Immigration lawsuit thrown out...

...Arpaio and Klayman immediately appealed the ruling to the U.S. Court of Appeals for the D.C. Circuit.

“It’s a weak decision,” Klayman said in an interview late Tuesday. “We’re confident that we’ll win in the end.”

A gust of wind and Navy wins.

Jack is Back (on his iPad)

Looking at most of the photos from the anti-cop, NYPD=KKK march yesterday it appears most are ANSWER or IOW stupid white college kids that can't get a job at Wendy's. OWS retreads with nothing else to do in Barry's exploding economy.

When I read about people like Jason, I just think 'what an ass.'

Jack is Back!

This is for DoT, Sandy and all the swabbies when they wake up:

Army/Navy Game

Guy walks into a bar and trailing behind is an old, mangy dog who promptly curls up in a corner and goes to sleep as the guy is bellying up to the bar.

Bartender comes over and says: "No dogs allowed in here, you'll have to put him outside."

Guy says: "You can see he's an old dog, it's cold out there and I take him everywhere. If he can do a trick you like will you let him stay?"

Bartender says: "Him do a trick? That I would like to see."

Guy goes up to the dog and yells: "Navy beat Army". Dog's ears immediately come up, he pops up, jumps on the bar, does thirteen back flips, barks out the rhythm of Anchors Weigh, jumps off the bar and promptly goes back to sleep in the corner.

Bartender says: "That really is something - what does he do when Army beats Navy?"

Guy replies: "I don't know - he's just thirteen years old."

hit, everybody---re:flu.
I am all in on not seeing doctors too often as a rule---but this is different.

This is not about you toughing it out--gosh hit, I know you are tough. That finger that nearly fell off and you weren't whining--I remember!

Now that there is Tamiflu--it is about you doing the right thing by your fellow humans, finding out if you have it, and taking Tamiflu to decrease the number of days you spread it. Some will prescribe it for the entire household to prevent its spread.

This isn't at all about you feeling better faster--it's about not killing people. (Though it may be about you not dying too, depending on your underlying health.)

Flu kills people--lots of people. Mainly babies and old people.
Especially old people. Sometimes the people you are celebrating Christmas with.

I tried without success to find the youTube thirty minute dinner party with the host with the "runny nose" that fluoresced-it was EVERYWHERE.
Best illustration I've ever seen of viral spread.
I think I saw it here, in the fall--

Anyway, on that light note---Happy Christmas Eve to all!

Here's an odd but cheery local story. A tiny High School on the Kenai, in a town of Old Russian True Believers, has had it's first 2 girl Basketball players graduate and be good enough to be now playing College Ball.

Dorvall, Kalugin first Nikolaevsk girls to play college hoops

When we first moved up here 20 years ago there was a Russian Believer Community on the Kenai that only had a half Gym. There was only a Boy's Basketball Team then, and when a Team scored the other team took it out at half court and went toward the same basket. I believe that was this village of Nikolaevsk, and about 15 years back they finally got a full court Gym.

Go Warriors! G'nite.

Miss Marple

Good morning, and Merry Christmas Eve!

Drizzly outside, rain all day changing to snow after 6 PM but they assure us we won't get too much accumulation. We will see.

I have 2 sisters who have been hit by the flu even though they got shots, so do not take it lightly. One was off work for almost a week, the other nearly as long.

Dear God another Bush is running for President. After the first Bush destroyed the economy Democrats had to step in and rescue it producing historic growth and employment numbers. Then another Bush stepped in a completely destroyed the economy again.Again,Democrats had to push the Republican party aside and clean up the mess they made by rescuing the economy and producing historic highs in the stock market. And a third time a Bush want to have a go at completely destroying the economy...if at first you don't succeed try try again I guess.

Well o.k,we Democrats will just have to come in AGAIN!!!!!!!!and rescue the economy AGAIN!!!!!!!

Some may be aware of Lenny Cohen's Hallelujah popularly covered by Jeff Buckley

A group, Cloverton, has performed a Christmas cover of Hallelujah

I've heard about this baby boy Who's come to earth to bring us joy And I just want to sing this song to you It goes like this, the fourth, the fifth The minor fall, the major lift With every breath I'm singing Hallelujah Hallelujah

A couple came to Bethlehem
Expecting child, they searched the inn
To find a place for You were coming soon
There was no room for them to stay
So in a manger filled with hay
God's only Son was born, oh Hallelujah
Hallelujah

The shepherds left their flocks by night
To see this baby wrapped in light
A host of angels led them all to You
It was just as the angels said
You'll find Him in a manger bed
Immanuel and Savior, Hallelujah
Hallelujah

A star shown bright up in the east
To Bethlehem, the wisemen three
Came many miles and journeyed long for You
And to the place at which You were
Their frankincense and gold and myrrh
They gave to You and cried out Hallelujah
Hallelujah

I know You came to rescue me
This baby boy would grow to be
A man and one day die for me and you
My sins would drive the nails in You
That rugged cross was my cross, too
Still every breath You drew was Hallelujah
Hallelujah

Peace be with you.

Miss Marple

Thank you, Sandy.

I often think it is sad that some of the old carols have been forgotten. The lyrics to this one were written by Henry Wadsworth Longfellow, and are very meaningful to our time:

I Heard the Bells on Christmas Day
Their old familiar carols play,
And wild and sweet the words repeat
Of peace on earth, good will to men.

I thought how, as the day had come,
The belfries of all Christendom
Had rolled along the unbroken song
Of peace on earth, good will to men.

And in despair I bowed my head:
"There is no peace on earth," I said,
"For hate is strong and mocks the song
Of peace on earth, good will to men."

Then pealed the bells more loud and deep:
"God is not dead, nor doth he sleep;
The wrong shall fail, the right prevail,
With peace on earth, good will to men."

