The NY Times editors finally write out against the Perry indictment:
Is Gov. Rick Perry’s Bad Judgment Really a Crime?
By THE EDITORIAL BOARD AUG. 18, 2014
Gov. Rick Perry of Texas is one of the least thoughtful and most damaging state leaders in America, having done great harm to immigrants, abortion clinics and people without health insurance during his 14 years in office. But bad political judgment is not necessarily a felony, and the indictment handed up against him on Friday — given the facts so far — appears to be the product of an overzealous prosecution.
So the prosecutor got one small benefit from the time-tested 'announce insane indictments on Friday' strategy - it took the Times a few days to sound out the experts and check the weathervane before they could chime in on this.
And we thank the editors for maintaining their sense of humor in describing the problem:
Ms. Lehmberg was arrested in April 2013 for driving with a blood alcohol level of more than three times the legal limit, and she verbally abused the officers who found her with an open bottle of vodka. She ranted and raved at the local jail, threatening sheriff’s deputies, and she had to be restrained in a chair with a hood over her head. She pleaded guilty and was sentenced to 45 days in jail. In addition to endangering people’s lives, she instantly lost her credibility as a prosecutor of drunken-driving cases.
Is that really all the credibility she lost?
Even lefty crazed Madison dumped the WI AG gal who got caught driving drunk. Does the NYT think Lehmberg is a Kennedy or something?

Posted by: Sue | August 19, 2014 at 09:31 AM
Great harm to abortion abattoirs and illegal immigration is not seen as a negative in most of the country.
How exactly did he do great harm to people without health insurance?
Prevent them from buying some or prevent them from moving to a state that will buy some for them?
Least thoughtful? They mean wrong thoughtful.

thought crime, must be real crime of course if they could they would put the Texas leg in the

they don't focus on the absurdity of indicting him for a veto, that Patterico has zeroed in on.

http://dailycaller.com/2014/08/19/preliminary-report-over-a-dozen-witnesses-back-darren-wilsons-story/
Post-Dispatch reporter Christine Byers sent a tweet late Monday teasing her findings.
Wilson’s claims match a woman who called herself “Josie” who called into Dana Loesch’s radio show on Friday. CNN confirmed with police officials that what Josie told Loesch matches what Wilson says happened during his encounter with Brown.
According to Josie, Wilson, a six-year police veteran, claims Brown assaulted and then “bum rushed” him during their encounter on August 9.
The assault followed after Wilson drove upon Brown and a friend walking in the street. Wilson told the two to move to the sidewalk. After driving forward, Wilson reportedly received a dispatch call about a strong-arm robbery at a convenience store.
Brown allegedly stole cigars from the store and shoved a store clerk. According to Josie, Wilson says he saw the cigars and then confronted Brown and his friend.(more)

Clarice, I thought Josie was a friend of Wilson's and was just restating what he'd told her (per DoT in the previous thread).
Gov. Rick Perry of Texas is one of the least thoughtful and most damaging state leaders in America
As if the NYT's leftist credentials would ever be doubted. This reminds me of when W was in office, and whenever someone in Hollywood or anyone center or left would say something positive about Bush, it would always be prefaced by something like "Of course he's been a horrible president, but...."
Posted by: jimmyk | August 19, 2014 at 11:08 AM
Bear in mind that Josie is not an eyewitness. She's simply giving a hearsay account of what Wilson told her.
The flow of information from the various authorities is just plain mystifying.

Perry's "bad judgment"? He's got a rogue DA in Travis County on his hands; that office has been an embarrassment to the State of Texas. That office had been hounding one of the Governor's pet programs for a year.
It's headed by a woman who, based on video evidence, is fat, drunk and stupid. As Dean Wurmer said, that's no way to go through life. She's an embarrassment to prosecutor's offices throughout the state.
So Perry lifts up his line item veto pen, and encourages Ms. Fat, Drunk & Stupid (and I might add sloppy) to leave the hog pen that's the Travis County DA's office. And the NYT thinks that's "bad judgment" on Perry's part?
I'd say that the new owner of the New York Times has some hog pen cleaning that he needs to do pronto.

It's up to the Democratic black caucus to finally get this message out to their communities: the only way mothers are going to stop their babies from being hunted down and murdered by white police officers is to vote for Democrats this fall. Not voting for Democrats this fall is akin to murdering your own child.
Also,Fathers within the African American community have to understand that they are not men if they cower at home in the darkness on voting day hoping to placate white by being a "good boy". Whitey don't care if you're an obedient n*****. He gonna kill you anyway so might as well vote for Democrats this fall and buy yourself some protection againt whitey.
Young AA men....if you want to stop being harassed and searched by white men who laugh at you back at the station among their white friends about the power they exerted over you then get registered a VOTE DEMOCRATS THIS FALL.
If we can use Ferguson to up voter turnout this fall then we might be turning those slivers of margins back in our direction and we might just hold onto the Senate. We need to hit the "War on voting" big and keep the media eye on Ferguson, where apparently it's deemed acceptable to shoot an unarmed college kid(was he shot because he was going to college...did whitey hear about it and target him?????)

Doesn't look good when a bullet ricochets off the top of a shooting victim's eye socket and exits below his cheek. It could only do that if the victim where bending over-as in getting on the ground.
Also, the bullet that entered the top of the vics head indicates that he was bent all the way over when the white police officer thought it would be a goo idea to blow his brains out.

