K9 has always been there...kids are so good. I could sit for hours trying to think of something...he on the otherhand can garbble something out in 2 seconds flat, walk away, grab a Popsicle and move on to the next thing (without even knowing or caring how good it is). Free of mind clutter I guess.

Haven't found it either...but have been doing some interesting reading. Woodward was the one that kept getting Pincus work published against the WH, back when. Pincus was the one he dropped it on. Something just smells about Woodward keeping quiet for 2 years and now his conscience says step forward. Don't know that I am buying that he is soft on WH. Looks more like a hit, the more I read.

Jonah Glodberg pointed this out too. The left are bashing Woodward as a Bush lover, like Judy, but as you and Jonah point out...would not his coming out EARLIER lest hiding in hopes of no subpoena(?) helped Rove and Libby a yonder back?

Dunno ts--but if you go back and look at Pincus and all his resources, he had to have known Plame/Wilson. Ditto for Kristof. So what was all that about Woodward coming by and dropping Pincus the tip?

I think the point is that Woodward didn't know until shortly before the subpoenas, that Libby would be considered the first leaker.

People seem to forget that what we learned from the indictment and from the presser, was not real knowledge beforehand.

Sorry, this will be cryptic as all get out even by my standards, but...

I have checked out the Free Rep thread on "Pincus Knew" (and downloaded the 1996 WaPo story, which I may post later), but...

Per a 1995 USA Today story, the CIA NOC was Mary Ann Baumgertner, a 50-ish woman.

OK, I have heard of disguises, but that is probably not our gal Val.

And another commenter at Free Rep noted that Pincus is writing *about* the incident, but may not have known the players.

Well, I hope to have a post titled "Kristof - The Next Woodward?" available in a day or two, but there is a big question mark about it.

Bonus question - the editorial position of the WaPo and NY Times on whether a crime ocurred, and whether a special prosecutor was needed might be influenced by the involvement of the reporters we know about (e.g., Pincus, Miller).

OTOH - their position might also be influenced by knowledge gained from reporters who did what Woodward is criticized for *not* doing, i.e., reporters who got a Plame leak in June and told their editors.

For example - the NY Times was quite clear about the Miller story - Taubman, Washington editor, asked all the reporters there if they had received a relevant leak, and Miller did (or did not) respond satisfactorily.

All very interesting, but what about Kristof, who is not part of the Washington Bureau? Wh asked him, and what did he say?

Anyway, as a control - does anyone know the editorial position of comparable non-tainted papers, such as, maybe the LA Times and the Chicago Trib?

If they were pounding the table for an investigation into this heinous crime and the Times/WaPo were not, that would be suggestive.

Steve Clemons on the Washington Note has been interested in the "Good leaker" who leaked that the Bush White House was "out to get" Plame and Wilson. He notes that on September 28, 2003 Dana Priest and Mike Allen ran a story from a source who told them that it was a White House "vendetta" that led to the outing of Plame. That might explain the Armitage and Hadley theories in a so called "Grand Unified" Plame theory or GUP. Thus they would have both leaked something in the case. Would explain a lot.

Ahh, the old, "Libby was actually talking about another reporter, but screwed up three consecutive times about three different reporters" defense. Let's really look at what the indictment charges, shall we?

1. Lying about the July 8, 2003 meeting with Judy Miller and stating that he did not discuss Plame with her. Miller says otherwise and her contemperaneous notes do too.

2. Lying about his conversation with Russert

3. Lying about his conversation with Cooper.

These lies were made both to the FBI and the Grand Jury. So Libby would have had to forget conveniently six times! Crappy memory huh?

Rob W, to count each supposed misstatement twice because Libby said it to the FBI and the GJ is a bit misleading. If Libby misremembered something when he talked to the FBI, he'd very likely misremember it the same way if asked later by the GJ.

As far as he specific alleged misstatements:

1. If you read Miller's version of her testimony it's unclear whether she has any independent recollection of what Libby said. She mostly seems to base her version of what occurred on the parenthetical phrase "Wife works at Winpac" in her notes. Miller says she "had no clear memory of the context of our conversation that resulted in this notation," and that her "notes do suggest that our conversation about Ms. Plame was brief." So, assuming Plame was actually discussed, rather than Miller adding a parenthetical remark to remind her of something she'd learned from another source, it's hardly unreasonable that Libby forgot it several months later.

2) This is the only conversation that might be attributed to Libby misremembering who told him something, with Libby mistaking something he'd heard from Woodward as coming from Russert.

