If he returned to the fray, the only self-defense claim he might have is defense of others. And if he started the first ruckus, he can't claim that. At any rate, he used disproportionate force, so he's definitely going to get convicted, even if we don't know what the eventual conviction will be for. Using a gun to defend yourself is legally not permitted unless you are in fear of your life or fear of grievous bodily harm. That can be a hard standard to meet when the jury pool has been contaminated by TV where people get up after being hit in the head with a baseball bat--completely unlike real life. So most people don't equate a baseball bat or similar object (tree branch, golf club, rock, etc.) as a deadly weapon.

Yes, escape then return is problematic. NRA training I had suggested escape is the best option... followed by a call to the police. Firing a weapon is restricted to times when escape is not possible (for you or someone in immediate peril). Alcohol impairs judgement, teenage impairs judgement, adding a gun to that is a bad mix. I assume more facts will trickle in, the DA will release those selectively, and eventually a jury might get something close to the full story.

Years ago when I was a young lawyer in my first apartment I had a prowler who then stood in front of window exposing himself until I looked up.

My dad showed up the next night with a shotgun for my closet, a pistol for by the bed, and instructions from some family members in law enforcement that if I had to fire while someone was breaking in, to please frag them across the threshold before the cops came.

Same family members also told me not to ever sit at a red light alone at night. If there clearly was no one around, treat it as a stop sign and go on.

What a beautiful fall day here. We took the
Jeep off road on a hillside near the cabin to explore the wind turbines that have sprouted on many of the hillsides here. They look like a mutant amusement park ride up close. The blades were turning slowly despite the strong breeze and I asked why,hubby said because it is a big scam. Ha. Beautiful views on top of the hill,the trees are brilliant.

Just for info, a 3rd brand new runway was opened in Guangzhou just 3 months back and taxiing out the other day during a rare daylight flight I was able to see they are constructing another humongous Passenger terminal, so all that said they're Airline infrastructure is still in build mode, regardless of whether it's built on bubbles about to burst or smoke and mirrors.

The music is crappy but the visuals are great. Years back I remember posting that when I had climbed way up to the top of Bird Ridge, (3,500 feet high) one of the mountain ridges surrounding the Turnagain Fiord, I heard an odd sort of continuous whooshing, whispering sound, and looking way down I realized it was the sound of the incoming tide that you could see rushing down the fiord. Down lower you never hear it, as the sound of the traffic and train's going by clobbers that soft sound, but way up top above all those traffic sounds you could hear this neat sound as if someone was blowing near your ear. That was very cool and unexpected, and I suppose a sound that the ancient Natives up here were well familiar with.

So the "Justice or Else!" March in DC featured a Native American bozo chanting "Down, Down, USA". Nice people.

Was at Rick Warren's Saddleback Church for the past 3 days for the Gathering on Mental Health and the Church. an amazing conference.

One of the mothers of a victim of the Sandy Hook tragedy spoke. She is a Marriage & Family Therapist (MFT)and she spoke of her loss and her faith and the deep mental illness of the shooter and of forgiveness. It was very moving.

I'm a very strong 2nd amendment supporter and it pains me to hear of the violent alternatives offered by some. At the same time I am outraged by the gun grabbers. Since when did our schools and workplaces become free fire zones and how can we allow this travesty to continue?

The only thing in my "go bag" for either coming or going here are my pills (though when I tell my Doc what Anonomom told us about statins, next trip I might have fewer pills...), my iPad (for my books - 42 this summer for a personal best), and my reading glasses. And that is for six months in this house or in DC. If I had a man-purse, that would do it for me.

Mrs. OL and the dogs, OTOH, well the car is packed to the gills.

I do stay connected with both houses with my previously described OCD level electronics and cameras. This year I added one camera at the Nantucket house. It is set at my eye height in my cocktail hour G&T chair, facing the ocean. At home I plan to set that "G&T CAM" up on the iPad each evening at the appointed hour.
