The not-always reliable Jason Leopold of TruthOut set hearts fluttering with his story that Rove has been indicted and Fitzgerald has met with Rove's attorneys to work on a plea deal.
TruthOut helpfully provides a compendium of Mr. Leopold's earlier work on this investigation, so we can see for ourselves how often Rove has been near indictment before.
Let's note that the latest story has already evolved slightly - here is the current lead:
Special Prosecutor Patrick Fitzgerald spent more than half a day Friday at the offices of Patton Boggs, the law firm representing Karl Rove.
During the course of that meeting, Fitzgerald served attorneys for former Deputy White House Chief of Staff Karl Rove with an indictment charging the embattled White House official with perjury and lying to investigators related to his role in the CIA leak case, and instructed one of the attorneys to tell Rove that he has 24 business hours to get his affairs in order, high level sources with direct knowledge of the meeting said Saturday morning.
The original report gave Rove "24 hours"; the correction to "24 business hours" was inserted after, well, nothing had happened in 24 hours. Personally, I have heard folks speak in terms of business days, but never "business hours" - if Federal guidelines require clerical overtime after an eight hour day, does this really mean that Rove has Monday, Tuesday, and Wednesday to get ready? Maybe that will be the next clarification.
And no worries - if nothing happens, no less a reporter than Steven Leser has already stepped up to explain that Mr. Leopold was the innocent dupe of a subtle yet vicious BushCo disinformation campaign.
Meanwhile, Rove spokesperson Mark Corallo has denied this to the NY Sun, Byron York, and (I'll bet) other news outlets who aren't going to dignify the initial report with any coverage. [UPDATE: Good guess - Jeralyn Merritt runs a forceful denial from Rove spokeman Mark Corallo which includes this:
7. He has received calls from the major papers on this and denied the story to all of them.]
All that said, I am personally predicting (with 70% probability) a Rove indictment for this Friday, May 19, with a second guess of Wednesday, May 24.
Fortunately, I have no sources for that. And as to track record I was OK with my predictions (but erring to pessimism) last fall, when I predicted indictments for Libby and two others, but not Rove.
MORE: Jeralyn Merritt talks to Jason Leopold (and gets an astonishing rebuttal from Rove's guy Corallo) and articulates my own hunch, which is that Fitzgerald may have been negotiating with Rove's team about a *possible* indictment:
I'm wondering: Did Jason's sources understand the difference between Fitzgerald handing over a copy of the charges he said Rove would be indicted on if he refused the offer Fitz was making and an already voted-on Indictment?
It's hard to believe folks could get that wrong, but that may be the best reconciliation we get, unless someone (or lots of someones) are just making stuff up.
GOOD POINT: Maybe "instructed one of the attorneys to tell Rove that he has 24 business hours to get his affairs in order" meant that Rove would have to surrender during the next episode of "24". Boy, if Rove is threatend with missing Jack Bauer in action, he'll turn in a second.
OUCH: Making some stuff up and plagiarizing the rest? No, not Ben Domenech, but Jason Leopold - Salon tells their story.
UPDATE: The National Journal Hotline tells us that:
Rove Speaks!
WH DCoS Karl Rove spoke at the American Enterprise Institute this a.m. and to the surprise of some, he took questions. Asked about his role in the CIA leak investigation, he declined to comment, referring the questioner to a statement released by his attorney. Rove: "I have nothing more to add. Nice try, though."
Let's call that a tearful confession, then! Meanwhile, who has received the statement from the attorney?
MORE: Details here:
CORN: David Corn from “The Nation Magazine” on a different subject. Scott McClellan told the White House press corps, many who are here today, that he had spoken to you and you were not involved in the CIA leak. Can you explain why the American public, almost two and a half years later, hasn’t been given an explanation and don’t you think it deserves one for that misinformation because it does seem you were to some degree, though maybe disputed, involved in that leak?
ROVE: My attorney Mr. Luskin made a statement on April 26th. I refer to you that statement. I have nothing more to add to it. Nice try, though.
MAKING SENSE: Peter Daou of Salon (Leopold's on-time employer) is spot-on with his skepticism:
My concern - and the reason I write this - is that Leopold's ubiquitous reporting has set expectations very high in the blog community. We're at a moment when blogs are under assault by prominent media and establishment figures. I wouldn't want to see him used as a cudgel to flog the progressive netroots as a bunch of conspiracy nuts. There's enough of that already. We don't need to provide ammo to our opponents.
No worries - like chipmunks, we can find the nuts easily enough already.
IMO, Larry and Joe are attempting to practicing "Death by a thousnad cuts". They see this as an opportunity to weaken Bush and Rove. The only thing Bush and Rove have said is they would not comment on the ongoing investigation. So Larry and Joey are taking the ball and running with it.
As for a Rove indict, I predict June 31st :-)

