We'll find out just how corrupt the legal system is, in Seminole Country, Florida. Right now, it discards all facts that indicate justification for self defense. If you discharge a firearm in reasonable apprehension of your own death, you will be charged with murder 2. Tell the judge about your fear later, all the prosecutor knows is you shot a gun, and somebody died.

I think that the thing that bothers me is the impression that she emphasizes with the Martins more than the Zimmermans, and that she may have charged him based on political considerations - that Florida was going to burn if she didn't. That ain't no way to run a railroad. And, wanted to put the onus on the judge, instead of taking it herself.

We shall see how strong her case is, likely at, as cbolt suggests, the preliminary hearing, where she will have to show probable cause why the self-defense claim is inapplicable.

The fact that Corey prayed with the family is probably grounds for dismissal or mistrial down the road. I just can't believe that they are charging him but I am quite relieved that GZ has a good lawyer now. If Trayvon were older I don't believe they would have come up with 2nd degree murder. This is a manslaughter case if they have the evidence. I don't think they do much as the media, Shapton, Jackson and Holder and Obama tried to distort the scales of justice by putting their 2 cents in.

I've never been involved in a criminal case in Florida, but I have had cases in both Federal and State Courts there, including a vivid case in Pasco County, where I heard banjo lines every time I walked into Court.

That said, it remains my unfortunate experience that the history of slavery looms large there. The Legislature formally apologized for it only 4 years ago.

My point is not that Sanford is a village full of rubes or Klansmen, it is that the theme made of this case resonates at the deepest levels. The actions taken by the State cannot fully be understood without that factor.

Face it guys: you're in the position of condoning a lynching of Martin by damning the existence of a trial for an alleged murderer and maligning a prosecutor for simply ensuring that a confessed killer gets his day in court.
For day-to-day politics, the wingnutosphere bubble -- hermetically sealed against fact and reason -- is amusing and, let's face it, provides some measure of psychological respite for identity conservative's resentment-driven paranoia and intellectual inferiority complexes.
But in a case like this, where you're talking about murdering unarmed teenagers, I'd have thought more of you would at least have the minimal dignity to admit that it's just not plausible to argue that a confessed killer should not have his self-defense claim tested in court.
That should be a no-brainer. Let all the facts come to the table and in front of a jury THEN decide whether Zimmerman's a murderer or a guy who had no reasonable choice but to kill Martin.

She is a prosecutor whose job is to use judgement in charging decisions.
She CANNOT get a conviction on 2nd degree murder, and she knows it. The injuries to Whitey Zimmerman alone create reasonable doubt as to the particulars of the Florida Statute. If you can find 12 jurors, none of whom, would fear for their life after being punched in the nose, knocked to the pavement and had their head smacked on concrete, then you're living in fantasy land.
Corey sniff sniff sniff, prayed and bonded with the family of Skittles. Skittles did not need to die that night. His mistake.

Before I cast Corey into Nifong hell, I'd like to see Zimmerman's statement and the physical evidence. I found her slobbering comments offensive but she holds an elected office and her target group was the Fuddler's who feed on the crap she spewed.

Zimmerman's CCW class covered the conditions under which his weapon could be lawfully discharged. There is a reasonable possibility that his account (given without an attorney being present) may have been enhanced or embellished in order to reflect his understanding of the prerequisites and that the enhancement or embellishment is contradicted by the physical evidence.

Grounds for a guilty verdict? Probably not. Grounds for an indictment and and trial by jury? Perhaps.

Corey will object to bail, but I don't believe that there is any grounds to hold GZ without bail. I suspect the bail will be set very high, and predict that somehow or other it will be raised. I also predict he will go into hiding because of the bounty put on his head. Or he may be put in protective custody.

His new attorney sounds like a pro. He doesn't seem to be a Johnny Cochran or Mark Geragos type which I believe is very good. Hopefully, his dad is savvy enough to keep things between the white lines.

I think DeeDee must have told the investigators that GZ continued "stalking" TM after he told 911 he would stop, and that GZ wasn't heading back to his truck as he claims, but hunting for TM until TM came out of hiding and asked GZ what his problem was. She may have described TM as very afraid of this stranger who was determinedly searching for him in the rain.

