What happened to make Joe Wilson go to Niger?

1. Valerie Plame pushed him verbally with her bosses; then wrote up a memo suggesting he was the best one to go to Niger to find out what was going on.

2. Valerie Plame conducted a meeting with representatives from State INR, DOD, various other intel groups/agencies, with Joe Wilson present, made introductions and then left the room. [Note: fait accompli and how inappropriate]

3. According to those at the meeting, Joe Wilson going to Niger was opposed because State had it's own effort; and the CIA had another "redacted" source who could inquire directly. Nevertheless Joe Wilson was sent by Plame's boss at his insistence.

4. According to Wilson's SSCI testimony, when he arrived in Niger the Ambassador insisted he meet with no one in the government or active business community so as to not jeapordize ongoing Ambassadorial and diplomatic efforts to inquire into the matter. Instead Wilson met with ex officials.

5. Wilson reported that ex PM Mayaki had met with an Iraqi trade delegation, and it was Mayaki's understanding the Iraqis wanted Uranium but he Mayaki did not pursue the matter.

6. This report was not made in writing, instead it was made orally to two CIA agents who debriefed him at his home with his Wife present; and in turn generated their report.

This ... is possibly the most bizarre bit of stuff to come out. It sure stinks of nepotism.

Obsessed: Larry Wilkerson, Colin Powell's aide, who blasted Cheny and Rumsfeld for making decisions themselves instead of handing off to the bureaucracy, admitted that ALL including the CIA believed Saddam had WMDs. He specifically mentioned seeing Satellite imagery showing a complex site that was cleaned up of everything with many, many trucks taking whole buildings apart, before inspectors showed up. He still does not understand this. Basically, the Duelfer report concludes Saddam had to bluff on WMDs to deter Iran and the US; he felt that perception he HAD WMDs would prevent any attack.

BOTH WH and CIA were on the same page as everyone else on WMDs and Saddam. Everyone thought he had them. After having been burned so many times by him and folks like AQ Khan and Lil Kim there wasn't a whole lotta trust.

All this is really is fingerpointing for blame, CIA vs. WH.

I would love to see an FDR style Dem. Unfortunately all I see is openly asking to "negotiate" with bin Laden. That's a non-starter for me.

NEO, if I were going to hazard a guess, the violation of Joe Wilson's Civil Rights is some application of law his attorney might use in a case against the Administration (Wilson suggested he is planning to sue after any indictments come out) and not something Fitzgerald is considering.

The "violation of Wilson's civil rights" refers to the (hopefully) absurd notion that Fitzgerald will use the breathtakingly broad Conspiracy Against Rights statute (18 USC 241). The pertinant part provides that:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same.

The punishment is up to ten years in prison.

One might think that a law this vague would violate due process, but unfortunately the courts haven't seen it that way. They have, however, reduced the scope of the law so that it would be very unlikely to be applicable to the Plame cases (if there are any).

I note that it seems to me that by the plain language of the law it could be applied to a group of state legislators who pass a censorship law which is later found unconstitutional. Have they not conspired to injure those who were censored by imposing criminal penalties for exercising their constitutional right to free speech?

Two theories on why thty're re-interviewing the neighbors:

1) Fitzgerald's trying to get a skeptical hold-out juror to indict someone for reveling Plame's CIA status, and he wants to convince the juror she was actually covert. (Hearsay testimony from the FBI agents would be allowable in the grand jury.)

2) Some information has come up that casts doubt on the neighbors' original claims that the didn't know Plame works for the CIA.

I hope the second theory is correct, but probably neither is.

It's gossip anyway, especially if someone who is curious could actually follow her. I mean, what if they all figured she had a desk job.

In fact, it doesn't matter if Valery knocked on everyone's doors and announced she works at the CIA. Some people would actually believe her, and be impressed. Others would say, yeah, sure.

It's her NOC that is the real problem. Is it for real, or not? Were she and her husband a little too casual about the whole matter?

I'm rather late to this story but have been following the discussions here recently. However, I found some very interesting bits of information in AJStrata's post that could add up to a smoking gun. I'd like the contributors here to let me know if I'm on track or blowing smoke. For all I know this theory may have already been discussed and debunked. Anyway, here goes...

