Jerralyn Merritt explains who needs to show what at George Zimmerman's June 29th bond hearing. Her gist - normally a defendant is entitled to reasonable bail. This is not the case with a Murder Two charge. However, even then the state has the burden to demonstrate a strong case, and precedent suggests that plausible self-defense claims reduce a case from strong to arguable.
Hence:
So it seems to me Zimmerman is still entitled to release on bond. And Judge Lester's order [link] yesterday [where he described the stat'e case as "strong"] contains a revisionist view of what he ruled on April 20.
Hate to go off topic so soon (OK I don't hate it at all but everybody else says that so I figured I'd throw it in there)
but, if he's lost Obama girl then maybe the jig really is up for Barry already.

Shouldn't this case be handled by the regular prosecutor instead of Norma Desmond?
Posted by: myiq2xu | June 13, 2012 at 04:05 PM
I took Ig's advice and read the Comments to that jerralyn post. I think alot of the comments correctly point out that the substance of what Lester did at the April 20th Bond Hearing and the written revocation order are not completely consistent geometric logic. I do agree with that, but until we see what he does at the next release hearing, I think Lester has been been substantively consistent until this point. On April 20th he viewed the Arrest Affidavit and the State Investigator's testimony in the "best possible light for the State" per Arthur, and decided that releasing GZ would require his sound discretion. he exercised that discretion and released GZ because there was a very good chance GZ would be acquitted (or even found immune) and reasonable conditions preventing flight could be imposed. In revoking Bond, he again concluded --in essence--that being released could happen, and that would require the sound discretion of the court. Why the same legal standard, but the opposite result? Huh? The difference is that Lester learned that he had been lied to on April 20th. Should it cause him to reach the opposite result? probably not-- Lester should be having a hearing to consider a higher Bond and/or stiffer conditions. But Judges are people, they don't like being lied to-- or lectured by Harvard Professors.

Ignatz, when I read about Obama girl, she had not given up on Obama, was just playing coy about not endorsing him just yet.
On topic:
I have been wondering if the reason Korey wants keep Z locked up is because if he were executed on the outside, that would place the case, in which she has so much professionally invested, in the toilet.
Posted by: Chubby | June 13, 2012 at 04:10 PM
I think it is more likely that Corey want to keep GZ in detention for a year, and then give him an offer to plead to manslaughter, time served and probation. He'd already have done the time, so why go to trial and risk the whole thing?
Posted by: DrJ | June 13, 2012 at 04:17 PM
DrJ-- that sounds about right. Plus she can use the jail time as the 'pound of flesh' to take back to the Martin Family who have to be consulted as part of a plea deal.
Posted by: NK | June 13, 2012 at 04:21 PM
That's her plan all right..and probably the Governor's as well--he hopes it takes the heat created by the race baiters off his back.

Posted by: lyle | June 13, 2012 at 04:28 PM
He'd already have done the time, so why go to trial and risk the whole thing?
I'm not so sure. First, I don't think anything short of a murder conviction with a long sentence will satisfy the race-baiters, and for sure the "time served" will be viewed as a slap on the wrist. Second, from GZ's point of view, a plea like that will ruin his life, depending on the type of manslaughter, and again there is no overlap between a plea that won't ruin his life and one that will satisfy Crump et al.

His life already is ruined. He may or may not know this yet.
Posted by: DrJ | June 13, 2012 at 04:36 PM
His only hope is a clear and unambiguous exoneration.
Posted by: jimmyk | June 13, 2012 at 04:39 PM
jimmyC-- I don't think anyone said that type of plea is fair or would satisfy anyone, it describes what Corey is going for and how she's using detention for leverage. Manslaughter 2/probation?-- GZ's life is already ruined, at least he's not a risk for 20 years. The race Hustlers/Martins-- the taxpayers of Fla wil take care of them with community facilities named for St. Trayvon plus some walking around money, plus all of Trayvon's social activities don't come out. It's anything but fair, but maybe it's a solution for Corey/Scott.

"Harvard Professors"
I suspect Lester may be in for one of the high points of his career: going up against Alan Dershowitz. In the interview he gave on a Jacksonville radio program a couple of days ago, Dershowitz pointed out that he owned property in Florida, and was in the process of retiring there. He also indicated that he had been assisting, without charge, a Florida
prosecutor on a case in which he took a personal interest. Pretty obvious he's taking a strong "personal interest" in this case. Third-tier Circuit Court judges should perhaps be a little more circumspect about where they fling gauntlets.

Breakin' News
Judge Lester has ruled that all the statements taken by the police from Zimmerman, including the "voice stress" analysis, must be turned over to the media within 15 days, saying there was nothing in the statements that amounted to a "confession." Check Jeff Weiner, Orlando Sentinel (sorry, can't post links.)
On the "lying": Dershowitz has said that Zimmerman's evasions don't amount to anything, when compared to the transgressions of the prosecution.

Here's a shot of my "stand in" (grrrrrrrr) with his hand on the Momma-san who he's just given a buoy back to.
Terry is actually quite a good guy, as is the other boy, who happens to be fluent in japanese. Story says they brought over multiple items, but the poor bast@#ds had to wear their uniform jackets and no-clip on ties, plus they had to jumpseat on a 777, instead of driving the MadDog, so perhaps it all worked out for the best.
On a point somewhat related to George Zimmerman and bears, here is a link to the 911 recording of a local guy mauled by a Grizzly 2 days ago. After being unexpectedly attacked he was able to climb 30 feet up some tree as the bear prowled below snorting and pawing.
The 911 operator asks of the victim, "Do you have any lacerations on your head?"
Victim: "Let me feel....No...my neck is really sore..."
He wound up with some pretty good gashes and blood loss but is doing ok.
I posted this because I thought it decently illustrated how in the heat of the moment a person isn't always able to immediately evaluate the specifics of how or where he's been injured exactly, as seems to be demanded by many regarding George Zimmerman.
And FWIW, while googling for this tape, I see a breaking story has a black cub wandering around inside a local High School.

Sure,it's what necrophiliacs who wanted to be accepted by society are into.
Look,we instinctually are attracted to young women in the same way you'd rather have a juicy chicken thigh than a burnt up crispy leather one.
It's only frowned upon because we use marriage to structure our societies and anything that runs counter to it is deemed a threat.
That's why people were so mad at Bill Clinton, but Clinton was merely doing what every single man in the world does-getting his knob cleaned by a pretty young thing.

Roll call -With less than four and a half months until Election Day, Senate Republicans are shutting off the bipartisan spigot when it comes to confirming President Barack Obama’s nominees to the nation’s top courts and will present a unified front against his circuit court picks through November.
Senate Minority Leader Mitch McConnell (Ky.) made the decision to blockade nominations official Wednesday when he informed his colleagues that he would invoke the “Thurmond Rule” from now until after the elections.
Named after the late Sen. Strom Thurmond (R-S.C.) — and alternately called the “Leahy Rule” by some Republicans after Judiciary Chairman Patrick Leahy (D-Vt.) — the doctrine holds that within six months of a presidential election, the opposition party can, and typically does, refuse to allow votes on circuit court judges.
