Chick cop.

Alright, I've got to do some research, I was unaware that David French is a laudable being but will trust our gracious host.

Threadkiller
breaking and entering

n. 1) the criminal act of entering a residence or other enclosed property through the slightest amount of force (even pushing open a door), without authorization. If there is intent to commit a crime, this is burglary. If there is no such intent, the breaking and entering alone is probably at least illegal trespass, which is a misdemeanor crime. 2) the criminal charge for the above

Neo

I don’t consider this a police activity.

maryrose

I am confused.
Why would the door be ajar or as stated above somehow the cop had a key?
Didn’t the cop need a search warrant?

Threadkiller

The cop lived in the same building, maryrose. She was confused about where her apartment was so she entered a similar apartment and blasted the tenant.

No glass ceiling was harmed.

maryrose

Her own key wouldn’t open someone else’s apartment.
Why is she shooting her gun if she is off duty?

henry

Straight murder. What does her being a cop have to do with it. She wasn't on duty, or on a call, or any of that. Equality under the law. You bust into someone's home and shoot them dead, you are a murderer. That is what this cop did. I vote death penalty if I'm on that jury.

maryrose

Manslaughter?
Well some jail time for sure.
She just can’t go around shooting people.

maryrose

It may surprise some here that I am against the death penalty.
Let them rot in jail.
Her defense sounds lame to me,

henry

You wear the badge, stronger not weaker penalty.

Threadkiller

The cop had a key to her apartment which was located in the same building, maryrose. When she put her key in the wrong lock she claims the door opened without her having to twist the key.

Threadkiller

Local news played a bit of the national coverage. Another tenant in the same building showed the reporter his key. It looked like part of a kids toy. Really odd.

I imagine the lock manufacturer will be joining the police department on the opposite end of the wrongful death lawsuit.

 Disgorging the Fecker

Yesterday, Amy Berman Jackson moved a pre-trial hearing that had been scheduled for this morning to Friday morning. That has led to further reports that Paul Manafort is seeking a plea deal. But, as ABC reported, one sticking point is whether Mueller is willing to offer a plea deal without cooperation along with it.

Sources tell ABC News that Mueller’s office is seeking cooperation from Manafort for information related to President Donald Trump and the 2016 campaign. Manafort, however, is resisting and his team is pushing prosecutors for a plea agreement that does not include cooperation, at least as related to the president, sources said.

To be clear, both sides have an incentive to find a way to avoid the trial. Mueller already has Manafort on the hook for an 8 year sentence or so, and if that’s not going to make him cooperate in the case in chief, it’s not clear that another 8 years will. And Manafort’s legal bills have to be sky high already, without another trial where he’s facing overwhelming evidence.

But the reason why Mueller isn’t just going to let Manafort plead to some of the DC charges without cooperating is because that would mean giving up the considerable leverage — $30 million worth — that Mueller built into place a year ago.

While it hasn’t gotten a lot of attention, both Manafort indictments include forfeiture provisions, meaning the government will seize his ill-gotten gains. And because Manafort had a shit-ton of ill-gotten gains, there’s a whole lot of stuff that the government can now seize, starting with his ostrich skin suits..

Jack is Back!! (On the Old iPad)

Oh, and BTW, she could use the Russian excuse, which seems pretty popular these days as the generic for everything you do or can’t do.

Michael (fpa P4F) ... Stop the Witch Hunt - Stop the Coup !

Haven't caught up yet (ever?) - but wanted to mention this important claim/allegation re Weissman (Mueller's SC henchman):

I read a story from a major conservative source this past week (can't remember the name just now) re Bruce Ohr's interview with the House Gov Oversight/Intel committees' members and staff.

That story was based on info provided by Repub sources - *no* Dem members/staff attended the interview - and included the allegation that Bruce Ohr provided Andrew Weissman with regular updates of the information being passed to him (Ohr) by Christopher Steele in the meetings Ohr had with Steele from ~ Sept. 2016 through May 2017.

Remember, Ohr had *no* counter-intelligence oversight at that time, and Weissman was a DOJ prosecutor who was not known to be assigned to any counter-intelligence unit.
There was no reason given for why Ohr reached down to brief a prosecutor - who was *below* him on the organizational chart of DOJ - about his (Ohr's) contacts with someone who had been terminated as a confidential source for the FBI.