Strata points out that there were 4 people at the meeting when Joe Wilson returned from Niger: Wilson, Plame and two debriefers sent from the CIA. This meeting was noted by Nick Kristof in his NYT column that first brought Wilson's trip to public attention. He also points out that the Times would never print such a potentially explosive story without a second source to corroborate it, and this second source would probably need a CIA connection to be credible. If we exclude the two debriefers, only Plame is left. And if she did back up Wilson, then she outed herself.

I have been wondering why the Times has been piling on Judy Miller so viciously the last few day. This could be explained if Miller learned of Plame's identity from Kristof (either directly or indirectly, i.e. through the grapevine in the Times newsroom), and they are afraid she might testify to that effect. Or perhaps she already has. Remember there was a lot of speculation that Miller was protecting a second source other than Libby. Was Kristof that source? Her testimony could simultaneously expose Plame, let the Bushies off the hook and further damage the reputation of the Times. Maybe the attempt to damage Miller's reputation is just a tactic to protect themselves and their sources from accusations based on her testimony.

Question: Did Kristof talk to investigators or testify under oath? If he denied any knowledge of Plame (Flame?), then he could be at risk of a perjury or obtruction charge.

Miller's testimony (plus the testimony of the 2 debriefers saying they never spoke to Kristof) would *prove* that Valery outed herself. Perhaps that was why Fitzgerald put Miller in jail: to make her give up Kristof and prove the ultimate source of the leak: Plame herself. Since jail didn't work, maybe Fitz used strongarm tactics after her release to achieve the same thing.

None of this means the WH (Libby, Rove, Tenet, Cheyney, maybe others) is out of the woods. Depending on how Fitz sees things, he may indict anyone who mentioned that Wilson's wife worked at the CIA. Or he could charge one or more with obstruction if they were less than forthcoming in their testimony.

Predictions: I foresee a bi-partisan crop of indictments this week, with the most serious ones (related to the outing) directed at Plame, Wilson and persons at the NYT. Lesser charges of obstruction will be laid on the White House. These will be easier to beat in court but still politcally damaging. The press will express surprise at the Wilson and Plame charges but quicly distance themselves -- perhaps they have already started (i.e. Yesterday's Pincus article). They will cry foul if any journalst at the times (other than Miller) is charged. But mostly they will focus on the minor charges against the WH and make mountains out of molehills.

Time will tell...

But only if it can be tracked all the way to Novak. Kristoff didn't identify her. Miller didn't write a story. The two certainly could have discussed it. And Miller possibly gave it to Libby.

Just gossiping about it behind the scenes doesn't mean much (unless a conspiracy) I think.

If you get back here, I think I figured out the real reason Wilson turned around in March.

Now don't laugh.

It was the invasion of Iraq on March 19th.

Before that it was fine for him to support the notion Saddam had stockpiles of WMD and Saddam was a bad guy. But I'm sure many...a lot...of people thought Bush wasn't really really really going to do it. :)

Wilson was shock-and-awe'd.

This is true:
Some of the questioning indicates that Fitzgerald may be considering indictments that some have viewed as too difficult to pursue, including prosecution under a federal law that makes it a felony to reveal the name of a covert agent.

That is what is going on with questioning the neighbors. It is all about very secure and airtight cases against Rove et al, not Wilson. I have never read anywhere anything bad about Wilson except from people who are scared they are going down.

That debriefing was on March 5, so either Kristof's date is wrong or he's talking about the first (Feb) meetings where the decision was taken to send Wilson. In either case, Plame is almost certainly the second source (assuming Kristof is accurate), but it's not provable.

No offense taken Syl. There are still details to be worked out (exactly how Novak found out, for example) but I think the most important thing is the original leak, and I think Plame is the source. There is also the fact that Wilson supposedly shopped his story around before the Times printed it, so Plame may have revealed herself to other journalists too. This would explain how her name became well known among the DC media. The administration eventually got wind of it and checked it out independently. Novak, who may have heard the same thing from multiple sources, just called the CIA on the off chance they would confirm it and -- stupidly -- they did, so he ran with it.

