent, irrelevant and immaterial".

the Top Men, hang a shingle in interesting places;

While McCain’s campaign prophecy has since
come true in dramatic fashion, there is a very soft underbelly to this entire story that leaves the senator’s slam-dunk prediction completely compromised. All the while that McCain was talking up Ukraine as being a potential future hot spot on the Russian geopolitical horizon, Republican insider and political strategist Paul Manafort was deeply entrenched in Kiev. He was advising a Soviet apparatchik with strong Ukrainian-Russian mafia ties by the name of Victor Yanukovych; the very man who would become Ukraine’s president in 2010, the very same man whom Ukrainians sent packing out of the country in 2014 through an incredible three-month long protest against his authoritarianism and corruption.

Jim Rhoads f/k/a vnjagvet

Yes Jane, I do. I commented briefly on one of the threads that mass tort litigation started heating up in the 1970's with the asbestos litigation. It was responsible for bankrupting a number of building material manufacturers, and resulted in settlements which compensated plaintiffs' attorneys very handsomely. Defense attorneys also made out very well, as these cases were big, complicated, and involved potential multi-million, sometimes multi-billion dollar exposure.

Since then, such cases have proliferated. Phen fen, Love Canal, Bhopal, Benlate, and the list goes on and on.

Many of these cases resulted in significant sanctions against attorneys representing both plaintiffs and defendants, usually for spoliation (destruction) of damaging evidence or creation of bogus supporting evidence. Often, the guilty parties are partners in very large, prestigious firms who typically are defending the cases on behalf of major Fortune 100 companies. Just as often, the guilty parties are buccaneer plaintiffs lawyers. A pox on both their houses.

Greed has for eons been a very powerful driver of human conduct.

rse

OK hit. Bet my shrimp scampi tonight would go well with that gumbo.

OK lawyers, I keep discovering that lawyers involved in representing school districts are simultaneously involved both with advocating for Radical Ed Reform and serving on working groups to steer us towards this collaborative, planned economy.

Q: Conflicts everywhere in my mind, but do those disappear when you represent public entities? Even if your fees are paid by taxpayers?

This is not a local matter although it is why I noticed. Thoughts?
