The Associated Press has learned the officer was a CIA veteran nearing retirement, Mary McCarthy. Reached Friday evening at home, her husband would not confirm her firing.

In McCarthy's final position at the CIA, she was assigned to its Office of Inspector General, looking into allegations the CIA was involved in torture at Iraqi prisons, according to a former colleague who spoke on condition of anonymity because the case is under investigation.

The Post's Dana Priest won a Pulitzer Prize this week for her reporting on a covert prison system set up by the CIA after Sept. 11, 2001, that at various times included sites in eight countries. The story caused an international uproar, and government officials have said it did significant damage to relationships between the U.S. and allied intelligence agencies.

Post Executive Editor Leonard Downie Jr. said on the newspaper's Web site, "We don't know the details of why (the CIA employee) was fired, so I can't comment on that. But as a general principle, obviously I am opposed to criminalizing the dissemination of government information to the press."

Justice Department officials declined to comment publicly on the firing and whether the matter had been referred to federal prosecutors for possible criminal charges. One law enforcement official said there were dozens of leak investigations under way. Another said there had been no referral from the CIA involving the fired employee, normally a precursor to a criminal investigation. Both spoke on condition of anonymity because the matter is under investigation.

On the NSA - definitely 798 - but this type of disclosure is rather difficult.

It seems reasonble to infer that Ms. McCarthy was one of a group of CIA careerists who strongly opposed Bush foreign policy. Lots of evidence to support such an inference. Not dispositive of anything, but definitely interesting.

I don't think that conspiracy to commit sedition can be a crime when sedition itself is not a crime.

There is a very good reason why all the CIA referrals to DoJ don't result in charges. The statutes are simply too narrow to cover what the seditionists are doing.

I would not want to be in this McCarthy woman's shoes (should the DOJ decide to prosecute her for leaking classified information). JUST THE THOUGHT of having to defend myself against the Federal government and its infinite $$$$ financial resources, vs my, by comparison, limited financial resources would scare the living bejeezus out of me.

Fitz's Farce has been illusory since the beginning if one looks at all the 'referrals' from the CIA to the DoJ and then searches for prosecutions arising from the referrals. 'Leaking' - or disclosure of classified information is illegal within a very narrow range of matters.

There may be an entire set of statutes of which I am totally unaware but I haven't found anything in the USC that fits either what McCarthy has done or what Fitz has pretended to be investigating. Consider the number of leaks of which you have heard and then think of prosecutions of which you have heard. There simply aren't many prosecutions in comparison to the number of leaks.

On April 13, the judge in the Scooter Libby case issued an order (pdf) asking both sides to submit grounds in writing why a gag order should not be imposed as a result of disclosure of non-public information to the media and statements lawyers had made to the media about the case. Their responses were filed today. [Libby Response, Fitz Response, Fitz Affidavit.]

Shorter Fitz: His office didn't leak anything and because his office doesn't talk to the media about the case he takes no position on whether there should be a gag order.

Shorter Libby: Team Libby admits to two disclosures, explains and justifies them, (quite well in my opinion) and opposes a gag order.

I think the Judge will not issue a gag order based on Libby's response. The longer version:

Rick, perhaps it is naive of me, but I always figured the reason we don't see many prosecutions is because the prosecution itself would reveal even more sensitive information than the original leak. Perhaps that is the loop hole that these leakers count on ... they can't prosecute me without jeopardizing the whole show, so I'm safe to leak anything, to anybody, at any time. I never thought it was because the law was too flimsy to make the case that what they are doing is against the law. That's a whole new idea for me.

You're talking about journalists here - unless they are spoon fed they find nothing. McCarthy probably held Priest's head as she fed her but the Abu Ghraib 'scoop' belongs to Uncle Sam.

Larwyn, even if Mrs. McCarthy doesn't end up being prosecuted, every moment of her entire life is going to be under the microscope. Her legal bills will be astronomical (as well they should be).

Yes, I suppose someone may pony and help her financially, but they can't carry her water for her. Life as she once knew it is OVER. The press may laud and praise her for her "courage" but it the wee hours of the morning, only Mrs. McCarthy is sitting there contemplating the unknowns of financial ruin and a Federal Penitentiary.

I don't want to go way off topic, but out of curiousity, am I the only one here who thinks these Duke guys should be hung by the cajones?
