TANG was such a lame media scam. Disgrace.

rich@gmu

really ...

This article then considers the application of sovereign immunity to the Treasury
and Federal Reserve's exercise of ownership in TARP companies under the
bailout. After considering a number of novel theories under which a clever
plaintiff's lawyer might try to challenge the federal government's sovereign
immunity, it ultimately arrives at the conclusion that the federal government's
belt-and-suspenders approach protecting it from liability in this arena, including
the liability waivers of the Emergency Economic Stability Act, waivers included
in the Securities Exchange Act, and challenges in using other avenues, eventually
foreclose meaningful challenge to the federal government's sovereign immunity
in its exercise of ownership power over its TARP shares.

don't get me wrong, i wouldn't mind seeing G in the dock, but it ain't going to happen.

Obama is considering releasing Jonathon Pollard for hundreds of Palestinians?

I simply do not get why he is negotiating for terrorists.

Roger Simon on the silence of the liberals:

"They are bewildered and embarrassed.  Some are even ashamed of themselves, not that they will readily admit it.  The man who was their hero has now been unmasked in every direction as the worst president since the Civil War and possibly earlier. Not only is he a cheesy liar, everything he has done, domestic and foreign, has failed, sometimes to extraordinary degrees. The domestic part is bad enough, but at least that might be reparable.  The foreign is another matter.  The world is spinning out of control.  Who knows where that will end?"

Delicious.

They're not conspiring together to hurt a little girl.

They're conspiring together because that's what bureaucrats do. They conspire to cover their own behinds, to protect fellow bureaucrats and to preserve their power.

And, as bureaucrats everywhere do, they're circling the wagons against "outsiders" who have dared to challenge their expert judgment or, even worse, their authority.

But if they are conspiring, it's not to hurt a little girl--it's to retain their personal power, as OL notes. Their business just happens to be children, instead of potholes.

In my experience there is no other kind.

NK(withnewsoftware)

Rich-- read the whole article. The authors run down the scenarios of different Treasury ownership positions (Citigroup/AIG ownership), and the original NONpublic GM shares. The GM position was converted to public shares by newGM's share offering, Treasury ultimately sold those public shares. What disclosure did newGM owe in its IPO, and was Treasury a 10b-5 insider when it sold its shares to the public. The losers on the GM share trades will be looking to get their money back. My guess is this will be heavily litigated in various courts (Fed District, Court of Claims, Delaware state etc.)

narciso

they may genuinely believe they are doing the right thing, however, why is there no improvement in her condition, why are they so loath to return her to her family doctor?

Jeff Dobbs

Jane:
She just finds it hard to believe that they would all conspire together to hurt a little girl.

It's possible they all think they're doing the right thing . . . and be absolutely wrong.

Basically the C.S. Lewis take on tyranny happening before our eyes.

But it's likely that in the myriad of people involved, there are some who are evil, some who are know-it-alls, some who are simply power hungry, some who desperately think they are right and that the end will justify the means, some who are butt-covering mistakes, some who are too afraid to speak up (some who may be trying but are too small to be heard), and so on and so on.

Old Lurker

Lois Lerner, of course, also believed she was doing the right thing. As does Eric Holder.

Most of them will say the same thing, except for the crooks who are taking advantage of them.

jimmyk

It's possible they all think they're doing the right thing . . . and be absolutely wrong.

The bottom line has to be the girl's deteriorating condition under the status quo. Possibly that would have happened anyway, or is the best outcome that could be achieved, but that seems highly unlikely, and at least to warrant a change. Even if the change is not to send her home to her parents, it ought to be to transfer her to another medical facility.

Old Lurker

Hit's CS Lewis also nailed it here: "“Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive.” In addition, he said, those who do this do it “with the approval of their own conscience.”

narciso

Short answer he thinks the Palestinian cause is just, Ayers, Wright, Khalidi, all influenced this opinion,

Old Lurker

More (we need more shirt colors):

"Authorities in Long Island have launched a crackdown on homeowners who rent their house out to tenants who have not been registered under a “zero tolerance” program that will see police conduct home inspections without notice.

Landlords in the Long Island community of Westbury will be targeted by a newly created police “Housing Enforcement Unit” that will “modify search warrant law to eliminate prior notice, aggressively use warrants and housing sweeps on a regular basis.”

Residents are being encouraged to report their neighbors to authorities if they suspect they are housing tenants who have not been registered with the government. Local station News 12 also gave out an email address and phone number encouraging viewers to, “report a suspected illegal rental.”
Maintenance rules and violation fines will also be raised under the new program.
Mayor Peter Cavallaro told News 12 that permitting property owners to call the shots on rentals “victimizes the community as a whole.”

Old Lurker

I hope those guys in Westbury don't find Ann Frank living in the attic of some kind person's house.

Rich-- i did read on... God help me I find this stuff interesting... and beyond some clear immunities under the '34 Securities Act, and immunity from SEC prosecuting Treasury for 10b-5 violations, there was a lot of gray, which the authors rightly suggested needed clarity.

OL-- Lead based enamel paints were banned in NYC before I coud indulge in those fumes. The EPA national ban came in what '77?

jimmyk

"Authorities in Long Island have launched a crackdown on homeowners who rent their house out to tenants who have not been registered under a 'zero tolerance' program"

I suppose one can argue that local communities have a lot of leeway to make rules about such things. Sort of an extension of the condo association concept, or zoning. But the police state tactics are certainly creepy.

Looks like lovely weather east of the Appalachians--just got some pics from youngest son with beautiful blue skies in Somerville, MA.

