Interesting point/counterpoint on whether the President can engage in obstruction of justice.
Prof. Dershowitz:
On "Fox & Friends," Dershowitz countered that Trump had the constitutional power to fire FBI Director James Comey and to tell the Justice Department who to investigate and who not to investigate.
"If Congress were ever to charge him with obstruction of justice for exercising his constitutional authority under Article II, we'd have a constitutional crisis," Dershowitz said.
He explained that Congress would have to demonstrate "clearly illegal acts" on Trump's part, such as former President Richard Nixon paying "hush money," telling people to lie and destroying evidence in the Watergate scandal.
"There's never been a case in history where a president has been charged with obstruction of justice for merely exercising his constitutional authority. That would cause a constitutional crisis in the United States," Dershowitz said, adding that he hopes Special Counsel Robert Mueller understands that before he considers bringing an indictment or recommending that the matter be referred to Congress.
Judge Napolitano, who differs but not by much:
On "America's Newsroom," Judge Andrew Napolitano came down on the side of Feinstein.
He explained that if Trump asked Comey to end the investigation into Flynn for a non-corrupt purpose - such as if he felt sympathy for his former national security adviser or he wanted the bureau to use its resources on more important matters - it's not obstruction.
However, if Trump did it for a corrupt purpose - such as trying to protect himself or his son-in-law, Jared Kushner, from what Flynn might say - then it is obstruction and there is no presidential immunity, Napolitano said.
"Obstruction of justice is a crime no matter who commits it, if done for a corrupt purpose. It's also an impeachable offense," he said, adding that the charge is "intentionally not easy to prove" for a prosecutor.
Of course, from what we have seen so far Flynn has pled guilty to lying about the commission of a non-crime, so unless Mueller has more, impeaching and removing Trump for "obstructing" the investigation of non-criminal activity will be perceived by many as a Constitutional coup.
FISA -imho ain't gonna happen, daddy. We might get to know whose signature was on the application.

This caught my eye:
McCabe told Flynn “some agents were heading over (to the White House) but Flynn thought it was part of the routine work the FBI had been doing and said they would be cleared at the gate,” the source said.
“It wasn’t until after they were already in (Flynn’s) office that he realized he was being formerly interviewed. He didn’t have an attorney with him,” they added.

JiB -- that's actually the main point of the calculator. (I'm very familiar with this because last year our itemized deductions came out to be $17 less than the standard deduction, so for the first time in a quarter century we didn't itemize. That's what happens when you are po' folk!)
Posted by: cathyf | December 04, 2017 at 03:59 PM
JiB,
We currently itemize. The new standard exemption will be higher than our itemized deduction total - even with the SALT deduction loss.
We don't have medical expense deductions and after refinancing our mortgage (going from a 30yr in the 5's to a 15yr @ 2.75), our home interest deduction hasn't amounted to much.
I'm not seeing what the calculator is missing...

34) January 26th, 2017 - Sally Yates (per her congressional testimony in May) informs White House Counsel that Flynn is now vulnerable to Russian blackmail because he lied to the FBI and to Pence about the contents of the call.
37) "We weren’t the only ones that knew all of this, that the Russians also knew about what General Flynn had done and the Russians also knew that General Flynn had misled the vice president and others,” Yates said.
So we know for a fact that the bad guys somehow knew Flynn lied to the FBI but via the WaPo we absolutely know because the WaPo told us via these same sources that none of the bad guys knew about Strzok and his affair with Lisa Page, or about any of their inter office text messaging damning Trump which would have been wonderful blackmail material.

Orrin Hatch introduced him, with many compliments.
Then President Trump got up and began by saying that he hoped Orrin "would be in the Senate for a long, long time", turned to him and pointed and nodded.
I think that spells the end of Romney's ambitions as a Utah senator.

