I'm wondering whether anyone in the media will point out that the president committed a gaffe big enough to sail the Titanic through. He claimed that overturning the ACA would be an unprecedented action by the court against a duly passed law of Congress.

Has he already forgotten about Citizens United? McCain-Feingold got more support by Congress than ACA. As did the Detainee Act of 2005 which the Supreme Court nailed in 2006. I'm sure there's a whole laundry list of cases that disprove the president's completely absurd statement.

Is the president really going on a pre-emptive attack on the Supreme Court in a case where 70-75% of the public disagrees with him about the constitutionality of the law?! Really?

After his already poor relationship with the Supreme Court after berating them directly in a State of the Union speech, it seems the president risks being seen as a King who doesn't respect the other branches of government.

I'm just amazed he would be so brazen - even for him. Shocking.

Judicial activism is making up laws or constitutional provisions out of whole cloth (like the penumbras and emanations to find a right to abortion) to produce a desired result. Acting to prevent the government from overstepping its powers is precisely what the courts are supposed to do.