Just for the record, disclosing federal grand jury information is not a crime, it is simply a violation of Rule 6(e) of the Federal Rules of Criminal Procedure. It is punishable (I believe) only by civil contempt proceedings. Also, it should be kept in mind that the Rule is only binding on the grand jurors and the prosecutorial and court staffs. Once the cat is out of the bag, outsiders are free to disseminate the information. If someone in the prosecutor's office gives a heads-up to a defense attorney, I don't believe that a violation has occurred.

I think Wilson and Johnson have always been Leopold's main sources, that's why Leopold has no problem printing false story after false story - Leopold gets called the mat? Well, it's what Wilson (the bearer of all things honest right?) has been telling, not his fault Wilson's been fibbing to him.
If you follow TalkLefts posts, she talks to Luskin (rude late at night on weeked), then when the story gets even wobbly Jason says he will out his sources if the report is wrong and then?
Up pops Larry out of the blue (as a thrid time poster at DU? Not hie won blog?, even DU'ers aren't sure it is him) getting a jump start on outing WIlson and noting Leopold has 3 sources (as in, not just me and Joe) -
here is the order of Larry
DU 1
--It is not just Jason Leopold. Joe Wilson heard the same from other sources. And, more importantly, Jason is reporting based on multiple, more than two, sources. His editors realized what a big story this is and did the appropriate checking before posting. They are called Truth Out for a reason. Getting the truth out--
DU 2
--I, Larry Johnson, owner of NoQuarter.typepad.com, do solemnly swear that I am the one who posted the piece re Jason Leopold. Check it out on my blog. I spoke with Joe yesterday. We're all hopeful that the sources who spoke to Jason and Joe separately aren't doing drugs of some sort.
LJ--
Sexion-
--Seixon,
You moron. You could never be an intel analyst. You're only good at leaping at conclusions. Try this on for size--I did not know about Jason's story until he posted it on Truth Out. Truth, try it sometime, you might like it.--
TL -
--Joe heard the same things but not from Jason. If these multiple sources are lying then I certainly hope Jason outs their a*s.--
Damage control on his goof-ball statements?
I especially like how he tells Seixion that he had no knowledge of jason report AFTER he informs DUer's how through his colleague at truthout's appropriate checking...and I love how he has to s e p e r a t e Joe from Jason after he pretty much tells us Joe is Jason's source.

Talking of Iran - the Iraq war is the best thing that happened to them in years. Their sworn enemy is gone. The Iraqi government has already made overtures to them and made deals on trade and military cooperation. And there was a visit by the Iraqi Prime Minister and his eight cabinet members to Tehran in 2005. Oil has gone through the roof providing the Iranian mullahs with loads of cash.
The United Iraqi Alliance which received 140 seats in the 275 seat National Assembly has many members and parties that lived in exile in Iran and support the 1979 Islamic Revolution. The former Iraqi Prime Minister (who is still a heavyweight within the party) has lived for several years in Iran, and when he went there last year he paid a visit to Khomeini's tomb and placed a wreath there.

Saddam was no longer much threat to them. Higher prices do benefit them as well as others. Iran is isolated now as the most thuggish local element. A net negative clearly for the mullahs. Why do you think they've let a mad man be their voice? Desperate, I say, desperate.
Kerry was another Carter for them, and now they've got Russia and China wary. Time and tide slipped from them. There was quite a crescent from Pakistan to Libya and now the most treacherous of the bunch is isolated in the middle.