My point is that she can't abandon the role of advocate for Martin. She's cast him as the victim, and charged Zimmerman with murder. If Zimmerman defends himself (in court), she's duty bound to resist with all her might, otherwise she's not advocating for the side she's chosen to be victim.


In other words, she's only made her first concession or deposit on behalf of the mob. From this point forward, she is the in-court arm of the mob, yes?

This is only my impression:

He was contacted by GZ's dad after dad listened to his commentary on local television, and did his due diligence about O'M's experience and reputation.

If GZ or his dad had asked me, I would have recommended someone like O'Mara. Low key, all business, professional and very knowledgeable about the political and legal predilections of the judges in the venue in which the case was charged, and about the nuances of potential alternative Florida venues.

O'M seems to me to be a guy who is comfortable in the Courthouse and with the system, and who is used to dealing with politically charged cases.

Rick--I am also wondering whether Zimmerman said something incriminating when,if I understand things crrectly, he talked to the prosecutors, against his lawyers advice and without them present-or when he talked to Hannity-which might explain his camera-hog lawyers being so public about bailing out. It wouldn't take much--if he said, for example, that he was more angry then afraid when the gun went off. Even if everything known at this point which favors Zimmerman is true, he would still be guilty if he shot Martin without believing he needed to to defend himself. The only thing we don't know is what happened just before the gun went off, and without any evidence the state can't prove that it wasn't self defense. One slip of the tongue by Zimmerman changes that.

What? She heard something over the phone? No, she says she heard something over the phone.

And, regardless, witnesses who actually had their eyes on the scene corroborate Zimmerman's statement.

(And, hey, the defense can ask why it took her so long to come forward, and if the family offered her a cut of the merchandising and/or settlements.)

Whether GZ is guilty or not is besides the point. The media were led around on a leash by Sharpton and Jackson. Willingly. You would think Sharpton's past would encourage caution. But you'd be wrong.

This story is really just an extension of Newsweek spiking Presidential perjury and Dan Rather whipping up an authentic but fake 1960s document in 2004. How improved would the media be if you sprinkled a handful of conservatives across the MSM? If there were a conservative, any conservative, at NBC there surely would have been a 'wait a minute, did you say Sharpton, Al Sharpton?' moment where they may have thought sifted through the data to make sure they weren't missing most of the story. Going after Corey is a separate issue from defending Zimmerman, unless Corey is found to be suppressing evidence from the defense.

I'm wondering how the FL immunity statute operates at the charging phase. Does a prosecutor have any duty to look at this? Or is the prosecutor free, at the charging stage, to ignore ALL of the FL statutes that justify deadly force and homicide?

(1) A person who uses force as permitted in s. 776.012, s. 776.013, or s. 776.031 is justified in using such force and is immune from criminal prosecution ... [including] arresting, detaining in custody, and charging or prosecuting the defendant.

It seems this is a toothless provision, against the state. In other words, the state can violate this with impunity.

I don't know if Corey is a good prosecutor or a bad prosecutor, I do know her blubbering press conference shows she didn't arrive at this decision on it's merits. Skittles Martin died because Skittles Martin attacked Whitey Zimmerman. In this case Zimmerman may not be the good guy, but he was the one who was feloniously attacked and injured, and it would take a whole lot to convince me otherwise. BLubbering news conferences and tales of prayer would not do the job.

Nope.


From this point, there are two separate ways "self defense" can be found. One is a pre-trial motion asserting that the use of force was justified. This would be the judge saying that Corey improvidently charged, charged in violation of FL law. All that Zimmerman gets is freed.


The other is to be found not guilty via self defense, by the jury.


I see at least two FL statutes on justified use of force, and wonder if a charging document EVER mentions a "justified use of force" statute. Corey never acknowledged self defense, at any point. And if she gets to punt the prosecution to a local prosecutor, then this is REALLY a cheap shot.

Zimmerman, a married man who worked in the mortgage and insurance industries while studying criminal justice, had called police to report a variety of crimes 46 times in eight years. In the past year, he had reported black men looking “suspicious” on four prior occasions.