Dumbass, in real life, multiple shots are fired very quickly one after the other in a matter of a few seconds. Brown appears to have been in the process of falling on his face/putting his hands up to protect himself while still charging/stumbling toward Wilson. All consistent with the forensic evidence and most eyewitness reports.

Narciso,
Isn't Hoft just creating a counter narrative? "Two St. Louis sources" has a rather ephemeral resonance, as does "police sources". Having been apparently mislead by reports the police chief said the first shot was fatal, I'm rather unwilling to fully believe much beyond the video of the thug committing a strong arm robbery and the fact he's dead.
The release of the video was definitely a counter narrative move on the part of the locals but Hoft's breathless blather needs more confirmation than has been provided to date.
[Having said that, we should expect confirming X-rays within the hour based upon my previous reversals.]

Simplest scenario covering all the facts: Brown muscles (punches/pushes/grapples, whatever) Wilson, decides to run . . . Wilson recovers enough to get out and yell "halt"; Brown turns and rushes Wilson, gets shot.
Baden's claim of "no struggle" was particular to the second interaction. Nobody denies the first.
Each version has some of that in it, so I'd take that as a given. And, obviously, Brown opened up some distance before the shooting. But Parks is right on one thing, it was the second interaction that killed him.Posted by: Cecil Turner | August 19, 2014 at 12:23 PM

Jimmy K,
The statement by Dr. Baden is not inconsistent at all. It is based on a statement by the family that said that the police had claimed that MB was shot and killed during a struggle.
Dr. Baden's conclusion was that he was shot at a distance of more than 2 feet, which he could not confirm because he did not have access to the clothing to test for gun residue. Reporters are the ones who are confused and mixing statements and their conclusions.

If the officer is innocent it's further proof that whitey enjoys killing blacks but covers his own ass and the only way to remedy that injustice is to vote for Democrats this fall.

I think it's perfectly apt to question if Brown was targeted by the white police because he was attending college.
Wow. Talk about multiplying beyond necessity. But let's discuss.
The first story I read about Brown's college aspirations were all about music and sound engineering and his aspirations to being a rap star. But then, a couple days ago, it switched to "heating and air conditioning engineer"; neither of which seems to me to be much of a threat to whitey's dominance of the Ferguson social structure or a reason to "target" him. YMMV.
But wait, there's more . . . Vatterott College gave a rather uninformative statement when asked whether Brown was enrolled:

Christie was in Maine recently and said the RGA will support Lepage with all the money it takes. Sen.Angus King (I) endorsed his friend Eliot Cutler, the independent running in the governor's race against Lepage and Michaud. Cutler split the vote last election and could do so again,in Lepage's favor. Michaud has brought in the Democrat activist groups and such luminaries as Debbie Wasserman Schultz and James Carville. Michaud has also sought advice from Barney Frank on how to run as an openly gay politician. He (Michaud) is pandering to the other Maine.

What happens when the grand jury returns a justifiable homicide verdict based upon the testimony of twelve eyewitnesses and the ME reports (including the report on Officer Wilson's injuries)?
Does the Fed Flying Lynch Squad go home or do they persist in fanning the dump fire?

This is deja vu all over again with the return of DuDa and BuBu. Must be nervous times in Progland. The bosses must not like the poll numbers of the full criminal enterprise operation in Mizzou, St. Louis County, Ferguson and the USA.
We went through this whole poltical masturbation with these clowns during St. Skittles Adoration. In the proble this time there are witnesses and if they are impeachable then Holder and his State equivalent will have their chance. But I have a feeling this is going to whimper out the more details emerge that 1) MB was stoned, 2) a known thug, 3) resisted arrest or Q&A, 4) battered a police officer and 5) committed suicide by cop.
I'll even go so far as to speculate the NYT's leads the way in abandoning Ferguson for "good news" - which is what they are probably looking for right now.

Barnes Hospital in St Louis has excellent eye surgeons, can't imagine why he would go elsewhere (except death threats). I'm sure the sample image was to show what an orbital socket injury is (ie not something astronauts experience while in orbit).

fun idea for MSNBC and CNN pundits
give pundit a paintball gun, put 300 lb 18 yr old 35 feet away, pundit has a patch over one eye to simulate blown eye socket
instruct 300 lb 18 yr old to charge
PS commenter Jello333 at the Treehouse
I think all the wounds other than the two to the head came first, as Brown was charging. I do NOT really think he had his head down in a charging elephant kind of position… I think he was just running full speed toward the cop, in a more or less upright position, as the cop was firing.
But finally one of the bullets struck a vital spot, which caused the (conscious) charge to end. That is the bullet that hit him in the eye. At that point Brown DID begin to fall forward, and the last bullet hit him in the top of the head. I believe all the shots were fired within a matter of maybe 3 or 4 seconds…. and those FINAL 2 shots were both fired within a fraction of a second of each other.
No, the very last shot was NOT necessary to stop the threat. HOWEVER, unless I’m mistaken, this cop doesn’t have super-human reflexes, so it was impossible for him to that quickly react to the fact that the next to the last shot had got Brown in the head (and so ended the threat). No human could be expected to do that if, as I say, the final two shots were separated by a max of half a second.
