Although Judge Hanen's opinion was 123 pages long, the rationale for it was extremely simple: the government is not harmed at all by maintaing the status quo until the matter is tried, whereas if the stay is lifted the toothpaste will be out of the tube. In that event, even if the states win a trial it will be impossible to restore the damage that will already have been done to them.

I don't think this is a close call.

I think it will be decided by a panel of three judges on the 5th Circuit.

I can't remember watching the miracle on ice, although I must have - I was a big fan of Ingemar Stenmark and Olympic sports in general. We just watched the movie with Kurt Russell as Brooks - pretty well done.

Earlier this year, I brought my children in to the Brooks arena to show them the ice. We also skated on the oval where Eric Heiden won 5 gold medals. My youngest chose Heiden for her elementary school wax museum. She styled it swinging five golds like Flavor flav. She looked great. I love the history in that town.

Iggy, in answer to your question, I thought my friend's plan was terrific. Unfortunately, I had to regretfully decline and he concocted other means to attract women.

DoT, I recall reading years ago, that Obama was the first HLS law review president to be elected,The election notion seems to have been one of those "diversity" notions.

As for the stay, I believe the entire panel assigned to the case has to grant it, not just one judge. The SCOTUS has , I believe, a different rule in capital cases.

I am unaware of any DoJ special appeal tights, There may be one, I just have no recollection of such. I do not think Hannen will grant the stay. I hope the Fifth Circuit will not either. If they do, I'd bet the states move immediately for a s/j which the DoJ could then appeal in the normal course of events--i.e., months to judgement.

As for the SCOTUS, it has original jurisdiction (IIRC) of suits BETWEEN states, but this is not such a case and was rightly brought to the District Court.

And now for a Fifth Circuit story. In my youth, my husband and I had cases there one day after the other. As is the practice the local USAtty moved our admission to the Court together. My husband argued the first day. when I got up to argue the following day, one of the judges said jokingly, "Another feldman from Washington?"

I also believe he was unique in never having written anything for HLS law review while president of it.

Do you know (or where I could find) what spray paint vaporizes in to when it is zapped with a CO2 laser? Would the vapors bond with metal?

More information is necessary, as there are all sorts of paints. A CO2 laser basically focuses heat into a small area, so I'd guess the organic compounds will go to CO2 and water. Inorganic constituents, like TiO2 used in white paint, would stay as the oxide, but evaporate.

I doubt much from the paint would stick to metal, but you can give it a try.

I assume that the laser has a high enough fluence that you can cut with it. Such tools usually have an exhaust located near the work so that off-gases are removed.

What's the application?

issues: would it void the warranty on the device (the laser vendor hasn't responded as yet)?

would the vaporized paint and copper get into the optics or laser tube and degrade it over a short period of time?

would the fume remover we have remove the compounds produced?

I sent an email out to the company so hopefully I can get an answer soon. I'm halfway tempted to try it and if I don't break anything or end up in the hospital ... the process works!

This Marie Harf story seems like one of those stories that started at one end of the line sounded one way only to emerge at the end as something else.

I came across a story a while back that sort of described ISIL recruitment as being based on the "frustrated job seeker" paradigm, but of course it was much more nuanced than the 'rubes' at the State Dept could possibly describe in one sentence.

It seems that ISIL recruitment is based on offering quick advancement on multiple levels:

1) you get to shoot up shit. This includes multiple weapons of various sizes, including knives and fire. Targets can be cars, buildings and live people.

2) you get money .. lots of money by basically stealing it .. or extortion .. but hey, you're on a "mission from Allah."

3) you attain social success by getting the women .. sure some may be slaves but remember, 12th century standards apply here.

4) you get to be in the inner circles of power in the IS, which includes trucks, homes, etc.

Simply, it's Mad Max meets Islam.

To say that you can counter this kind of salesmanship with a "jobs program" is like saying you can clean the Capitol building with a toothbrush .. it can be done but your going to need a shit load of toothpaste.

If the administraion takes any action in violation of the PI, I think this judge might hold a number of federal officials in contempt, and perhaps even order federal marshals to arrest them.

I haven't read the terms of the Preliminary Injunction, but I doubt that they prohibit the continued preparation of documents that will be used to effect the EOs in the event the stay is lifted.

But if they go further, it might even be that open defiance of the PI would embolden McConnell to abolish the filibuster rule and send Obama a DHS funding bill that excludes funding of this stuff. Let him veto it if he wants. I think public opinion will have shifted pretty dramatically against him if it came to that.
