n 2003, Disney brought us its latest animated feature, Brother Bear, the usual New Age mumbo-jumbo with a generic Native American gloss. It told the tale of Kenai, a young fellow in a bucolic Pacific Northwest at the end of the Ice Age. To avenge his brother's death, Kenai kills the brown bear responsible. But trouble's a-bruin: his late brother is wise enough to know that killing is not the answer and so gets the Great Spirit to teach Kenai a lesson by transforming him into a bear. He thereby learns that bears are not violent beasts but sensitive beings living in harmony with nature who understand the world they live in far more than man does. I would certainly agree that bears are wiser and more sensitive than man, if only because I've yet to meet a bear who's produced an animated feature as mawkishly deluded as this.

Among the technical advisers on the film, hired to ensure the accurate depiction of our furry friends, was Timothy Treadwell, the self-described eco-warrior from Malibu who became famous for his campaign "to promote getting close to bears to show they were not dangerous". He did this by sidling up to them and singing "I love you" in a high-pitched voice. Brother Bear is certainly true to the Treadwell view of the brown bears, and he would surely have appreciated the picture had he ever gotten to see it. But, just as Kenai found himself trapped inside a bear, so did Mr Treadwell - although in his case he was just passing through. In September, a pilot arrived at the ursine expert's camp near Kaflia Bay in Alaska to fly him out and instead found the bits of him and his girlfriend that hadn't yet been eaten buried in a bear's food cache.

Treadwell had always said he wanted to end up in "bear scat", so his fellow activists were inclined to look on the bright side. "He would say it's the culmination of his life's work," said his colleague Jewel Palovak. "He died doing what he lived for."

I wonder if he was revising his view in the final moments. And if his girlfriend was quite so happy to find she had a bit part in "the culmination of his life's work".

You'd have to have a heart of stone not to weep with laughter at the fate of the eco-warrior, but it does make Brother Bear somewhat harder to swallow than its technical adviser manifestly was. There are People for the Ethical Treatment of Animals, but sadly no Animals for the Ethical Treatment of People. And, just as bugs are becoming resistant to antibiotics, so the big beasts are changing, too. Wild animals are not merely the creatures of their appetites; they're also astute calculators of risk. Not so long ago, your average bear knew that if he happened upon a two-legged type, the chap would pull a rifle on him and he'd be spending eternity as a fireside rug. But these days it's just as likely that any human being he comes across is some pantywaist Bambi Boomer enviro-sentimentalist trying to get in touch with his inner self. And, if the guy wants to get in touch with his inner self so badly, why not just rip it out of his chest for him?

North American wildlife seems to have figured that out. Why be surprised if other predators do..?

In 2008, the Italian performance artist Pippa Bacca set off to hitch-hike from Milan to the Palestinian Territories to promote "world peace". She was dressed as a bride, and the purpose of her trip was to show that if only you put your trust in our common humanity then all will be well. A month later, her naked body was found in the bushes near Gebze in Turkey. She had been gang-raped and then killed. Like Timothy Treadwell's, her illusions met reality.

Most of us as individuals retain enough of a survival instinct that, if we find ourselves on a rough city block in a foreign land late at night, we mothball the PC pieties until we get back to the lobby of the Grand Hyatt. But what happens when Pippa Bacca's illusions become the dominant political discourse of a free society? And how many Timothy Treadwells crooning to their killers does a society have to have before it loses even the very idea of a survival instinct?

I watched on our TV in Evansville, Indiana. We were glued to the set and jumping up and down when they won.

Best sports moment I ever watched. Ever.

Before that, we felt like the Soviets could never be beaten. Afterwards, it was like anything was possible. I have never forgotten it, nor those kids skating around the rink draped in American flags.

I honestly do think it enabled Reagan's victory.

I was studying for winter quarter finals in the the main humanities building that was 3 floors and quite large. Someone races up and down the hallways and floors that everyone needed to stop studying and come watch the game. Mass exodus to the student union and dorm lobbies.

Quite astonishing as it was so unexpected during that Cold War tension year.

Appeal Judge Hannan's Order?: Clarice is the expert who can give the most details about procedure. Essentially, Hannan has issued a 'temprary' stay against Obummer enforcing his EO indefinitely delaying deportations and issuing work permits to illegals. Obummer claims he is obeying the stay, and will 'appeal'.This is where Clarice can give specific procedural detail; ordinarily, these types of District Court 'temporary' orders are not appealable in Federal Courts. Instead, the stayed party would have to push for an immediate trial on the merits, and when the District Court issues a final determination on the merits, an appeal can be taken. The Fed Rules Pro, give special rights to the Justice Department to seek appeals from interim orders, and I am sure he DoJ can do so with Hannan's order, but I don't believe they get an 'automatic stay' merely by appealling. Instead, they have to move at the 5th Circuit Ct of Appeals to 'stay' Judge Hanna from enforcing his temporary order pending Judge Hannan issung a final determination on the merits. Clarice can fill in important details.