I've been scavanging up some bits & pieces for our amusement while we're loitering about, waiting for our designated 24 (business) hours to pass. Don't forget that the offical business day is only 8 hours long! A fact which will, no doubt, be pointed out by Leopold's cabal of truthseekers any moment now, if they haven't already manned that rampart.
In a Yahoo report on Rove's apparently indefatigable good spirits, Watergate purp turned gadfly, John Dean, puts that cheery countenance into perspective for us:
Stop the Presses! Howard Kurtz tells us Leopold's publisher has cancelled his book. Couldn't happen to a nicer guy....
In Leopold's Friday headliner Rove Informs White House He Will Be Indicted, this paragraph seemed eerily familar:
It was the same allusion to a "low-level staffers and senior officials" gabfest (gripefest?) that I found myself wondering about nearly seven months ago, in a WaPo piece by VandeHei & Leonnig . You can also "read the whole thing," as the saying goes, over at
Truthout, where, oddly enough, it was reproduced in full. Similarities abound throughout, but maybe that's because Leopold isn't the only one posting the same stories over & over again.
It certainly looks like CNN's caught the recycling bug. They seem to think that Fitz is Closing in on Cheney
Who knew?Posted by: JM Hanes | May 15, 2006 at 05:24 PM
Chris Matthews had Mike Isikoff and Eric Lichenblau on to talk about the CIA Val Plame case. At the end he asked Mike any indictments coming down? and Mike says" no, we haven't heard anything." Shuster attempted a time-line but big push was made about Cheney writing in the margins. Eric thought this was an orchestrated attempt and why Libby would lie to gj. Very shaky ground and a thin premise. I consider it admirable restraint that Shuster and Matthews didn't lead with the Rove Indicted story. Obviously they felt that one was over the top. Then to appear balanced Chris had Nicole Wallace on to talk about immigration reform and President Bush's speech which is the STORY of the day but you would never know it on Hardball.

VIPS is of course 100% behind the Wilsons. Johnson has known Val since he was in the CIA nearly 2 decades ago, and has since gotten to know Joe. I'd imagine that Ray McGovern and others in VIPS are pretty good friends with them as well. So it's not as if we should take anything any of them say as if it were anything other than pro-Wilson biased spin.

Just posted the following in comments at truthout. Wish me luck....
Now the former Los Angeles Times and Dow Jones reporter has written a book, "Off the Record," that criticizes journalists as lazy. Oh, and by the way, Leopold says he engaged in "lying, cheating and backstabbing," is a former cocaine addict, served time for grand larceny, repeatedly tried to kill himself and has battled mental illness his whole life.
"I'm devastated," Leopold said yesterday. "I worked really hard these past two years to restore my credibility after the Salon fiasco. . . . I have a checkered past, and I was hoping that by coming clean about my own past, it would allow me to move forward."

For example, in a report on a blog that reviews Leopold's articles (SEIXON), Leopold had an article in October on Fitzgerald's broadening his investigation to review pre-war intelligence. Shuster had a breathless report almost the same day on the same topic.

Seixon,
One of the things Larry didn't want to discuss with me by deleting it almost as soon as I posted it was just how long he has known Joe Wilson and Valerie P. He came out of the starting gates in their defense with lots of knowledge about someone he only knew as Valerie P until, according to Larry, he realized the Valerie Plame was really his very own Valerie P. When I asked him about how he knew so much so quickly, enough to become the instant "go to" person on all things Joe and Val, he deleted my post. He only deletes that which he considers getting too close to the truth, from what I've seen over there, anyway.

Interesting responses to the new Luskin post at talkleft. Now they're saying, "Don't trust Jason Leopold".
Posted by: Lurker | May 15, 2006 at 06:42 PM
And Jason's still sticking to his story:

"Rob
I have now been turned into the story—again. Robert Luskin and Mark Corallo, Rove’s attorney and spokesman, are liars. Damned liars. I have five sources on this. In the news business when you want to discredit a reporter and an explosive report you call the spokesman and get him to issue a denial. My reports have gone way beyond the spokesman and the lawyer to get to the truth. I am SHOCKED that the mainstream have followed this up by simply calling a spokesman.
Best
Jason Leopold"

He's got 5 sources and no one else has any. A nest of vipers, exposed to the light and air.

