Can't they find some 9th District judge to rule that the 2nd Amendment is unconstitutional? Isn't that the way things are done these days? That makes as much sense as some of their other rulings.

Rattler Gator--glad you're back.

Do Supreme Court justices ever move from the Left or the Center to the Right? I've always wondered about that. Are the canapés in Georgetown that yummy?

jimmyk

I see on Twitter that the other "Stevens" (Bret Stephens, the NYT token "conservative") has penned a "Repeal the 2nd Amendment" column each of the last two years. I'm sure glad there's a conservative voice at the NYT.

jimmyk

Do Supreme Court justices ever move from the Left or the Center to the Right?

Apparently not. The closest would be Whizzer White, appointed by JFK, but I don't think he moved right, he was always moderately conservative. But it's the one case of a moderate/conservative justice nominated by a Democrat President.

sbw

I tweeted:

Stevens: “Concern that a national standing army might pose a threat to the security of the separate states led to the adoption of that amendment ... Today that concern is a relic of the 18th century.” HAHAHAHAHA!

I hope Justice Thomas doesn't "evade" this issue as well.

Miss Marple

Because it takes 2/3 of the House and Senate plus 3/4 of state legislatures to pass, this won't happen any time soon.

So we will have years of complaining and demonstrations and. fundraising by activist groups, which is just what the left wants - an unending cause.

Do Supreme Court justices ever move from the Left or the Center to the Right?

Does ANYONE in DC (or any level of government) ever move from left/center to the right?

I'm trying to reconcile these two frequent statements;

1. "That's absurd scare mongering. We don't want to ban guns."
2. "Let's repeal the 2nd amendment because it prevents us from banning guns."

So far, no luck.

Gun control and gay marriage will always be election losers.
However every Dem candidate should be asked their position on gun control and whether they think lawful citizens should lose their guns.
West Virginia, Montana and Missouri senators should be grilled repeatedly.

Some lib on Twitter was all upset about Stevens' article because they have been saying they only want "sensible" restrictions and now all the right wingers will say this proves they want to ban guns.

In other words, he was mad that Stevens let the cat out of the bag.

Stevens committed a perfect example of a Kinsley gaffe.

Why is it illegal to ask illegals there citizenship status on the Census?

I'm going to give maryrose a break on that one, OL.
Constitutionally he of course is not their boss and she knows that. I think her point was he is the nominal head of the party, not the state, and they therefore have something of an obligation to at least pretend like they believe that.
And most congresscreeps of both parties will respect the office enough to toddle on over if the pres gives them a call.

Captain Hate

If that OIG report ever comes out, it should provide multiple reasons to justify the second amendment.

Miss Marple the Deplorable

I remain mystified at how the left can live in this country with us and not understand how we think.

You know that some lefty pal of Stevens talked him into writing that article. In their minds we are supposed to think "Oh, it's a Republican SC justice! I guess he must be right."

It's amazing, really. First they stir up a bunch of ignorant kids who have NO manners or dress sense to appear on television. Then they drag out every obnoxious Hollywood lefty to harangue us and sneer at us and call us murderers, demonstrating that they HATE us. Then they drag this guy out to make us supposedly fall in line, when all I can think of is Kurt Schlichter's advice:

"They really, really hate us. Buy more guns and ammo."

Old Lurker

Ext and Jim...I do get confused about the Census and Representation.

The Constitution says, at least when it was written that the Census will count all people living in a state...and that number will be used to assign Reps.

Later the census added questions for gathering information and I recall that such questions were challenged but the courts ruled informational questions are legal.

Are those two things correct?

If so CA would still get the full reps based on their illegals, but we will get accurate counts of how many illegals they have.

Is that correct?

James D.

those progs in the know really want guns in the hands only of the military, police and private security forces of the tech barons, entertainers and athletes.

That's EXACTLY what they want.

My response is the same as it is with all their proposals for climate change:

You first.

If you want to take away my right to defend myself using the tool of my choice, then you give up your right to do the same first. Let's ban private bodyguards, and disarm security guards at banks and high-end stores, and also disarm the Capitol Police and the security details for state legislators. Once we do all that, THEN maybe I'll listen to your arguments about restricting my 2nd Amendment rights.

Old Lurker

Iggy, I did not read her that way.

Miss Marple the Deplorable

Old Lurker,

The question is whether the number of representatives is based on the number of citizens they represent or the population as a whole.

I personally believe that the representatives should not be based on anything but citizens. California would lose representatives if they followed my preference. California would also lose votes in the electoral college.

Davod

"those progs in the know really want guns in the hands only of the military, police and private security forces of the tech barons, entertainers and athletes."