Journalists may also have contacted the WH to get confirmation, so the Bushies could have known about Wilson earlier than media reports originally indicated. All this talk about earlier and earlier meetings where Wilson's name came up may have come as a revelations to the press, but perhaps not to Fitzgerald. Whenever journalists called to ask about this story that was floating around the WH tried to wave them off (and may have revealed too much in the process). However, Wilson's Op-ed put it back on the front burner and then it was only a matter of time before Plame's identity came out.

"Three days before the grand jury in the case expires and with the White House in a state of high anxiety, the special counsel, Patrick J. Fitzgerald, appeared still to be trying to determine whether Mr. Rove had been fully forthcoming about his contacts with Matthew Cooper of Time magazine and Robert D. Novak.."
If Fitz doesn't know by now, how strong could his case (against Rove, anyway) be? I know we're all supposed to show great deference to his painstaking professionalism, blah blah blah, but if he indicts on something he's had two years to investigate and think about, and he's not sure the night before whether or not it rises to the level of being indictable, than it's possible he might be something of an idiot. If true, I hope he's not an idiot of the reckless variety.

The problem with that one, is Joe Wilson was never an analyst.

He was an ambassador, and there is probably no reason for him not to be able to say it. On the contrary, Wilson probably talks all the time about being a former ambassador. He was the head of Joe Wilson International Ventures, so I find it hard to believe he was trying to pass himself off as undercover...

I hope I am misinterpreting these latest interviews by the FBI with Wilson's neighbors for Fitz. I hope that he has not waited until 2 days before the end of the grand jury to start investigating whether Plame was truly covert and taking active means to hide it as required by the statute to convict. He had over 2 years to investigate that and it should have been the FIRST thing he did not the last. And a couple of neighbors in a heavily Democratic neighborhood after the politics of this has become obvious to all? Terrible. If this is the case, he is not the stellar, hard-nosed investigator as he is portrayed to be but instead is a sloppy hack. I hope, as I said already, I am misinterpreting these interviews.

No, Syl, I think you are missing the issue. The IIPA has some specific legal language about how the CIA has to be actually taking action to hide the person's identity in order for the person's identity to be legally secret. This is a very fundamental legal problem with secrecy laws -- one of the most fundamental common-law principles we have is that you can't be held liable for violating a law unless you reasonably would have known that you were violating the law. This principle underlies such varied things as the constitutional protection against ex poste facto laws, the requirement to publish laws, and protection for children, the retarded and the insane who might violate some law that they do not have the ability to understand is wrong.

Under the Rule of Law, you can't have the Alice In Wonderland scenario -- was it the Red Queen who kept screeching "Off with her head!" hysterically to imagined offenses? Congress was careful -- they imagined the scenario where the government could classify (an administrative action) some information which was either not secret at the time, or which then they failed to keep secret later, and then turn around and pull the Red Queen act and demand the head of some poor slob who had no reasonable way of knowing that the thing was classified. Because of course the fact that something is classified is also a secret.

Once the CIA (or more precisely, one or more of it's agents, i.e. Plame, Hawley, etc.) is chattering about something classified as "secret" to people not authorized to receive it, then it's no longer "secret" under the law. It can't be -- if the law allowed the government to punish people who discussed "secrets" that the government did not take any reasonable action to keep secret, then the law would be instantly found unconstitutional. Which is why the law explicitly rules out this scenario.

So if Fitzgerald is asking the neighbors, he is attempting to figure out whether the identity is secret. Because it doesn't matter that the CIA bookkeepers paid her salary & benefits out of an NOC account. What matters is whether the CIA kept her employment secret.

But we're not necessarily dealing with the Identity Protection Act. And mishandling classified info does not depend on what her neighbors thought.

So, it seems, unless there's another explanation for the questioning...which there very well may be...we ARE dealing with that Act. Which means the other provisions may have been met.

Not quite. He's attempting to demonstrate to a potential indictee that indeed it was.

