State Dept. inspector general report sharply criticizes Clinton’s email practices

The State Department’s independent watchdog has issued a highly critical analysis of Hillary Clinton’s email practices while running the department, concluding that she failed to seek legal approval for her use of a private email server and that department staff would not have given its blessing because of the “security risks in doing so.”
The inspector general, in a long awaited review obtained Wednesday by The Washington Post in advance of its publication, found that Clinton’s use of private email for public business was “not an appropriate method” of preserving documents and that her practices failed to comply with department policies meant to ensure federal record laws are followed.
The report says she should have printed and saved her emails during her four years in office or surrendered her work-related correspondence immediately upon stepping down in February 2013. Instead, Clinton provided those records in December 2014, nearly two years after leaving office.
The report found that a top Clinton aide was warned in 2010 that the system may not properly preserve records but dismissed those worries, indicating that the system had passed legal muster. But the inspector general said it could not show evidence of a review by legal counsel.
IANAL and someone can doublecheck but when I looked recently my conclusion was that these [the record-keeping stuff, not the handling classified info stuff] are administrative, not criminal violations. Utter disdain for the FOIA, for example, earns a dressing-down from one's supervisor or a federal judge, not fines or imprisonment. Back to the WaPo:
The new report focuses on record keeping and how Clinton and previous secretaries of state have maintained documents regarding public business. She has said she complied with laws requiring the preservation of documents, including emails, because she emailed other government officials at their official accounts, knowing their emails would be retained on public servers.
However, she has not explained how she intended emails sent to private citizens, who did not use government email, to be preserved. Some emails have emerged, particularly from Clinton’s first months in office in 2009 when her aides have said she was transitioning technology, that she did not provide to the State Department.
ERRATA: This is from the FOIA, section 4:
(F) Whenever the court orders the production of any agency records improperly withheld from the complainant and assesses against the United States reasonable attorney fees and other litigation costs, and the court additionally issues a written finding that the circumstances surrounding the withholding raise questions whether agency personnel acted arbitrarily or capriciously with respect to the withholding, the Special Counsel shall promptly initiate a proceeding to determine whether disciplinary action is warranted against the officer or employee who was primarily responsible for the withholding. The Special Counsel, after investigation and consideration of the evidence submitted, shall submit his findings and recommendations to the administrative authority of the agency concerned and shall send copies of the findings and recommendations to the officer or employee or his representative. The administrative authority shall take the corrective action that the Special Counsel recommends.
(G) In the event of noncompliance with the order of the court, the district court may punish for contempt the responsible employee, and in the case of a uniformed service, the responsible member.
I guess a contempt of court finding could result in jail time but it is still not a felony, as best I know. Still, what a weird Hillary defense - she broke the law but the penalties are minor, so what's the big deal? Uhh, she broke the law? And now wants to be Chief Executive?
TO BE CLEAR: I am focusing on the record-keeping violations, not the potential mishandling of classified information.

It's hard to find good comparisons because so few people with a record of incompetence and criminality like Hillary's ever rise to being close to getting nominated for President, but would it be unfair to say that Hillary's experience in public service is more akin to Mohammed Atta's as a pilot? Sorry for the delay in getting back to you on your inquiry about my present thoughts on Trump's chances.
I will remind everyone that I never thought Trump would win the nomination. I was very negative on his chances to win the general if he was nominated.
The early -- probably too early to be meaningful -- polling of late has been better for him than I expected.
So my predictions have not been so good this year.
For what it's worth I think that Trump is the only conceivable Republican that Rodham could beat. She still has a very good chance of doing so. A long way to go and a lot will happen between now and November. Trump may still get blown out and he could certainly still lose.
But so far -- and it is not very far -- he is doing okay and better than expected.
I despise Rodham both as a person and for her policy stands. But I am not yet convinced that Trump is the better alternative. But that is another subject. In terms of his odds of winning, they are better than I expected at this stage.

I am a realist. Trump is who we have. If you are hoping that someone else comes along, it is futile and, in my opinion, wishing for disaster.
Any late entrant will cause disarray in the GOP and cost us the election.
Trump is the guy. Pray on it, think about it, whatever. No one is going to come along and save you from this choice.

It is highly likely that this will be the choice. But things have a way of changing. It's been a very strange year and very few predictions have held up well -- certainly not mine.
I will continue to think about it and monitor the campaign. As I said, if the choice does come down to Rodham or Trump or third party or staying home, I will make my mind up at the end of the campaign, not the beginning.

Since I am not the single issue voter that you appear to be,
We all have single issues that are enough to count out a potential candidate. Sometimes there are more.
Open Borders are ok in your pro/con list, and not in mine.

Theo, I would think that anyone of libertarian leanings would want Trump and not The Hill/Biden/Warren/Comrade appointing federal judges. Another four years of Dems appointing federal judges will enhance judicial willingness to uphold whatever anti-natural liberty legislation or regulations that are promulgated.

There are probably continuing secret meetings in which a third party candidate such as Romney is being sought. But I don't think there will be a convention challenge to The Donald.

I was reasonably happy with Trump's list of potential Supreme Court nominees. If I trusted him to deliver, that would be a point in his favor. But even SCOTUS is not the only reason to vote for someone.
Trump is in no ways a libertarian himself. He is a big government man through and through. He does not appear to believe in either free markets or free trade. He is not a conservative. He is a populist and a nationalist with a pugnacious style, which I think explains almost all of his support.
I agree with others here who said that he would not have been my first, second or even fifth choice for the nomination. The question is whether to vote for him in the general and I have not made up my mind.
