Wait a second here. I have to brush up on my American history. The declaration of Independence was in 1776 I know that. And some tell me here the Constitution was in 1789. Didn't the Constitution make the US an official country? Or was it the Declaration of Independence that made the US a country? Must google later I suppose. Just using logic, I would think a country is not a country until there is a Constitution.

So if you read the constitution literally, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President" only people who were citizens living in 1789 would be eligible and we would ALL be disqualified! We would need some Nacny Reagan seances to bring back the dead.

Wasn't there some kind of 5 year provision when the mother was under age at time of the birth and the father was not a citizen? I can't remember it exactly and I'm not going to go to the trouble to look it up.

Relaxing the requirements to those who are U.S. Citizens opens up a whole new can of worms. Sleepers and moles are very patient and could easily become citizens and then who knows what mayhem might ensue?

As to the birth certificate issue: the only reason I remain skeptical about Obama's legitimacy as a "natural born citizen" is because of his own actions in spending millions to avoid having to produce an archival copy when he could quickly put the matter to rest with a $15 fee to get a certified copy of the original. Why? Explain that and then I won't wonder any more.

The constitutional conventiion provided that it would go into effect once it had been ratified by nine states. The ninth state--New Hampshire--ratified it on June 21, 1788 and the US government began operating under the constitution on March 4, 1789.

Well Sue, I will combine your and my theory to make a grand theory.

Obama was adopted by his stepfather which sealed his original birth certificate.

Sotero and Dunham then revoked Obama's US citizenship and stuck with his Kenyan/British citizenship because they were going through an anti-American stage and didn't want Obama drafted in any US capitalist pig wars like the Vietnam War (was it going on back then? - must google dates). They probably thought about turning him into an Indonesian citizen eventually.

Once Obama's original birth certificate was sealed after he was adopted, he had his US citizenship restored when he got back to the US by his grandparents, and got a copy of the short certificate. However, he could not get a copy of the original long certificate because it was modified or removed because he had been temporarily a Kenyan citizen.

Since his original bc cert was sealed, and he could not get another long one, he could not release it. He could further not tell us why he could not release it because for anyone to know his citizenship was revoked for a short period of time would cause an uproar amongst the bitter cling crowd.

I think that's the best one yet if I do say so myself.

McCain was born in a military hospital on a military base. These, like Embassies, are normally considered U.S. soil, aren't they? If not, I have a lot of friends from our 26 years in the Navy, who have children born while the families were "on orders" out of the country who would now have questionable citizenship. Places such as Germany, Japan, Rota, Spain, and one in Iceland.

I don't think Obama would be declared ineligible if his original birth certificate surfaces. I think he is hiding something, but not where he was born. The rest of my ramblings are just my theories as to why he doesn't want to produce a birth certificate. He was enrolled in school under Barack H. Obama, Jr. He would have had to present a birth certificate. No one would have questioned it, if it was the original, which his mother/grandparents would have had. The adoption would have been sealed as if it never happened. No record. Which is why it is so hard for adopted children to find birth parents. They have to know something in order to find the paper trail.

I don't know if your theory is correct or not re: Obama, but I do know that when we adopted our daughter, who was the child of friends of ours, the attorney, the judge, and the social services rep all made it clear that once the adoption went through and the birth certificate was changed, there would be no way to ever prove she wasn't ours "from birth." I didn't pay much attention to these warnings at the time, but it must have been important since it was repeated at every step along the way, not just to us, but to the mother about to give up her child.

If Barack was legitimately adopted by Soetoro, it seems strange that there would be any record of birth listing Barack Obama, Sr. as the father. But, every state was different back then.

So the Viet Nam War was raging when Obama went to Indonesia when he was 8 to 11 in 1969 to 1973. I would bet $25 bucks the parents revoked his citizenship so he couldn't ever be drafted.

How that effects birth certificate records, I am not sure, but it probably does something.

Hmmm. Well then Obama should have Sotero in the bc. Hmmm. Maybe Dunham secretly became a citizen of Indonesia or someplace else at that time because she didn't want to be capitalist pig American anymore. Or maybe, she was in the CIA and became Indonesian for cover.

Then when Sotero adopted Obama, Obama then became an Indonesian citizen because both his stepfather and now his mother were officially Indonesian citizens, and the modified birth certificate showed him as an Indonesian citizen.

