The WaPo gets a leaked version of the upcoming IG report into Hillary's private email server:
State Dept. inspector general report sharply criticizes Clinton’s email practices
By Rosalind S. Helderman and Tom Hamburger May 25 at 10:18 AM
The State Department’s independent watchdog has issued a highly critical analysis of Hillary Clinton’s email practices while running the department, concluding that she failed to seek legal approval for her use of a private email server and that department staff would not have given its blessing because of the “security risks in doing so.”
The inspector general, in a long awaited review obtained Wednesday by The Washington Post in advance of its publication, found that Clinton’s use of private email for public business was “not an appropriate method” of preserving documents and that her practices failed to comply with department policies meant to ensure federal record laws are followed.
The report says she should have printed and saved her emails during her four years in office or surrendered her work-related correspondence immediately upon stepping down in February 2013. Instead, Clinton provided those records in December 2014, nearly two years after leaving office.
The report found that a top Clinton aide was warned in 2010 that the system may not properly preserve records but dismissed those worries, indicating that the system had passed legal muster. But the inspector general said it could not show evidence of a review by legal counsel.
IANAL and someone can doublecheck but when I looked recently my conclusion was that these [the record-keeping stuff, not the handling classified info stuff] are administrative, not criminal violations. Utter disdain for the FOIA, for example, earns a dressing-down from one's supervisor or a federal judge, not fines or imprisonment. Back to the WaPo:
The new report focuses on record keeping and how Clinton and previous secretaries of state have maintained documents regarding public business. She has said she complied with laws requiring the preservation of documents, including emails, because she emailed other government officials at their official accounts, knowing their emails would be retained on public servers.
However, she has not explained how she intended emails sent to private citizens, who did not use government email, to be preserved. Some emails have emerged, particularly from Clinton’s first months in office in 2009 when her aides have said she was transitioning technology, that she did not provide to the State Department.
ERRATA: This is from the FOIA, section 4:
(F) Whenever the court orders the production of any agency records improperly withheld from the complainant and assesses against the United States reasonable attorney fees and other litigation costs, and the court additionally issues a written finding that the circumstances surrounding the withholding raise questions whether agency personnel acted arbitrarily or capriciously with respect to the withholding, the Special Counsel shall promptly initiate a proceeding to determine whether disciplinary action is warranted against the officer or employee who was primarily responsible for the withholding. The Special Counsel, after investigation and consideration of the evidence submitted, shall submit his findings and recommendations to the administrative authority of the agency concerned and shall send copies of the findings and recommendations to the officer or employee or his representative. The administrative authority shall take the corrective action that the Special Counsel recommends.
(G) In the event of noncompliance with the order of the court, the district court may punish for contempt the responsible employee, and in the case of a uniformed service, the responsible member.
I guess a contempt of court finding could result in jail time but it is still not a felony, as best I know. Still, what a weird Hillary defense - she broke the law but the penalties are minor, so what's the big deal? Uhh, she broke the law? And now wants to be Chief Executive?
TO BE CLEAR: I am focusing on the record-keeping violations, not the potential mishandling of classified information.
How am I supposed to get work done if I have to constantly check for new threads?

Yup, spin. "everyone did it." spin again "just administrative policies." don't look at those classified materials laws -- look st the spinning squirrel!!!!!
Posted by: henry | May 25, 2016 at 10:58 AM
Sure, there will be spin. The IG once dated someone whose sister is a Republican or something. But while not the big KABOOM I think that this report just adds to the steady drip drip drip that reinforces the notion that Rodham is not honest or trustworthy and does not play by the rules.

My comment;

An IG would be unlikely to even address any criminal possibilities or anything besides State Dept regs while an official FBI criminal investigation is underway, I would think.

Another nail in the coffin.

Posted by: maryrose | May 25, 2016 at 11:21 AM
While Hillary may escape sanctions for evading FOIA and State Department rules, there is that little matter of instructing an underling to strip the intelligence headers and send the info over unsecured channels. That's exposing secrets to the enemy and should result in her losing whatever classification she should have.
This is also a woman who a) needs help using a classified phone, b) orders aides to find out what's on televisions, and c) deliberately acts outside rules and regulations, and has consistently done so throughout her career. That alone should make anyone who is not already in the barrel with her wary of entrusting her with the presidency.

Of even more concern, at the very end of the WP article: "She said that she also exchanged about 31,000 personal emails during her time as secretary and that those messages have been deleted." That's a lot of emails that have been declared "personal." What are the odds some US govt "sensitive" info was in there and she deleted it (and then destroyed the server, btw)?
Posted by: dc | May 25, 2016 at 11:29 AM
Very good, Ig. Another aspect of the 'even worse' argument is that their assessment of Trump is purely speculative, and never considers, argumentum gratis, that he could actually be a good, very good, or excellent president. It's embarrassing.

Trump readily agreed to an interview. Hillary declined, and has not given an interview to the WaPo in 13 months.
This article shows how out of touch the Clinton people are. They keep mouthing the same platitudes, and it isn't working.
Trump is quick, nimble, and operating a lot on instincts. She cannot react quickly enough to counter him.

