As if the FBI hadn't brought itself into enough disrepute, today's gambit is inexplicable. If the statement wasn't an authorized release, someone in charge of issuing statements should have immediately sent a "That's not from us" message before the fake statement went viral.

According to an NBC reporter, the statement came in an email from the FBI press office. However, not all of the email has been released and the receiving reporter will not let people see the entire thing.

"Concerning" news from the DC Circuit Court:

The en banc panel of the court upheld the CFPB's structure in a split decision issued today. In reversing the earlier ruling, the court accepted the argument that Congress could create a uniquely structured agency as a way to shield the bureau from political influence.

"Congress's decision to provide the CFPB director a degree of insulation reflects its permissible judgment that civil regulation of consumer financial protection should be kept one step removed from political winds and presidential will," Judge Cornelia Pillard wrote for the majority.

Although the court upheld the CFPB's structure, it tossed out penalties that the CFPB had issued to PHH Corp., a mortgage services firm and the plaintiff in the case.

This ruling might not be the last word on the CFPB. Ilya Shapiro, a senior fellow in constitutional studies at the Cato Institute, thinks the Supreme Court should take the case. The D.C. Circuit ruling was disappointing but not surprising, Shapiro says, because the court has a history of being deferential to the government's case.

All reporters are in on the pool and, at certain times, only a couple are designated to receive the statements and distribute them to the rest of the pool. The idea that the NBC reporter was the designated pool reporter and he withheld portions of the email from his brothers in arms is farfetched.

If HuffPo was the first to market it is only due to their reckless nature that is leaps and bounds worse than the rest of the MFM. The later reports only mean that some of the clowns exercised a little caution or they wanted to do hit-job questioning on unsuspecting Republicans.

I think the NBC reporter story is BS.

Now, I gotta go continue celebrating on this victorious Tuesday (I hope y'all are celebrating, because last night was one hell of a victory) and, OL, I've been hip to your lets bait the HNIC game but . . . about this FBI statement. This is clearly part of the script. Who runs the FBI? Who runs the DOJ? Who is the boss of the Executive branch? Who just delivered a phenomenal State of the Union address ???

Come on, gang. All is well, these people are being played like a fiddle. The FBI *should* have grave concerns, right? Some of the rank and file genuinely don't want the memo released for good and proper reasons. But the memo is going to be released and the FBI will have to work to regain trust. Frankly, lawyers and prosecutors all around this country will have to do the same. Government will have to do the same.

Everything has changed in the blink of an eye because of Donald John Trump winning the Presidency. Bill Clinton famously said the era of big government is over; President Trump means it.

How so? The DACA fix, funding the wall, ending chain migration and ending visa lottery will all be done via legislation that will require enough Democrats to overcome a filibuster. If a deal is made and signed into law, future Presidents will not be able to get rid of the immigration reform provisions without repealing the law and that will also require 60 votes in the Senate.

Hannity on with DeSantis on radio on the Memo's Release-Gate, so not verbatim but just my general takeaways

DeSantis is saying that the Committee asked the FBI to tell them what was inaccurate in the 4 page Memo. Says it was one of the very high up guys at the FBI in the CI branch and he said there was nothing inaccurate at all in the memo he could point to.

So as a consequence DeSantis says he is not buying the current FBI requests not to release it since they can't point to anything inaccurate in it.

DeSantis also says he has now read Schiff's Memo and he is happy to have that released as well. He says we the people need to see it all.

DeSantis also says that if the FBI is so worried about all this info being released then why have they been leaking like sieves to the Media and why are Ohr and Strzok and McCabe and Page etc now demoted? He says he is not buying the words from these folks who have leaked like sieves in the past now screaming "Oh woe is me."

He says there is a lot more stuff other than the Memo stuff that as a result of the Memo's release is going to result in a lot more Congressional scrutinizing.

Desantis says he also think it was more focused animus by the FBI perps against Trump than focused against the Republicans in general. Says in his opinion they really really had it in for Trump personally.

I think President Trump is, too. But I’m on the Ledge because no matter how smart he is, he needs the people on his team to be trustworthy and effective, and from where I sit I can count the number of people who qualify on both of those criteria, on my fingers.

I hope I’m wrong. I hope Sessions really does understand what’s going on and is truly working hard behind the scenes. I hope Nunes and company really do know what they’re doing. I hope there actually are honest people in the ranks at DoJ and FBI and elsewhere. I hope and pray for all that. I just don’t trust that any of it is true.

Here is the link to the statement on the FBI site, which has just appeared in the last hour or so, although it has been circulating around the press for quite some time.

Is this some obligatory thing that they put out as something to object to whenever information comes out? Who is in the FBI press office? Why hasn't this been signed by the FBI Director?

To my mind, the FBI is made of of actual people and isn't some monolith which comments out of an automated file cabinet or something. So who wrote this?

And more importantly, who sent the email alerting the press? THAT might tell us something.

And after seeing this, I have to agree with Old Lurker that there seems to be a faction in the FBI which are not on the same page as the administration and Wray doesn't seem to have control over them.

One other thing: could Comey have gotten someone to write this and delayed putting it on the site until late in the day?

The memo is House work product. They voted to release it, so it becomes public in 5 days. The FBI (an inferior statutory agency) doesn't get a vote. The President can object, but the house can and will vote to override him. The memo will be public on Saturday? What's everybody so worked up about?

CNN now says Strzok wrote the letter Comey sent to Congress when he reopened the Clinton email investigation "according to a source familiar with Strzok's thinking."

How do you know that? I don't. Over the years I have seen many statements walked back because underlings weren't on the same page as the boss.

However, we just do not know one way or the other. Did Wray approve it? Did Comey call in a favor from a pal still in the press office? Does the press office report to HR and Strzok is the author?

We just don't know. I imagine we will know something by tomorrow morning.

One other thing we need to consider: maybe Wray is mentioned in the memo. That would make it factually accurate (according to what we heard yesterday) but still cause an objection.

Because I know how big organizations work. There are checks and balances over things like press statements, and high-level approvals are necessary for anything controversial. People don't just purposely lose their jobs over silly shit that can be easily corrected or withdrawn.

These are desperate times for certain people within the FBI, so I do think we have to keep all possibilities on the table.

You will note that I also kept the possibility that Wray himself is mentioned in the memo, so I am not totally giving him a pass.

I do think it is odd that all of the press had the statement for hours before it went up on the web site. I would like to know who sent the email and why there is the time differential.
