The reason I ask is I lost an antiSLAPP motion once because defamatory statements made at a supposed private informal settlement meeting regarding a lawsuit with a group of creeps suing me was ruled covered by the lit privilege and my looks at case law seemed to be pretty expansive on allowing any communication even referring to contemplated litigation as being covered by the privilege.

I have no idea how Boehner plays in his district but since he is always re-elected without much trouble then it tells me he is a constiuent kind of guy. He brings in the pork and says/does the right things. Probably a pretty good bacon to the house kind of congressman.

Then in congress he made his bones. He supported the leadership, gave money to them (the secret by the way) and eventually rose to where he is. He continues to give money via his PAC to congressmen on the edge. Look at who voted for him and who received his PAC money. No brainer.

Counter attacks from the studios of CNN which are per se defamatory are likely to be met with a lawsuit. Dershowitz knows that. He should know that in such an action, all of the records of these trips, all the witnesses, every document and Dersh himself will be discoverable. As will be the victims’ lawyers.

Why would they make that move?

He said he wanted full disclosure. Now he has it.

I am impressed by Jeralyn Meritt's post on Talk Left analyzing the initial pleading. DoT also, IIRC, considered the pleading a POS.

They are attempting to get a pleas bargain undone years after the event--a virtual impossibility--and have spiced up their claim for maximum media impact. Whether or not Dershowitz did one thing they allege--which I doubt--it is irrelevant to their claim,Her reference to Rule 11 is a reference to a federal rule--adopted by manyif not most states, which holds counsel liable for filling frivolous pleadings. Obviously she thinks there ;s is such a pleading.

Dershowitz has filed a Motion to Intervene, which I hope is granted. But his request for relief is somewhat more limited than that we will see in the defamation case:

"Alternatively, if intervention were granted, he would request that the Court grant intervention for purposes of submitting a request for a show cause order to Plaintiffs’ counsel with respect to their investigation of and justification for including the allegations against Prof.
Dershowitz in the Joinder Motion."

This is a simulacrum of a Rule 11. A Motion to Strike backed by an evidentiary hearing might have been stronger.

I have always respected Dersh. I have a hard time believing he would have been involved in this way. Yet, his response is much different from what I would have expected.

Some interesting facts about Boehner: He played linebacker in high school (Archbishop Mueller) for Gerry Faust. He enlisted in the Navy but was forced out because of a bad back. He worked his way through college as a janitor, taking six years to do it, then joined a plastics firm, where he was so successful that the owner sold it to him, when the owner retired. (The owner's children weren't interested in the business.)

He was the first person in his famly to get a college degree.

He came to Congress by knocking off Republican Buzz Lukens, who had had an encounter with an under age prostitute. (Lukens may not have known she was under age.) If I recall correctly, Newt Gingrich encouraged and helped Boehner, after Lukens refused to step down.

His district (Ohio 8th) is very safe Republican (Cook rating: R+15).

He was one of the first Republcian leaders to favor banning earmarks.

I've always thought that his small business/working class background is one of the reasons he has been a pragmatic conservative, rather than a purist.

I don't think he will be rated as great speaker, but I do think he has been the best Republican speaker in my life time, better than Joseph Martin, better than Denny Hastert, and yes, better than Newt Gingrich.

(I probably would rate him behind Sam Rayburn, but Rayburn operated in such a different environment that it is hard to compare the two.)

Sue, my brother went to North Texas U, and married a Cowboys' Cheerleader. I've seen the Pack play in DALLAS 3 times, and I've seen them play in either Milwaukee (back in the day, 3 of the 8 home games were played in Milwaukee County Stadium) or Green Bay 6 or 7 times. Nick Hayden Defensive lineman for the Cowboys went to Arrowhead High, right where I live,( and Wisconsin) Tony Romo is from nearby Burlington.
I was once a Cowboys fan, as a kid, and a Roger Staubach fan. My family moved from Maryland to WISCONSIN, and the rest is history. I will be at the game Sunday.

With the NFL coming out a second time to apologize, you know they screwed up. And Yes, calls are missed/messed up all the time in every sport. The timing and manner of the missed/messed up calls in this game is suspect.

And Yes, if it were the other way around where the Lions benefited over the Cowboys, I would still be this upset with the NFL. I think it has to do with how I was raised by my father who was in professional sports and on the rule committees as well.

Stafford is good, he's not Rodgers, but he's good. Detroit has numerous parts, especially their D-LINE that are outstanding. Calvin Johnson is fantastic. This year was most definitely a step forward. I was at the final game 3 years ago in G.B. when Rodgers sat, and Flynn threw 6 td passes. Stafford threw for 500 plus yards. Getting in Staffords face changes the game. Getting in Rodgers face, not so much. Detroit is on the right path, guys like RODGERS make all the difference. We here in SCONSIN are very very fortunate. Detroit is going to be very good.

One last comment on Aaron Rodgers. It is very very rare, when a QB comes along, who is so intelligent, mature and who doesn't panic. Of course I am biased, but Aaron Rodgers has NEVER had an offensive line that was touted. So much of what Rodgers achieves and what the Packers have accomplished, has been despite, the cast, specifically the O-line. Jordy Nelson and Randall Cobb are awesome, but name another reciever or a single tight end?? One more time, I'm biased, but Rodgers is fantastic.
I met him once. At Donald Drivers tv SHOW, Gus and Gus Jr were sitting at a table with Donald Drivers wife and his 2 older kids. Rodgers came out from backstage and sat with us. He asked if he could have one of my chicken wings. I SAID YES!!

I wanted to respond to this but just got too tired. I respect Jim's opinion a great deal but imo he's pigeon holing too much of a non existent job description in this. And I say this while acknowledging that Newt's ego and need for attention is at times a failing. And I understand the requirement of doing the grunt work out of the limelight to be effective. But you can delegate a lot of that while still maintaining a high exposure as long as it gets done effectively. And I think Newt effectively steered public perception, and Slick, to the right before he was done in by a combination of factors, including jealousy within his own party.

At least with the Contract with America, which borrowed heavily on the principles of Reagan, you could say what the party stood for. Under Boehner it's a hodge podge of pandering, special interests and dodges; and can't be counted on to reflect the will of the people who elected them.

I would pay a lot of money to hear a reporter at Obama's next press conference ask him about that. "Mr. President, the editor of a French newspaper insulted Muhammad, and he's dead at the hands of Muslim terrorists, so does that mean the future no longer belongs to him?"

It's as cold as a divorce lawyer's heart here in NE Ahia but, surprisingly, snowzilla hasn't accompanied the cold front to the brutal level that was expected. It still might happen when the lake effect kicks in but so far everything has been counter to the dire warnings.

CH, you are not alone in that thought.

For all the jokes, I think the French can be quite practical, and ruthless, when it comes down to it if they truly feel their culture is threatened.

Welp, rse, I guess I'm stuck stating that amidst all his crackpottery, Newt pushed by and large, but not exclusively and with many outliers, a conservative agenda. I guess he thought that by being "open to everything" that people would think he was really really smart.

Charb is dead. I guess he DID live under Quranic law & didn't realize it.