3) The indictment says Libby told Cooper he'd heard Wilson's wife works for the CIA, while Libby claims he told Cooper he'd heard other reporters say Wilson's wife works for the CIA. Either Cooper or Libby may be misremembering a detail of the conversation, just like Cooper apparently forgot he'd mentioned welfare reform to Rove. Big deal.

I'm just counting every thing the prosecutor counted. Note also that a continued story totally internally consistent with itself, but totally inconsistent with the testimony of multiple other people indicates lying, especially when the consistent testimony conveniently removes liability under the law. A big red flag in testimony.

But back to my original question--was what Libby and Rove did morally right? I'd like everyone's opinion on that.

Setting the record straight to counteract malicious lies (Cheney sent me) always seems to be considered the right thing to do unless it's done by Republicans.

Since Fitz didn't get the whole story from reporters, his version is incomplete and unlikely to be accurate.

I just finished watching Woodward on LKL.

It wasn't Cheney.

Larry somehow got woodward to say:

"I didn't interview Cheney during that period."

But there was something wierd...when woodward was talking about the release the name Andy Card came up and I missed the context. I need to see the transcript.

My first thought, though, was not Armitage.

RobW. What did Libby and Rove do? It seems to me nobody has proved they did anything. Did Wilson, or the press in general, identify Wilson as a Kerry campaign operative when he leaked his story to Kristof, Pincus or the NYT editorial board? Did he actually think that he was going to get any privacy once he did this? Did he think nobody would wonder how he got the job? If he had identified himself as a Kerry campaign operative who had gotten a consulting job because of his wife's connections, this would not have ever been a story.

Myabe you should start by offering your own.

Earlier you objected that they should not have dragged Wilson's family into it.

A rebuttal that would convince me is that she was a legitimate part of the story - first, even in the indictmnet we see that someone from the CIA siad she was involved in picking her hubby for the trip.

Secondly, even if she was not specifically involved, Wilson's credibility as a neutral observer to the CIA/WH dispute over intelligence is undermined by the fact that he is married to a participant in the dispute.

If Andrea Mitchell appeared on the eveing news and told me that Alan Grenspan was a great American whose policies had improved countles millions of lives, am I allowed to say, hmm? Or is that smearing her, and dragging her family into it?

(If that is too obscure, isn't the gist of Wilson message, "My wife's group was right, the WH was wrong"?)

Or, one might say, it is immoral to knowingly out a covert agent. Well, sure - but do we know that that is what happened? I, for one, do not.

Syl mentions the interesting fact that the supposed contradiction between Libby's and Miller's testimony isn't used as the basis for either a false statement or a perjury charge; it's only used as a basis for obstruction of justice. Also, while the background section of the obstruction charge mentions that Libby said Wilson's wife wasn't discussed in his July 8, 2003 meeting with Miller, while Miller says she was, it isn't used as a basis for the charge. Only the July 12 meeting is used, and the allegation is almost exactly the same as the one involving Cooper: that Libby didn't qualify what he said by claiming it came from other reporters.

I'll offer a theory that might explain these strange omissions. Fitzgerald knows how pitifully weak Miller's testimony is, but he wants to allege that Libby mentioned Plame before Novak began writing his column; otherwise, it's harder to argue that Libby couldn't have heard about Plame from reporters as he claimed.

What has happened to the conservative movement? Where is responsibility, morality, the idea that right is right and wrong is wrong no matter who is doing it? That was conservatism's most important contribution to the national debate--reminding liberals that no matter what the conditions that created crime and malfeasance, those who did wrong should be punished. Now apparently these rules don't apply to conservative officials. Lying before a grand jury is nothing, or explained away in a haze of half-baked theories (yes I've advanced them too), despite the fact that a deeply respected federal prosecutor thinks multiple crimes were committed.

Its plain wrong to draw someone's wife into anything--why does it matter who sent her? Who cares? Why not attack the conclusion? Because Rove & Co. couldn't. That's right, Wilson was right about Niger. So what did Rove try to do? Distraction, attack the messenger. And people wonder what happened to debate in this country.

Its morally wrong to attack a family member in a political debate, period. What did she do wrong? Where is her behavior wrong? Please do not tell me that its a boondogle to wonderful West Africa--If he was going off to Paris, perhaps, but a trip to Niger is hardly a fun trip. He didn't even get paid for it, just expenses.

Although the CIA hasn't done a damage assessment, no matter what there was a risk that the outing of Plame might expose CIA secrets. It was totally unecessary, a piece of political theater--or an attempt to distance Dick Cheney from the forged Niger documents that everyone is trying their best to run away from. But don't take my word for it, take William F. Buckley's.