And Weissman accepted a position with Mueller's SC staff, despite his involvement with the improper contacts Bruce Ohr had with Steele, and Weissman has still not recused himself from Mueller's staff.

Has anyone heard/read about this story anywhere?

Pinandpuller

Threadkiller at 7:51 PM had a definition of breaking and entering but the linked "Burglary and Criminal Trespass" has this:

Sec. 30.05. CRIMINAL TRESPASS. (a) A person commits an offense if the person enters or remains on or in property of another, including residential land, agricultural land, a recreational vehicle park, a building, or an aircraft or other vehicle, without effective consent and the person:

(1) had notice that the entry was forbidden; or

(2) received notice to depart but failed to do so.

Lack of intent and ignorance of the situation looks like a live defense.

The definition I provided was to point out that in the general definition a "forced" entry doesn't have to be forced at all.

At the burglary link:

Sec. 30.02. BURGLARY. (a) A person commits an offense if, without the effective consent of the owner, the person: (1) enters a habitation, or a building (or any portion of a building) not then open to the public, with intent to commit a felony, theft, or an assault; or (2) remains concealed, with intent to commit a felony, theft, or an assault, in a building or habitation; or (3) enters a building or habitation and commits or attempts to commit a felony, theft, or an assault. (b) For purposes of this section, "enter" means to intrude: (1) any part of the body; or (2) any physical object connected with the body. (c) Except as provided in Subsection (c-1) or (d), an offense under this section is a: (1) state jail felony if committed in a building other than a habitation; or (2) felony of the second degree if committed in a habitation. (c-1) An offense under this section is a felony of the third degree if: (1) the premises are a commercial building in which a controlled substance is generally stored, including a pharmacy, clinic, hospital, nursing facility, or warehouse; and (2) the person entered or remained concealed in that building with intent to commit a theft of a controlled substance. (d) An offense under this section is a felony of the first degree if: (1) the premises are a habitation; and (2) any party to the offense entered the habitation with intent to commit a felony other than felony theft or committed or attempted to commit a felony other than felony theft.

But it gets even worse. The FBI either never discovered this blatant and clandestine violation of federal laws or did and simply covered it up.

Following the Benghazi consulate attack in 2012, then Secretary of State Hillary Clinton secretly worked with Google to reroute email traffic away from her private computer server and use public Google Gmail servers instead. That clandestine move served to cloak her inner circle’s communications from lawmakers, public scrutiny and would-be criminal investigators, according to intelligence sources who provided documents to True Pundit.

Posted by: Thomas Collins | September 12, 2018 at 12:24 PM?

I thought that was the thread winner.

Second, when my wife briefly mentioned the Dallas shooting a couple of days ago my initial reaction was “bullshit, how do you go to the wrong apartment?”. I’ve done very little reasearch on the situation. I still don’t know how a person going home goes to the wrong apartment. All actions in the case will/should be measured by the “reasonable person/officer” standard using all facts known by the officer at the time of the incident. In Indiana a person has a right to defend themselves in their home if they reasonably believe they or an innocent third party are in danger of death or serious bodily injury. Any person entering their abode and finding what they believe to be an intruder inside would have the same protection. Does a person/officer, who reportedly unintentionally, who enters the wrong abode have that protection? I have no idea on that.

Until other facts come to light, a first degree or capital murder charge wouldn’t fit. That charge requires malice aforethought/premeditation. There are lower levels of homicide that could fit, reckless homicide, voluntary and involuntary manslaughter. I’ll try to keep my eye on this one.

For clarification here, an officer does not have to be “on duty” to act under color of law. If I’m out and about on a day off in plain clothes and I see a crime committed I can and should act. The exact moment I’m involved I’m “on duty”. No uniform or specific radio call,10-41, that on working is required.

Apologies for any typos, etc. I’m not in the mood to proofread.

These series of text messages appear to contradict statements made by Strzok’s attorney, Aitan Goelman, after it was revealed earlier this week that Strzok and Page discussed a “media leak strategy” in some of their text messages. Goelman insisted, “the term ‘media leak strategy’ in Mr. Strzok’s text refers to a Department-wide initiative to detect and stop leaks to the media.”