Don't forget Obama's armed civilian force with greater numbers than the US military.

Extraneus

Is that correct?

They're whining that merely asking the question will intimidate illegals into not participating in the census, thereby losing their population clout.

Captain Hate

In their minds we are supposed to think "Oh, it's a Republican SC justice! I guess he must be right."

They obviously have no idea of what I think of the GOP.

Following the end of the Civil War, the first of those provisions was superseded by Section 2 of the Fourteenth Amendment:
Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed.[6] But when the right to vote at any election for the choice of electors for President and Vice-President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.

Don't ask me to explain, OL. But it seems to me to suggest for federal elections only citizens should be counted. It takes a better legal top spinner than I to get there.

Thanks Clarice. MM, I personally agree with you 10:59 but I think Ext is right that for the purpose of assigning a state a certain number of Reps, THAT count is of "the whole number of people" in the state (which would count illegals but those illegals would not be allowed to vote). So, as Ext says, by ranting and raving, CA just wants to prevent the actual number of illegals to become official and known, even though they would all get the number of reps they "deserve".

I think that's true.OTOH if District A has only 1k citizens and reports 2K voted for the presidential elector---trouble. I think the opposition may relate to what Rick Ballard used to say--the number of Hispanics in the US is far less than claimed by those wanted more $ and that may reflect the opposition. Well, I'm gonna have to put off for now going back to catch up. I did (and do) want to see how that dadgum TK responded to my jab and Iggy to the Trump 4D campaign. I already know how that damn OL responds.

Miss Marple the Deplorable

RG,

Read the whole thing including the VERY long review, which was difficult to understand for me because I haven't seen the movie.

If I am understanding your objection, the movie has set up some mythical African culture and denigrates American black culture as inferior. I think I would find that off-putting as well. American black culture is born of experience, both bad and good, and to mark it inferior is a rather elitist attitude in the same way that the mountain culture of the South is also denigrated by the coastal elite.

I probably missed a lot of your points and his points but that is what I took from it, and I do agree if that is what you were saying.

clarice feldman

OL. you know the drill, but given the time frame, the Feds will probably seek immediate relief from SCOTUS probably on an extraordinary writ.

NeverTrump’s Creepy Infatuation with Stormy Daniels

If NeverTrump was a class full of adolescent boys, none of them could go up to the front of the class to work on the blackboard right now, if you know what I mean.

...

NeverTrumpers have a juvenile—if not downright creepy—obsession with Stormy Daniels (real name: Stephanie Clifford), the “adult film” “actress” who claims she had a one-night fling with Donald Trump in 2006. Since news surfaced in January that Trump’s lawyer allegedly paid Daniels $130,000 in hush money to keep their sexual encounter a secret, voyeuristic NeverTrumpers such as Jonah Goldberg and Bill Kristol have been fixated on her. If I were Mrs. NeverTrump, I might want to check around the computer for used tissues and old tube socks. I mean, I understand these nerds didn’t get to hook up with the homecoming queen in high school, but sheesh: Give it a rest already.

Now that it is increasingly unlikely Special Counsel Robert Mueller will deliver the goods to ruin the president, NeverTrump has replaced a prosecutor with a porn star as its new mascot. Daniels is their latest cudgel to blast evangelicals (Roy Moore is happy to surrender that role), preen about their moral superiority, and tsk-tsk about how they’ve been right all along that Trump doesn’t have the moral character to be president of the United States. Kristol fantasizes how Trump “could be taken down by Stormy Daniels” and insists Daniels and the Mueller investigation will somehow intersect.

Old Lurker

I'm with you, Extraneus. At least that is the proper Constitutional way to do it. My guess is that within about 7 to 10 days all pronouncements from Lefty politicians who over the last decades have declared how much they love and respect the 2nd Amendment will be sucked down the FaceBook/Wikipedia Memory Hole and replaced with new Anti-2nd Amendment pronouncments, altering their fundemental positions as rapidly as their prior declarations that Marriage applied only to a Man and a Woman. James Francis Thorpe (Sac and Fox (Sauk): Wa-Tho-Huk, translated as "Bright Path";[4] May 22 or 28,[2] 1887 – March 28, 1953)[5] was an American athlete and Olympic gold medalist. Considered one of the most versatile athletes of modern sports, he won Olympic gold medals in the 1912 pentathlon and decathlon, and played American football (collegiate and professional), professional baseball, and basketball. He lost his Olympic titles after it was found he had been paid for playing two seasons of semi-professional baseball before competing in the Olympics, thus violating the amateurism rules that were then in place...
