I'm not a birther, but if Obama promoted himself, even through an agent, as someone born in Kenya, the question now deserves more than a shrug and name calling.

It's easy to get into the records in Hawaii and see it. Were this a court case, which is decidedly not, there would be an admission that he was, in fact, born in Kenya. There would be a question of fact.

I would like to point out that it is against the legal code of ethics of the bar for a member to deliberatly be deceptive. If Obama told his publisher, or even if he allowed his publisher to state, knowing that it wasn't true, that he was born in Kenya, he could face a disciplinary hearing if someone really wanted to make a stink about it. At the very least, it puts a final end to the "not a politics as usual guy" persona he sold so effectively in 2008.

im asking did he just let it expire? i was not aware he doesnt still have his license. i've known more than one lawyer that kept their license long after they actually practiced law. letting it expire is odd, but its even odder if he took steps to surrender it instead of just letting it expire.

A question that was asked at the beginning of the tread, but not definitively answered, is whether the mystery witness is Cuther. The mystery witness, who is the very distraught 911 caller, is definitely not Cuther. In the Cuther call, you can hear her say 'Get Inside, Selma!" to her roommate, Selma Lamililla (aka Selma Mora).

A good source for the 911 audio is this (anti-Zimmerman) website. Call 8 is the mystery witness; call 5 is Cuther.

I assume he was not under a bar complaint or anything like that, but, still, it is odd, considering his HLS status.

No one in the MSM has the slightest curiosity about it. It is a valuable thing, even if one does not intend to practice law full time.

You need to look this up and get back to me.

Because it takes work to keep it active, and he hasn't needed it to make a living for quite some time now.

Some of the work in a lot of states involves keeping up with CLE requirements. Even for practicing attorneys, it is often non-trivial.

That said, if you go "inactive", you can often avoid CLE requirements. You just pay your reduced yearly fees.

I think that the place to look would be in the Ill bar rolls. If he ever did have a law license, that would seem the most logical place.

One thing I can't figure out is that the NYT article says of the mystery witness:

More than a month later, she and her lawyer, Derek Brett of Orlando, met with two investigators from Ms. Corey’s office. Mr. Brett said his client was subject to only 15 minutes or so of “substantive questioning.”

It implies that was the first interview after the shooting. However, in the discovery evidence list, the last police or prosecutor interview of a 911 caller occurred exactly a month later, on March 26, and that witness (W6) was previously interviewed on March 20.

Let me add to my last two posts about the Obamas' law licenses - while the Ill. ARDC web site does not list when they went retired/inactive, my experience is that you need to have your CLE, etc., up to date in order to do so, at least in the states where I have been licensed to practice law. But, that once either retired or inactive, you don't need to do the CLE, nor, apparently according to their bar records, carry malpractice insurance (or maintain a trust account).

I really don't know whether a bar can discipline a "retired" attorney. Maybe.

The reason that I find this interesting is that awhile back, AZ decriminalized the practice of law without a license. Which means that they cannot do much of anything against all those document preparation sites that have sprung up. But, there was one guy who had been disbarred, who was quasi-practicing law, and they were able to sanction him. Again. All because at some point in the past, he had been subject to the AZ bar and its rules.

At least in my experience, it does take an affirmative act - which usually means that you check a different box when it comes time to renew your bar admission every year, and pay a significantly lower fee.

Don't know about "retired", as BHOII apparently is, but his wife is "retired", and in that case, you typically have to have a completely valid law license in order to go inactive. That means that if you are short on CLE, you need to come current, and if your license has been suspended for lack of CLE (etc.), you need to get it unsuspended first.

The Federal Bureau of Investigation (FBI) has been involved in forensic voice comparison for over four decades, and has a very strong interest in automatic speaker recognition (ASR) technology. Up until now, the FBI has relied on trained voice analysts using standardized aural and spectrographic techniques to assess the match between two voice samples.
Also Kenneth Marr, an audio expert who testified in the Simpson memorabilia trial. Not really a surprise, but it looks like they're going there.

Let me clarify a bit my last post. In the states where I have been licensed, there are essentially two different types of suspensions - administrative and disciplinary. Far more administrative suspensions. These include failure to pay dues and failure to keep up with CLE requirements. To be reinstated is pretty simple - you just have to satisfy the requirement that was missed (like paying the outstanding dues), and it is pro-forma to get reinstated. Sometimes, it can be a bit more difficult with disciplinary suspensions - you may need to satisfy some other requirements, such as show supervision, etc., along with having served out your suspension. Administrative suspensions are typically indefinite, while disciplinary suspensions are typically for a minimum specified period of time (for 3 years or less, except in rare cases, such as that of Bill Clinton, who received a 5 year suspension, instead of being disbarred). (The reason that I said "minimum specified period of time" is that you typically have to petition for reinstatement, and I know of several former attorneys who did not).

Not really sure of that. Someone above provided a link to the prosecution's discovery, and it turns out to be an 8 page PDF listing possible witnesses and evidence, and appears to be what Cbolt, et al., were discussing here a day or two ago.

The press is the usual requestor, but anybody can ask for and obtain the material, provided they are willing to pay the cost the state demands (which is a reasonable price for coying, media, etc.).

Same sort of issue is associated with obtaining materials filed in court. Some courts are very open and quick to post the material online, others don't, period, and if you want it, you have to get it in person. I hired a "runner" in DC to get at least two Libby appeal documents. It was cheaper than transporting myself to DC.

The state just provides a list to the court, then swears it has turned the listed materials over to the defense. Anyway, that press link ...

To me the lesson is clear, GZ made a mistake that night; we should all watch and report to get criminals off the street. But don't follow.

A little late to the party here, but it seems there are a lot of word games being played here. At least we haven't had bubu and kaka using the word "pursued," but even "follow" is ambiguous. As far as anyone can tell, GZ was keeping an eye on TM ("watching," as in Neighborhood Watch). Whether he got out of his truck to try to maintain visual contact or just to get an address for the police is not clear (I'd have to refresh my memory of the 911 transcript), but there was no attempt to confront.

In other words, GZ went by the book: He called the police, did not pursue or confront. He "watch[ed] and report[ed]," but TM decided to show off for his girlfriend and be a tough guy. And as many have already pointed out, only with 20/20 hindsight did he make a mistake.

the Zimmerman case is an incident where a hero answering Zimmerman's call for help would have saved everyone a lot of grief, and one person's death. He might have gotten punched by T. but there would have been no shooting, I think. Rand Paul gave a good speech recently where he cited other instances of standers-by doing nothing to help someone who is being violently attacked, and he called it a moral crisis.

I wonder if he and his dad could carry that thought up the ladder a bit, to Israel's need for help as well.

In New York, you cannot simply let your law license lapse, or you will lose the privilege of ever practicing law again. You have to advise the regulatory body that you wish to be classified as retired. If you do nothing, you will eventually be disbarred for not paying the semi-annual license fee.

The poster said "when arrested" which was April 11 or April 12; 6 weeks from the February 26 and soon after interrogations by police.