CNN is of course soft pedaling the IG Report. It says that the report "faults" Clinton (as opposed to the WaPo's "sharply criticizes"). It also mentions that Rodham and her top aides "declined" to be interviewed by the IG; I think Politico had it "refused to answer questions."
I still think that this hurts her, but we can see the media going into "some minor paperwork issues, just like the time you didn't get your expense report into accounting by the end of the month, nothing to see her and move along" mode.

Posted by: maryrose | May 25, 2016 at 01:21 PM
My theory is that people such as Murray are going to vote for The Hill but don't want to admit it. At the very least, even if they are going to keep clean togas by not voting, they want The Hill to win. And my theory on their preference is that it has nothing to do with anything approaching reasoned analysis, and everything to do with culture. Even many conservative intellects don't want an individual with a Rat Pack mentality becoming POTUS. The Hill may be from the crony rentier Alynskyite mindset, but her upper middle class, Wellesley and Yale breeding make her more acceptable.
But lest my friends here think I've gone soft on Trumpster, I reaffirm that my views on him haven't changed. Unlike Murray, however, thinking The Hill would be worse, in my opinion, is a compelling reason to vote for The Donald.

Happy Birthday, John Wayne:
HOW JOHN WAYNE SAVED THE MARINES
John Wayne was born on May 26, 1907, in Winterset, Iowa, as Marion Morrison, weighing 13 pounds. His birthplace is a museum. There is a guest book, opened to a page with the entry, in the entrant’s handwriting, Name: Ronald Reagan, Address: 1600 Pennsylvania Ave., Washington DC.
To celebrate the birthday of a truly great American, let me tell you how John Wayne saved the Marine Corps. In the aftermath of World War II, the psychological letdown after years of war and bloodshed, the huge demobilization of servicemen, the desire to slash military spending, and the antipathy towards the military by the leftist liberals in the Democrat Party.... all combined in a call by a number of Senators and Congressmen to abolish the Marine Corps.
In this, they were supported by the Doolittle Board, created by Harry Truman, which called for the Marine Corps to be “disbanded” as a separate military force, and “unified” with the Army [yes, the board was headed by Air Force General Jimmy Doolittle].
A group of enterprising Marines – you can always depend on Marines to be enterprising – with Hollywood connections, thought a movie made around the most famous photograph of World War II, Joe Rosenthal’s photo of the Marines raising the flag on Mount Suribachi on Iwo Jima, could help sway public opinion against their disbandment.
They approached Hollywood director Allan Dwan, who agreed to commission a script. The movie was to be called “The Sands of Iwo Jima,” and everybody agreed there was only one man who could play the lead role of Sergeant Stryker: John Wayne.
To their great surprise, Wayne turned it down. He didn’t like the script, and he wasn’t enamored of the character of Stryker. The Marines came to the rescue again. The Marine Corps Commandant, General Clifton B. Cates, got on an airplane and flew from Washington to California to personally request Wayne make the picture. When General Cates explained the stakes involved – the very existence of the Marine Corps – Wayne immediately changed his mind, promising the general he would do everything in his power to have the movie be a success.
The Sands of Iwo Jima was released in 1949 and quickly became a runaway blockbuster, with millions of moviegoers packing every theatre showing it. Wayne was nominated for a Best Actor Oscar, establishing him as Hollywood’s Number One box-office star. The Doolittle Board folded its tent, and no politician on Capitol Hill ever again said a word about disbanding the Marines.
So let’s all say “Semper Fi” to the memory of John Wayne.
To further celebrate his birthday, here’s a treat and some advice. The treat is this link: A biography of John Wayne written by Ronald Reagan, in the October 1979 Reader’s Digest.
The advice is this: Don’t ever trust a man who doesn’t like John Wayne. A man’s opinion of John Wayne is a good rule-of-thumb test of his character and moral values. To admire John Wayne is to admire the heroic and the morally noble. To sneer at John Wayne is to admire the opposite. It’s revealing that you find very few liberals among his admirers, and very few conservatives among his detractors.
And John Wayne’s famous quote? “Sgt Stryker: Life is tough, but it's tougher if you're stupid.”

I will upset Threadkiller's analogy with my eating habits.
This sounds thoughtful. Maybe worthy of a reasoned discussion.

Jack, if John Wayne had "become" transgendered LIBTARDS would have approved of him. I've heard libs sneer at John Wayne's given name of Marion Morrison.

"In the last hour Sen. Tom Cotton took to the Senate floor to denounce the “bitter, vulgar, incoherent ramblings of the minority leader,” the “cancerous” Harry Reid. And it gets better from there. Take it in—just two minutes long:"

her upper middle class, Wellesley and Yale breeding make her more acceptable.
So I guess they just ignore the way she dealt with "bimbo eruptions" by hiring her lowlife taxpayer-funded goon squad to trash the reputations of the women her husband sexually harassed and/or assaulted?
Or is that OK to them because she hired someone else to do it rather than do it herself, since of course people of good breeding always bring in hired help to do the messy household tasks?