I just posted Kurtz's quote about Leopold's background over at Crazy Larry's site. It will be interesting to see how long it stays up.

5 sources: Toe Joe Wilson, Larry Johnson, Valerie Plame, Marc Grossman, who else?
Does it mean that Fitz is a good friend with any of them?

Which one is going to sue first?

Peter,
It won't open for me.

American Spectator Blog has postings that report Leopold used a false identity when he called Corallo. He used a British reporter's name and the reporter was quite miffed that Leopold used his name.

And collect against which deep pocket? Leopold? Truthout? LOL

It's all a Rovian diversion so nobody sees the iceberg.

BIG News: A Brit Impersonator - Monday, May 15, 2006 @ 5:54:01 PM
In the blog post immediately below, I report on the apparent false identity scam used, according to our friend Mark Corallo, by lefty blogger Jason Leopold, in the course of spreading apparently false stories to the effect that Karl Rove had been indicted. Now it gets even better/weirder: In the course of talking to Corallo under the identity of a reporter for a British publication (conversations Leopold himself reported on, but without the little detail about having used an alias), Leopold gave Corallo a number to call back on. When Corallo tried back, Corallo said, the number didn't work. Well, just in the few minutes since I posted the tale below, I got the following e-mail from Corallo:
"Gets better – at 4:00 p.m. today I got a call from a guy named Joel Loria of the London Sunday Times!! He was a bit miffed (to say the least) that Leopold used his name. And the phone number was one digit off!"
This is really getting fun! Calling Janet Cooke, in addition to Jayson Blair and Stephen Glass.....

Dwilkers
In the perpendicular to reality world, Corallo is Rove's official spokesman, ergo he's a liar. Of course, it doesn't help that "Deny, Deny, Deny" is Numero Uno in the Official Spokesman's Handbook.
It should be clear before too long whether Leopold got it right, got it partly right, got it wrong, got used, or got nothing. I say should advisedly. If Rove's still standing at the end of the week, I think it's worth challenging Truthout directly to publish the truth, the whole truth & nothing but on this one, whether or not Leopold himself proves willing to out his sources.

Here is the first post...
VERY Weird Rove/Corallo Story - Monday, May 15, 2006 @ 5:38:31 PM
I spoke today with Mark Corallo, PR man and straight shooter extraordinaire, who told me a whale of a story about the whole crazy rumor over the weekend (on Lefty blogs) that Karl Rove had been indicted and would resign. Rather than repeat the whole thing, let me give you this left-leaning blog site, Talkleft, which has the full run-down (a run-down Corallo himself confirmed to me was accurate). The long and short of it is that it seems as if the lefty blogger who first reported the indictment story not only got it all wrong, but then (according to Corallo) represented himself under a false identity to Corallo. More from Byron York on this here. This has the whiff of Jason Blair/Stephen Glass stuff. Stay tuned.

Interesting email from a lawyer in Michigan:

Guess MTLA is looking to collect against some deep pockets, huh?
Posted by: Lurker | May 15, 2006 at 06:57 PM
Clarice,
Think Democrat, use the law to close them down.
Posted by: PeterUK | May 15, 2006 at 06:58 PM
JMHanes: You are way too generous to Leopold. He has been saying that Rove will be indicted any day now for months.
If Rove is indicted Wednesday or Friday, that does not vindicate Leopold.
The whole story he spread around has to be true. And the 24 hours are up.

Peter,
I thought he would have warts on his nose or something. ::grin::
Posted by: Sue | May 15, 2006 at 07:07 PM
But, Kate, Jason Leopold said that Rove is already indicted as of last Saturday.
Posted by: Lurker | May 15, 2006 at 07:08 PM
I'm not sure who will sue first, but Joel Loria will collect first.