When Obama went back to the US the grandparents restored his US citizenship and revoked his Indonesian citizenship which is why there is no record of Obama being an Indonesian citizen now. The grandparents got a new short bc, but could not get the long one, because the long one shows Obama as Sotero's son and a citizen of Indonesia.

It seems there must be a subset of people who were U.S. citizens at birth but are not considered natural born citizens.

What is interesting is that the dems, and the conservatives who have allied with them on the birth issue, don't seem to be interested in settling the issue. Instead, they smear, sneer, insult, and question sanity.
It looks more as if they wish the question would go away without resolution. When, if there were no problem, proving it being simple, they could certainly make the nirthers look foolish.
Instead, they call the nirthers foolish while refusing to provide the actual document which would put the whole thing to bed.
Seems reasonable to presume there's something going on, and one possibility is that the anti-nirthers smell a spot of difficulty here. Dems don't want to lose a loser president and some conservatives may be afraid of the results of finding out this guy is ineligible (like civil war).
They could solve it by answering the question BUT DO NOT. Instead they attempt to ridicule the questioners into stopping.

He's thought by some to have leaked a recent report that appeared to have unfairly criticized Sarah Palin for her legal defense fund and has given money to Democrats over the years, as well as being a partner in a law firm that represented Obama's political campaign. Yeah, one can't get much more ethical than that (story link here). Good grief!

Well that is a good way to put it. Makes sense. So it doesn't matter then where the person was born, as long as they didn't become a citizen through a citizenship process.

So using that interpretation, it is a myth that someone needs to be born on US soil to be considered for the Presidency. McCain back on.

So according to that, even if Obama was born elsewhere, as long as his mother was a US citizen and established minimum residency time requirements, Obama would be also a natural born citizen.

That's why I'm sticking with my Indonesia adoption theory, because although it doesn't effect his natural born status, having revoked your citizenship even as a child, would be a minor scandal.

I believe the statute DoT quoted said that both parents must be US citizens for a child born outside the US to be a citizen at birth. So it doesn't apply to Obama regardless of Indonesian adoption status.

IMO, there is something real strange about people saying that we should stay away from discussions of Obama's birth certificate/birthplace. When the Grandmother that raised the child (for most of his years) and the other people in Hawaii that must have known something, can not figure out which hospital he was born at, in the 1960s; there has to be some kind of a problem. It's not like there were dozens of possibilities. Some doctor, some nurse, some hospital administrator, some one has to have been there. Are we to believe that the press can find a witness to John Kerry going ashore to kill someone on the bank of some river in Vietnam, 40 years after the fact, but no witness can be found in the largest city in Hawaii to the birth of a baby of a daughter of a bank vice president. The entire fiasco defies imagination.

Last year, Adam Liptak in the NYT reported that Gabriel Chin of the University of Arizona concluded that McCain was not a natural born citizen, since the legislation related to the Panama Canal Zone postdated his birth. I suggested at the time that Prof. Chin have a look at the relevant statute from 1934.

I believe that when Obama was born his mother was not old enough to have completed the number of years of residency in the U.S. then required under the statute in order for any children born outside the United States to a foreign father to be citizens at birth.

I'll take it under advisement. Maybe his handlers can't make the overexposure connection either? I was surprised by the lecturing and anger in his sermon on healthcare personally. A very strange way to sell a policy, by his own admission, which has been "unsolvable" in DC for decades (maybe a hint that the solution can't be found in DC).

The Cambridge PD story really is bizzare, but it does take the focus off the healthcare debacle, and with Gov. Palin resigning this weekend, any sort of side deal or House procedural chicanery won't break through the news. The more important story is going to be the "national lecture on race" and "the quitter". Healthcare, and the little conference deal that is being cooked up by this distration, will be shown through the soft focus lens of heartbeaking anecdote and maybe salted with an extra bit of race. Axelrod, whenever he gets into a jam, plays the race card.

W. Teach, I went to the Wikipedia entry you cited, and I found nothing there that would support the idea that a person who was a citizen at birth is not natural-born. There is of course plenty of authority that one born on US soil is a natural-born citizen, but no reason (or precedent) to believe that that category exhausts the field.

I think the most authoritative legal memorandum on the subject was written by Laurence Tribe (very liberal professor of Constitutional Law at Harvard) and Ted Olson (very conservative former Solicitor General of the United States). They conclude that John McCain was, indeed, a natural-born citizen eligible to be president. You can find it on Google; unfortunately the only one I found is in PDF and I can't cut and paste it.