From DoT's link, I scrolled to the comments and unearthed this gem:

...global leadership abdicated rapidly finds a replacement – usually a worse one. (Rand Paul and followers take note.)..

Indeed. Rand Paul is an ideologue of another stripe every bit as dangerous as Barack Obama. Given a choice of Rand Paul or Hillary Clinton, this conservative votes Clinton in a heartbeat.

I replied rather tersely to him.

OT,

Just awoke in an Oakland Hotel Room and turning on the TV I clicked on the first few channels and by chance recognized the First Lady of Mexico. The channel was Univision and I see the show is called something like "Destilando Amor".

In the opening credits she starts out in some hot gardening outfit in the cactus fields making tequila, then winds up in lutes and choisseurs(sp) and face sucking: .

In the episode I am watching she has been in some church acting solemn and exchanging very knowing glances, then comforting some young child, then being victimized by some very bad good looking Business Tycoon, then desperately trying and succeeding to convince some other good looking Businessman that she is has been working hard at the office and is still faithful to him. etc.

She is a fine actress, emotes passion no matter if or what she's wearing, and she is twice the actress that Sarkozy's Wife (Ex first lady of France) is.

America could use a First Lady like Angelica Rivera.

Happy, happy, joy, joy Ignatz

I hope I am completely wrong--Childrens was the all time best place I ever took care of patients.

That's Amy's problem with the whole thing. Children's is possibly the best hospital in the world. Why would they give all that up to get this little girl?

But if they are conspiring, it's not to hurt a little girl--it's to retain their personal power, as OL notes.

Which they will dramatically lose if we are all right.

My theory is that it was a drip drip drip that got away from them.

C.R.

Jane, I don't know if you saw my comment at the end of the other thread, but there have been times when various bureaucracies have had no problem advocating for things that were definitely opposed to my autistic son's best interest and we all know teacher's unions can place their self interest over the students.

Meaning BHC and the Ma bureaucrats screwed the case over time and they are now stonewalling?

That's the most likely explanation as far as I'm concerned.

Why doesn't someone ask Michelle Obama to step in and solve the problem of that sad girl in Medical limbo? Michelle as I recall worked in a Hospital and was so darn good at it they created a $350,000 job for her, and she did it so well her job disappeared when she left.

Surely she could step up and resolve this issue, being that she's a genius, loved around the world, and one of the top most beautiful women on the planet. Don't wait for Deval Patrick, demand Michelle.

Sad thing is, sarcasm removed, that a decent First Lady probably could get a prompt, fairly impartial review of this case via effective use of the bully pulpit.

Thomas Collins

Well, anonamom, I come from the non-Chalcedonian side of the aisle, but two passages dear to the non-Chalcedonian practice of Lent, one from the Hebrew Bible and one from the Gospels, don't seem at odds with what you are doing.

"Even now, declares the Lord, return to me with all your heart, with fasting and weeping and mourning. Rend your heart and not your garments. Return to the Lord your God. (Joel 2:12-13)"

"When you pray, do not be like the hypocrites, for they love to pray standing in the synagogues and on the street corners, to be seen of men. Verily I say unto you, they have received their reward in full. But when you pray, go into your room, close the door and pray to your Father, who is unseen. Then your Father, who sees what is done in secret, will reward you. (Matthew 6:5-6)"

The mourning you are expressing seems to me to be within the ambit of the spirit of these texts. But since I am a non-Chalcedonian and certainly not an expert on Roman Catholic Church doctrine, I can only speculate.

I suppose one can argue that local communities have a lot of leeway to make rules about such things.

Not when it came to an illegal alien law in California from several years ago.

The lawsuit alleges that the Escondido ordinance - which is modeled on Hazleton's - violates federal and state laws and puts landlords in an "impossible position" of enforcing immigration laws.

"The ordinance is riddled with constitutional flaws and ignores the subtleties, complexities and primacy of federal immigration law," according to the lawsuit.

The city argues that the law aims to alleviate the "significant and costly burdens on society" that are posed by illegal immigrants. Officials have said it would only be enforced on leases signed after it takes effect.

I guess I'm flustered to wake up and learn that Malaysian Authorities have been lying now for 18 days about what was actually said back and forth between ATC and the missing Airliner, and that they still don't know who made the last radio transmission from the plane. And now I hear from CNN (If I can believe them) that none of the ATC transmissions from Ho Chi Minh ATC to the plane or via relays have yet been looked at.

Since Sebelius said that they never set a target of 7 million as the definition of success, why is The President saying he hit their Target of 7 Million and why is CNN bannering the ticker headline: Obama: 7.1 Million. We hit our Target.

The Obamaniacs know how many previously uninsured have paid for ExchangeCare. Their refusal to scream the number -- instead only saying 'enrollees' and 'medicaid expansion'-- demonstrates newly insured is pitiful number. ObummerCare is a huge churn operation-- 5.5M people dumped off of their individual plans-- and most of them forced to buy ObummerCare, most with a small subsidy that goes to pay for higher deductibles. What a scam... a $2 TRILLION scam.

2) An attorney asks: Are Climate Skeptics Legally Liable for Criminal Negligence?

With all the calls popping up now for jailing Skeptics and denying then the right to speak their opinions, a Lawyer looked into if there was a Legal Foundation that could be used to prosecute AGW Skeptics and put them in Jail. Examining California Law for cases under Voluntary Manslaughter and Involuntary Manslaughter, he concludes:

The facts related to the conduct of climate research that results in a conclusion of no alarm is warranted do not yield a conviction on a charge of voluntary manslaughter, or criminal negligence as described above.