Till, ringing singing, on its way,
The world revolved from night to day,
A voice, a chime, a chant sublime,
Of peace on earth, good will to men!

Dublindave, I'm heartened to read your diatribe about "another Bush", since you reliably get everything backwards. OT from the topic, but I thought I'd ask JOM'ers if they'd like to sign a change.org petition for Prof John McAdams, who was suspended at Marquette after having the temerity to point out that a fellow Prof claimed to students that opposition to same-sex marriage is comparable to racism. The petition address is included in the Breitbart story linked below. I know of McAdams as the long-time host of the most informative and non-hysterical website for information about the JFK assassination - I've never seen any intemperate comments from Prof McAdams. Oh, and...Merry Christmas, one and all!

Should the new Missouri Plug a Thug incident be added to the incitement death list? We now have two thugs named Martin who have died of violent stupidity. I suppose the first one could be classified as violent ignorance due to Zimmerman not wearing a target uniform. Maybe there should be two hashtags - @deadignorantthug and @deadstupidthug with Martin1 in one group and Martin2, Brown and Garner in the second group.

It's a shame we don't have any dead white anarcho-commies to include as yet.

--It's not so creaky when you look at the entirety of greatest hits from the Rogues Gallery, Iggy.--

The creaking, dying meme is the "cops indiscriminately and deliberately killing innocent black youth" one.

Your link shows, almost exclusively, non black victims of almost exclusively negligent rather than intentionally malicious police actions.

That police need to be held accountable for criminally negligent behavior is hardly an exclusive area of the left.
The supposedly evil right wing Orange County brought murder and manslaughter charges against the cops who killed Kelly Thomas. They were acquitted. With the info I have which is only the video I might very well have voted to convict on manslaughter but I don't know what the rest of the evidence showed.

I do know many here have criticized police militarization. Is there in general too great a willingness on the part of the public to give cops more of a benefit of the doubt than they should? I'd say so.
Libertarians are about the only ones who are consistent on this.
I don't hear many [any?] cries for police action restraint from oh so concerned lefties when a Cliven Bundy is being threatened or people's livelihoods and lives are being destroyed by the EPA or other enforcement arms of the government or some white separatist's wife gets an FBI bullet through her head.

"...what my long-time radio and podcast partner Brian Ward calls “stories of choice.” They are plucked from a nearly endless supply of sad events that occur daily in a nation of 315 million, and are promoted because they further a political narrative. An unholy alliance of activists and newspaper reporters and editors tries to distort our perception of reality by giving undue emphasis to them. Then, of course, reality begins to catch up with perception, and we have riots, murders of police officers, and so on. But understand that the decision to promote these stories, in preference to others that are equally or more newsworthy, is a choice that is consciously made by people with a political agenda."

So far, I have seen Salon listing the reasons why Jesus wasn't real, and that EIchenwald guy made sure everybody knew that he had a long screed in Newsweek about how almost everything you believe about what's in the Bible is wrong.

Now we get the "Mary was raped" story.

In the olden days, when I was a child, our newspaper used to print the Christmas story from Luke on Christmas Day, on the front page. Sadly, they quit doing that when Gannett bought the paper.

Someone ought to point out that we NEVER get these theological discussions in the middle of July. Nope, only Christmas and Easter.

And I don't believe I have yet seen a story debunking the visions of Allah by Mohammed, in order to make Ramaddan more festive.

Pointing out "nuclear reactor found on moon!" and "California about to change its shape!" don't give much confidence in the source is not shooting the messenger.

The story itself was not really even a story, but a hodge podge of contradictory legal rulings and theories.

In accord with Orwell, I don't mind if "nuclear reactor found on moon!" is printed. I only mind if it's taken seriously.

Is the aggregator of news stories anything more than a messenger?

Danube on iPad

2001, narc.

The BLM had been making demands for payment on Bundy for twenty years.

Iggy

If, judging by their sidebar, 95% of their aggregated "Today's Top Stories" is crazy stuff then yes, they're more than an innocent third party messenger.

Parts of the story reference that grazing allotments, rights etc are real property interests.
Parts describe court rulings holding that permits fro grazing allotments do not create an enforcable right or property interest.
And the story conflates and combines without explanatory distinction vested grazing and water rights, split interest estates and patented mining claims with grazing allotments and permitted grazing and water uses of public lands.
It does not appear to me that whoever wrote it understands that a grazing permit that does not confer or create any property rights or interests is contrary to the apparent thrust of the story. It means the permittee has gained no rights against the government, not that the permittor has established no rights contrary to the permittee's.

Cliven Bundy:

http://en.m.wikipedia.org/wiki/Bundy_standoff

Iggy

To give a short example of how impervious this kind of stuff is to simple blog posts I used to own a property with a split-estate property right.
I owned all rights except the mineral rights which had been retained by the Feds when they disposed of the land in the 1800s.

That seemingly simple division of rights and ownership led one into a labyrinth of laws, rules and regs on who could stake mining claims on the property, when and how they could and when, how and under what conditions they could or could not enter the property and those rights varied significantly with what type of claim, placer, lode or millsite was being claimed.

Iggy

How about innocent Afghani kids and innocent Japanese, Italian and German kids?
All wars involve horrible, collateral damage that would be avoided if it were possible.

Did Mr Tiller accidentally invade woman's uteruses and dismember babies and plunge medical implements into the brains of nearly full term infants? No. He intentionally murdered them and rather than regard their deaths as a tragedy the abortionists and their ghoulish supporters cheered the "right" to murder them.

The inability to discern the difference is nearly as revolting as the acts of the great martyr Tiller himself.

If you're serious about the moral equivalence game then lets see you condemn Tiller rather than use his name as a heroic handle.