I really don't think it's a close call. If you are a US citizen at the moment of your birth, no court in the land will ever hold that you are not a natural-born citizen.

I'm surprised that the Regime decided to bite off cap-and-trade and healthcare as part of Obama's 2010 budget. Obama was able to sign a significant expansion of S CHIP and heavily subsidize COBRA. He could have taken those two policy items as a success and made them the basis for a much more expansive reform of healthcare later in his term. His inner circle really has a tin ear when it comes to mistakes and reach.

Maybe the Chicago imports don't have much of a clue, but it was a non trivial agenda, especially with the foreign policy challanges and the recession as the backdrop.

And GS will eventually run out of government money to prop up share prices. What's the current PE ratio-24 on operating earnings-when most of the S&P are reporting numbers down 40% and 50% from last year (got that from the SP earning and estimate report-can link if interested but it opens as an excel file).

If I were a conspiracy theorist, I'd suggest that Team Obama originally replanted the long dormant seeds of the McCain controversy and then embraced the Congressional Resolution confirming his natural born status, in the hopes that the favor, in a newly bipartisan spirit, of course, might be returned. That would certainly have preempted any awkward questions, but once the birth certificate issue actually surfaced, there was no plausible way to push for a 2nd such resolution.

Because I need to bury one singular and unshakable truth that is openly admitted and laying in open sight. A singular and unshakable FACT that I have publicly confirmed.

I was a British Citizen at birth.

Not being an American Citizen alive at the time the Constitution was adopted means I am not exempt from the specific additional requirement I be a natural born citizen. I was born a British Citizen to a Kenyan father and therefore I am NOT a natural born citizen of the United States.

Nothing else is needed to establish that I am not eligible under the Constitution to hold the office of POTUS.

Game over.

I think the controversy about Bobby Jindal is equally important. There should be genuine focus there — not to be “anti-Jindal” but to be pro Article II.

Confronting the Jindal issue preemptively provides enormous credence and separation from the loonies, many of whom, I suspect, are working both sides of the disinformation curve.

Should the Jindal matter reache full national gestalt, that is when the big tumblers will begin to turn.

The founders were so specific in the NBC requirement. They were so concerned for the generational separation and established enculturation in American society that they imposed a higher standard of citizenship for the presidency.

They were so specific in this requirement. How imprudent to not give their concern and directive the most careful consideration.

Make the Obama case by making the Jindal case.

Let the truth be heard without partisanship.

As for Obama as POTUS, that’s who he is. He’s POTUS for three and half more years.

The object should not be to bring him down. He has sown the seeds of his political demise and he will reap them. I have no malice toward him. He won. That’s power. The Republican Party is as responsible as the Democratic Party. McCain was little different and Jindal is no different.

The critical mass of politics and political media today is too profoundly conflicted and corruptively intertwined to provide the leadership this issue needs. Further, the issue is not Obama or Jindal, though defining Jindal’s non-eligibility is the key to creating a correct and broad public understanding of Obama’s stunt.

The object should be to uphold the Constitution. The object should be to spread the learning and growth of Constitutional understanding within our populace and among our youth.

Our Constitution and its living relevance is the object of the exercise.

Let that be our focus.

Let go of the malice and speculation.

All the facts needed to establish POTUS ineligibility are admitted by Obama himself.

Were he not born in the US of A, then I think the law is pretty clear that his mother was not old enough to automatically confer citizenship on him. I think the question is rather whether he assumed and maintained that citizenship. Were he born in Honolulu, I think the question of dual citizenship rendering him ineligible is not settled, and is arguable, at the Supreme level.

This is not a simple matter, and the truth, if even ascertainable, is the pea that has been successfully hidden under the thimbles. The problem is no longer the place of birth or his eligibility, rather it is the implied deceit involved in resisting the call to be forthcoming about a historical document, and the deliberate disobedience to a reasonable request from the people.

In 2009 the idea of getting ducks in a row over a custody suit seems like the most normal thing in the world, so does a pre-nup, the idea of prayer neither prayer or corporal punishment in school and many other things.

In 1961 that was not the cultural mind set. The concept of divorce itself was not very well excepted outside of Hollywood or the elites. Black Americans were being denied the right to vote in many states and you think a Black African was going to win a court case against an American mother to keep her child?

The idea of preparing to fight a custody battle at the time of marriage would be as far from her mind as the idea of Twittering her birth announcement.