The DOJ's motion to stay the injunction goes first to the same District Court judge that issued it.
He will either grant, deny or ignore it.
Unless he grants it (which he won't), they will then submit it to the Fifth Circuit, which will grant or deny it in fairly short order.
After that, their next move is to file an interlocutory appeal of the order in the Fifth, which will take a while to be heard and is likely pointless anyway.

exdem-- good summary. I don't know whether DoJ MUST make application FIRST to Judge Hannan to stay his order pending appeal. For us dumb private litigants, once the Dist Ct Judge grants an interlocutory stay, the best you can hope for is a rocket docket to SJ/Trial to minimize the damage of a wrongly issued stay, I've never been a gov't lawyer (and I've never sucessfully obtained an interim stay against the Feds, although I once got Judge Dearie in the Eastern district to tell the Feds to back off, otherwise he would issue a stay) but my understanding is that DoJ has procedural rights for interlocutory relief in the Circuits, which the rest of us don't have.

NKV - they can (and probably will) skip the District Court but will have to add an argument for why they did so in their motion to the Fifth Circuit (heh).
The interesting part, to me, is how they will make the argument that implementing their policy is so urgent that posrponing its implementation - even while its questionable constotutionality is properly adjudicated - will do more irreparable harm than otherwise.

In other words that allowing the toothpaste sitting in the tube is worse than trying to get it back in.

ExDem-- a further interesting Art III/Fed Rules twist is the fact that the opposing litigants here are STATES. Say the 5th Circuit stays Hanan's order, wouldn't the States have rights to Appeal directly to SCOTUS? (Sorry to the rest of you JOMers, but I really enjoy this tedious stuff.) So wouldn't the easiest course for the 5th Circuit be to direct a prompt determination on the merits by Hanan, and defer hearing the case until there is a full record and a final injunction inplace to review?

(CNN)The Justice Department plans to ask a federal judge to allow the Obama administration to continue its plans to implement the President Barack Obama's executive order on immigration, while it appeals his ruling blocking the order.

White House spokesman Josh Earnest said Friday the department will ask for a stay of the ruling by U.S. District Judge Andrew Hanen, who ruled this week to temporarily stop the Homeland Security Department from proceeding with the president's order.

The stay request will be filed by Monday, Earnest said. Justice Department officials plan to seek an expedited hearing of their appeal, hoping that it can be resolved in the next few months. A stay would allow the administration to continue to prepare to implement the order; DHS said it suspended all such preparation after Hanen's ruling.

The stay request is widely considered a long shot, at least when it first goes to Hanen. The Justice Department could then ask for the 5th Circuit Court of Appeals based in New Orleans, which leans conservative, to intervene and put Hanen's ruling on hold.

Obama issued the order late last year to shield as many as 5 million undocumented immigrants from deportation.

Hanen ruled in a lawsuit brought by 26 states that the administration had failed to comply with the Administrative Procedure Act, which calls for the White House to afford a longer notification and comment period before taking action.

Hanen's ruling for now accomplishes what Republicans in Congress have sought to do to block funding for DHS to implement the executive order. A standoff in the Senate with Democrats has threatened to cause a partial shutdown of DHS at month's end because of the funding issue.

Depending on how long it takes to resolve the appeals court fight, the fate of executive order may not be decided until President Obama's term in office is drawing to a close.

My dad sent me the link to this excellent 2006 short documentary film, about 15 minutes long.

The filmmaker discovers his great-uncle's long-lost WWII film footage, and tracks down a Spitfire PA944 pilot who made an emergency landing. I don't want to spoil it by saying more.

I think all JOMers, but especially the pilots and aviation enthusiasts, would really enjoy this.

OL-- thanks for that news report. I have to admit, sound thinking by the DoJ Obamaniacs to go back to Hanen first. This is a case where the Judge has ruled that the POTUS is lawlessly ignoring the Immigration Statutes and APA, so to go straight to the 5th Circuit would reinforce the states' claim that the POTUS is lawless. Making application to Judge Hanen puts him on the spot to explain why one lowly Dist Ct Judge can hold up the mighty POTUS. My guess is Hanen denies the motion and eloquently explains why (regrettably) his stay must stand while the POTUS appeals.
