And Rahm is reported to be phoning Congressmen begging them not to criticize the osque. It should be illegal to hav as much fun as I'm having this week.

By the way, for those who are waving the First Amendment around in support of the local approvals for the Cordoba mosque, I would think that you folks would be especially desirous of a full investigation. If the mosque was pushed by public officials in preference to the rebuilding of the Greek Orthodox Church, it is the Christians, not the Moslems, who may have the First Amendment claim. We don't know that the mosque was given preferential treatment, but I'm sure all the mosque supporters will join me in demanding an investigation to ensure the integrity of the process.

The real religious story here may be that Christians have received shabby treatment by local officials. See LUN for an article pertinent to this issue.

Here's my guess. Bush would speak calmly in measured terms, of course. He would want to know who's building the mosque. If it's Islamist (fundamentalist, Islamofascist, whatever you call it) Muslims (which it is), he'd speak against its location. If it were genuine moderate Muslims, he'd speak in favor of it.

Some of what he'd say might rub you the wrong way, but you'd have respect for his point of view.

This was after Patrick Fitzgerald was appointed by Eric Holder under heavy pressure from Nancy Pelosi to convene a grand jury to summon all 5,040,000 New Yorkers who oppose the Mosque and find at least one they convict for perjury.

Former President George W. Bush was quoted, as he got off his mountain bike after a 50 mile ride from his ranch in Crawford to the campus of SMU, as saying he thinks they should build the mosque on the Arizona border with Mexico.

In other news, Iran, Hamas, Hizbollah, Al Queda in Lower Manhattan and FARC have all issued statements supporting President Obama's decision to invoke the constitutional right of terror-loving law abiding religious zealots to do any damn thing they please as long as it pisses off as many bigoted, racist Americans as they can.

Re Blago's conviction on making a false statement to the federal government (the agents who spoke to him): Blagojevich and Scalia. A federal jury convicted Governor Rod Blagojevich yesterday of one single count, remaining undecided on the other 23. And for that one guilty charge, we can thank Justice Scalia:

No, Justice Scalia had nothing to do with the Blagojevich case. But in a way, he had everything to do with it.

Governor Blagojevich was convicted of making false statements to federal agents. He told the FBI that he did not track campaign contributions and kept a "firewall" between his campaign and his official duties as Governor. In other words, federal agents asked him if he broke the law -- and just like any child who is caught with his hand in the cookie jar -- he said "no."

Before 1998, this decision might have been different. Until then, federal courts routinely excused people for what they called the "exculpatory no." If a federal agent came to your house and asked if you did something illegal, and you said "no," you were off the hook for making false statements.

You could still be convicted of the substantive crime, of course, but simply saying "I didn't do it," couldn't land you five more years in jail. Courts said it was too natural for a person to deny charges against them to find them criminally liable for it.

This "exculpatory no" doctrine was not put into the false statements statute by Congress. It wasn't even in the legislative history. Congress never even considered it. Judges decided to create it because of the basic human instinct to deny, deny, deny.

That is until Scalia took on this judicially-created doctrine in a case called Brogan v. United States.

This isn't all about politics. Remember how within days of 9/11 the entire ruling class decided never to show the towers collapsing again? The video was inappropriate. Too risky. It might stoke anti-Muslim emotions, an anti-Muslim backlash.

I wonder how many of them, Democrat and Republican, are recipients of Middle East oil money. After all, Muslims only make up about 1% of the U.S. population, and surely most of those aren't old enough to vote yet.

Hm...half the board thinks I'm bubu anyway; how about this:

None of you can recognize Obama's genius. He's thinking long-term. The two fastest growing groups in the country are Hispanics and Muslims, and Obama has them both secured for the Democratic Party for at least a few generations.

Better than that, he's set things up perfectly for a progressive wave election in 2012. Everybody knows there's some public disappointment with the results of the first couple of years of Obama's legislative agenda, because he had to water down things like the public option despite his overwhelming mandate. Of course the right-wing reactionaries opposed everything he suggested without even looking at it, but there are still some throwbacks within the Democratic Party. Naturally, the conservative Democrats who oppose the progressive agenda on things like health care and financial reform also oppose the President's inclusive stance on immigration and religious freedom. Now Obama has completely smoked out his opponents within the party. Come November, those people will be out of his way.

Sure, that might give the right wing a momentary, tactical victory. Obama's fine with that. In fact, he planned it - probably as early as January 2009, when some of the Democratic timeservers joined with the right wing reactionaries in a failed attempt to obstruct the American Reinvestment and Recovery Act.

Now, try to understand this: I'm not saying this was his preferred plan. I know I'll get howls from wingnuts caricaturing my argument as "Obama wanted to lose control of Congress". Obviously not. He wanted to enact the progressive agenda that he openly campaigned on. But he respects the system of government too much to try to do it without broad Congressional support. That's why he has spent the past two years explaining with superhuman patience why Congress and the public should support his plans. Unfortunately, the public isn't able to keep up with him. So, they're going to have to learn from experience.

The 2010 election will result in a Congress that will give America one final taste of right-wing rule. The public will be able to see for themselves what happens with your kind in charge, and whether they can live up to the goals they've set for themselves of a balanced budget without cutting Medicare or Social Security, a rising stock market, full employment, etc. When they inevitably fail, in 2012 Obama will be ready to accept the public's return to his leadership.

Since the Presidential election will be a foregone conclusion - as badly as the Repubs will mess up Congress in the next two years, only the dimmest members of your weak bench will even enter the primaries, and the public will get even more tired of her if that's possible - Obama will be able to spend the whole campaign working to get the next generation of progressives elected to Congress, replacing all the inept first-term Republicans who he used as unwitting tools to sweep out the last of the reactionary Democratic deadwood.

By 2014, the Democratic coalition will have swelled to include millions of new Hispanic voters, new union members, students and recent graduates whose debts have been forgiven by virtue of their work in public service, retirees grateful that their income has been guaranteed by the government rather than being handed over to hedge funds, the Muslim community (sadly including millions of refugees fleeing from the catastrophes Bush caused in their homelands), the public sector, of course African Americans, women, GLBTTRQ, and independents who see how successful real, undiluted progressive governance is. Your side will be a handful of scared old white people yammering about how bad the 14th Amendment and the end of slavery was.

Bush would speak calmly in measured terms, of course. He would want to know who's building the mosque. If it's Islamist (fundamentalist, Islamofascist, whatever you call it) Muslims (which it is), he'd speak against its location. If it were genuine moderate Muslims, he'd speak in favor of it.

A genuine moderate Muslim would support this outrage? It's a Victory Mosque to be built on the ashes of innocents massacred in the name of Islam.