I miss his contributions. I thought some of his positions were detestable, but you knew that he would call a spade a spade. Please. It is wrong to deliberately compromise the identity of a CIA agent who merely suggested that her husband might be the right person for a mission to find out whether or not Saddam was buying uranium from Niger. She had no political agenda--nobody even knew the answer to the question.

Ahem. Pasted directly from the indictment, page 13, part of count 1, perjury in violation of 18 U.S.C. s 1503. Libby is charged with lying about what he said to Miller:

c. LIBBY did not advise Judith Miller, on or about July 12, 2003, that LIBBY had heard other reporters were saying that Wilson’s wife worked for the CIA, nor did LIBBY advise her that LIBBY did not know whether this assertion was true; In violation of Title 18, United States Code, Section 1503.

TM, this weekend I saw Eric Burns show on the media (Fox) and I found it appalling that every single media observer on that shoe misrepresented what Fitz found--every single one talked of Libby telling reporters about Plame. And Jane Hall teaches future journos! And the others report on the story..Maybe they spend too much time in the bar and grille and not enough time online..

I watched the Woodward interview when they replayed it last night. He was talking about three people. 1. His source. 2. Andrew Card. 3. Scooter Libby. His source is not Card or Libby and I missed the part where you saw him say it wasn't Cheney.

We have a fundamental disagreement on what actually happened here. I assume that you believe that:

1) Joe Wilson bravely came forward to correct lies by the Bush Administration about Saddam’s purchase of yellowcake from Niger
2) Valerie had little to do with Joe’s trip to Niger & was, in essence, an innocent, uninvolved family member
3) Libby, Rove & others in the Bush Administration embarked on a malicious scheme to discredit Joe & out Valerie, with (at best) reckless disregard for her safety & possibly the safety of others
4) Fitz wasn’t able to indict any of these nefarious conspirators due to their lying, perjury & obstruction of justice
5) At least Fitz was able to indict Libby
6) Prosecuting Libby will eventually unravel the whole thing, leading to further convictions (& possibly impeachment?)

Please let me know if I’ve missed anything or if I’m in error on any of these. If that had happened, I would agree with you. However, some of us interpret the situation very differently:

1) Valerie was very involved with Joe’s trip to Niger – she “offered up” his name, she relayed the message to him, she was present at his debriefing (at least initially) and she gave Joe her opinions about what he would find before Joe even went to Niger
2) I suspect that she passed classified information to Joe (concerning the forged documents? Other issues?) – both before & after Joe’s trip (while he was working for Kerry?)
3) I think Joe’s trip was indeed a boondoggle, which was mostly inconclusive & changed few minds, though Joe did tend to confirm that Saddam sought (but not bought) yellowcake from Niger (I’m not sure how serious those efforts actually were, in fact, they could have just been more of the games Saddam was playing)
4) Joe didn’t sign a confidentiality agreement about his trip – even if I assume that was due to incompetence, rather than some far-reaching CIA plan, it’s continuing incompetence that was never rectified
5) Because there was no confidentiality agreement, Joe could lecture about what he didn’t find in Africa (no completed transactions, as opposed to no interest in purchasing yellowcake) as well as hire out to the Kerry campaign & shop his story to reporters
6) Valerie was complicit in Joe’s efforts – if she was really concerned about her safety, at some point in the process, she would’ve raised that point with Joe & told him to cool it
7) The CIA was complicit in this process, too – if the CIA felt that there would be any damage or that there would be any danger or safety issues, they would have told Joe to cool it before his Op-Ed in the Times (possibly even before the 1st Kristof column) – I think the CIA did a damage assessment, formally or informally, before Novak’s column
8) Even if Joe never actually said that Cheney sent him to Niger, others were saying or implying that, thus it was implied that Cheney not only should have known, but did know what Joe found (or didn’t find) in Niger
9) Rove, Libby & others wanted reporters to know that Cheney didn’t send Joe to Niger, therefore why Joe went & who recommended him for the trip became an issue – they might not have chosen the best or most effective means to convey that, but it was a significant issue
10) It wasn’t so secret that Valerie worked at the CIA – she actually worked at Langley, she’d been outed several times before, Hadley discussed her status with Novak, others were discussing the fact that she was with the CIA (Joe? Armitage?)
11) Fitz bought into the wrong story & didn’t conduct a thorough investigation, but he didn’t indict anyone for conspiracy or outing Valerie, even though he knew Novak’s source

So, after all of this, I have some questions for you, RobW:

What is it that you think is so morally wrong here? Who did it? Who, if anyone, outed Valerie? What reporters did Rove tell about Valerie? What reporters did Libby tell about Valerie? What’s morally reprehensible about saying “I heard that too?”