The problem is that he's trying to prove a negative, and it's extraordinarily difficult. So he talks to the neighbors, and nobody knew. But then at trial the defense pulls out some acquaintance that rode the Metro with Mrs Wilson and saw her get on the CIA shuttle in Rosslyn. Some acquaintance who wasn't a neighbor because she just got off the Metro with Valery, not on. If Fitzgerald is really going with an "it was really a secret" prosecutorial theory, he is taking a big risk that some out-of-left-field witness might show up from basically anywhere to show that it wasn't. Sure, the neighbors would be most likely to know, but just because you rule them out successfully doesn't mean you're safe.

But I agree that at this late date the neighbor interviewing has to be about intimidation and can't be giving Fitzgerald any info he doesn't already know.

Are you making some kind of mistake? The text of the article you posted (in an earlier thread) seems to be an altered version of the original article. Lots of people said Saddam was dangerous. Bush went a step further. He said Saddam was so dangerous that the only solution was a war of choice, and that this war needed to start on 3/19/03 and not a day later. Bush was wrong.

VERY interesting paragraph in the headline article in the Washington Post today, burried deep, close to the end:

"Two lawyers involved in the case said that, based on Fitzgerald's earlier questions, the prosecutor has been aware of Libby's June 12 conversation with Cheney since the early days of his investigation. The lawyers said Libby recorded in his notes that Cheney relayed to him that Wilson's wife may have had a role in Wilson taking the CIA-sponsored mission to Niger. According to a source familiar with Libby's testimony, Libby told the grand jury he believed he heard of Wilson's wife first from reporters."

Since the early days of his investigation!! This could be self-serving stuff from Libby's lawyers, but it could also be an indication that Libby has cooperated all along and Fitzgerald has other fish to fry. I am beginning to suspect that much of the reporting on this case is nothing more than uninformed gossip and that the indictments, however they turn out, will surprise everyone. One more thing: There is not necessarily a contradiction between the two statements "Cheney told Libby on June 12" and "Libby heard about Plame first from reporters". He could have heard about it even earlier, when Wilson and Plame were shopping their story around to news outlets.

Sure, it's quite explicit in the IIPA, but it's a broad principle of common law, too. The government has a burden of actively attempting to keep the info secret, and if they failed to meet their burden, Fitzgerald gets kicked to the curb with a summary judgement and dismissal because while it may have been "classified," it wasn't, in a legal sense, "secret." If the neighbors knew she was CIA, and they knew it because an agent of the CIA (Plame) told them, then that's a slam dunk. Fitzgerald has to have checked this out pretty much first thing, right?

So, yeah, I have to agree this is about intimidating someone. And it doesn't make sense that it's Plame or Wilson he's attempting to intimidate. (Because if it were Plame/Wilson, he'd go after the "outting" to Kristoff which happened no later than May. The neighbors knowing is exculpatory for anyone other than Plame/Wilson, but it would be further damning for them.)

If the neighbor found out because he burgled the Wilson's house and looked at her secret papers that is something totally different from if he found out because Valerie told his wife while the two were gabbing over the fence. Because if Valerie, who was an agent of the CIA, was telling people, then the CIA wasn't taking due diligence to keep it secret, and then it's not a secret.

An interesting wrinkle -- suppose Fitzgerald has found a neighbor who knew from Valerie, or who knew from Joe. Suppose that neighbor knew before "early 2002" (within the 5-year window from when she was overseas).

Nah, that would be too much like a mystery novel!

As I understand it from press reports, the practice in DC is to bring the grand jury before a magistrate and have them affirm the indictment. Had the grand jury trooped out en masse at any time or the magistrate entered the gj room, we'd have heard about it.

Some have surmised Fitz may be asking for permission to file a report. As I understand it Hogan is not in a position to grant this unusual request. (People keep confusing this with an independent prosecutor who can and did do this.)

I guess maybe you think the "but NOT YET" part somehow got redacted. Somehow you've come up with the idea that even though 82% are "strongly opposed" to our presence, somehow this means "they want us to stay." Very imaginative.

And maybe you missed this part: "less than one per cent of the population believes coalition forces are responsible for any improvement in security." I guess this is more proof that they really "want us to stay."