CNN on Peter Strzok changing Comey's HC server handling report to benefit HC:
"The shift from "grossly negligent" to "extremely careless," which may appear pedestrian at first glance, reflected a decision by the FBI that could have had potentially significant legal implications, as the federal law governing the mishandling of classified material establishes criminal penalties for "gross negligence."
Why was Strzok given so much power? Lead in HC's server investigation, lead in Clinton Foundation investigation, lead in Flynn sandbag, likely lead in FISA shenans and dirty dossier peddling imo.

The only way that the Russians could BLACKMAIL Flynn with any discrepancies between what he told Pence & the FBI and what actually happened is if the Russians had successfully bugged both Pence & FBI AND the FBI knew AND Flynn didn't know that the FBI knew.
Blackmail is all about keeping secrets in exchange for something of value. If it's not a secret, blackmail is impossible, and the notion that Flynn could be blackmailed is ludicrous.

Right -- but that means that the FBI on their fainting couch "he could be blackmailed" is all projection. The only way that the FBI could know these things that they are claiming make Flynn blackmailable is that the FBI has been doing things that make THEM susceptible to blackmail.
(...which makes you wonder...)

Not quite, Cathy. Projection is placing onto another faults you have yourself. Back at that time in the transition Deep State just wanted to damage and deny Trump at every turn. Any top person who could be taken down was a win for them. Just claiming Flynn talks to Russians wouldn't do it, but whispering he might be blackmailed by the Russians could indeed get him fired. And Trump embarrassed to boot. Win-Win.

Why not get her into the Intelligence Committee and feed Feinstein whatever information they deem "helpful" to the cause.
Feinstein used to be sharper than she is now, and her getting ol'Lisa in that position probably seemed like a good idea since she was so familiar with everything and had FBI connections.
If Lisa is there now, it is NOT a good look for Feinstein. We will see.

Threadkiller,
My list of people that I trust in government has grown very short, and I believe besides Trump and Pence, it only includes a few cabinet members.

I suspect 90% of the problems in Wash DC would be gone if we got rid of the politicians in the picture.

What if the Russkies were tapping the FBI and the FBI had no idea they were being surveilled. [Lots of contemporary evidence to that fact:]?
The way forward may be for Trump to finally collude with the Russians to prove his is being had:)

Lyle, 4:57: Re taking bait on VDH. I paused a moment on that post, thought 'hmmmmm, do I want to go read that? Naw, too much to think about going on with Flynn, FBI, those tantalizing twitter threads' :) to figure out if there's a diss in there.
I've gone from being 'down in the dumps' to 'encouraged' to 'we've got them' to 'sit back and study the machinations' to 'whatever happens, Trump is still president in a country that has turned into a tower of babel.' :)

It's a good question, Deb. Why demote Strzok when all the rest of them are obvious Dem operatives? Something special about him.

This is an interesting read:
While working with General Michael Flynn on The Field of Fight, I interviewed many of his former colleagues in order to better understand my co-author. Virtually all of them described a man who cared deeply about the truth and presented it in circumstances that were certainly not favorable to him. These people portrayed General Flynn as a compulsive truth-teller.

I'll tell you one thing -- I wish someone, anyone, would or could charge Sally Yates with something.
I bristle when I see her name. Darn cow. (A long time ago, I discovered that in England when you call a woman a cow, you're calling her a bitch. So, I get to say a 'bad' word and not feel guilty like I did last week.) :)

On Air Force One, @hogangidley45 said Pres Trump clear on the issue of moving US Embassy from Tel Aviv to Israel - that it's not a matter of "if," but of "when." Decision expected in coming days.

In that case, yeah, she's a major cow. I bet Bush wouldn't have fired her.

I'm guessing there's a shit-ton of things that desperately need stay uncovered at the CFPB. You?

There is one thing missing in the analysis of why Flynn copted a plea. His son. He is pretty outspoken and may have been more involved than anyone of us suspect. When a man of character like Flynn falls on his sword it is either for Country, God or Family.
I Take Family.
