The NY Times has coverage of the 'wrong apartment' shooting in Dallas. There detail about neighbors complaining about marijuana smoke is new to me (and to Google News), and provides a rationale for the seemingly gratuitous marijuana 'smear' of a few days back. My emphasis:
In an echo of past police killings, there has been anger over what seem to be attempts to incriminate the victim: Police released a search warrant that revealed that 10.4 grams of marijuana in multiple baggies had been found in Mr. Jean’s apartment.
“First they assassinate his person, then they assassinate his character,” Mr. Crump said.
Hours earlier that evening, managers at the apartment complex had received complaints from residents that there was a strong smell of marijuana in the fourth-floor hallways. Managers knocked on Mr. Jean’s door and at least five other doors inquiring about the smell, the Jean family lawyers said. It was unclear who on the floor was responsible for the odor.
OK, first, the Times cites as its source "Jean family lawyers", who held a press conference which included denunciations of the marijuana search and coverage. Did the Times get this 'neighbors complaining' detail separately, or did the rest of the media overlook its significance?
And what is the significance? Well, if - IF - Jean had been smoking marijuana and had cracked his apartment door in order to get some cross-ventilation, that would explain the neighbors' complaints and might answer the riddle of whether his door could have been ajar at times during the night, as Citizen Guyger claims. Kind of a big deal.
Other details which might lean a bit towards Citizen Guyger:
Mr. Jean’s relatives, lawyers and supporters all say it would have been difficult for the officer to have mistaken Mr. Jean’s door: It had a large, bright-red, semicircular doormat, lying on a bare concrete floor. Officer Guyger had none. Would she not have noticed?
“My main concern is that she is lying,” said Mr. Merritt, one of the Jean family lawyers.
But Officer Guyger’s supporters say she had her hands full at the time she arrived at Mr. Jean’s door: Officials said she had with her a police vest, duty bag and lunchbox — items she might be expected to carry to her own front door, not someone else’s.
Depending on how she is holding those items the floor and doormat might not be immediately visible. Nor, if she is on autopilot after a long day, would she be checking for prompts and clues as to her whereabouts.
I still believe that if evaluated as a police officer, Ms. Guyger's decision to shoot can not be justified; if it was too dark for her to see anything other than a silhouette, as she claims, it was too dark for her to see a weapon that could have elevated this to a deadly force situation. IMHO police training in de-escalation is woefully deficient but she could have simply stepped back out of the apartment, re-assessed, and called for back-up. My goodness, what if she had been at her own apartment door and the superintendent had been responding to a complaint about a leak and then decided to change a burned out lightbulb in her entranceway? She's going to shoot the guy?
Evaluated as a civilian in her own residence, the standards for the use of a weapon in self-defense are more lenient and a case for self-defense to prevent a robbery could be made (Texas Penal Code 9.31, 9.32). IF she had been in her own home, which of course she wasn't. And since the hallway was available, shooting just seems to me to be a second or third choice. She lived alone, so she had no reason to think anyone inside was in danger. Stand in the hallway and think things over. Count to ten.
Well. Hindsight is twenty-twenty.
AS BEST I CAN TELL: The NY Times stands alone on this, as best I see.
I await developments.

Iggy,
I didn't say I was the first to post on Cohl Feury's theorys. You were, of course.
I am sort of surprised they put Bama against Auburn this early in the season. A lot of games like that, it seems. But I love to watch Alabama, not because I am a fan but because I love to watch disciplined football.
Yes, absolutely discipined. From the first tier player to the last tier player. You know your position, for every kind of play, you know your reaction. From the play book you know every play and every contingency when it goes bottoms up. It is drilled into you every day. But then when you were recruited you were in the top 100 if not 50 of the best high school players in America. Then you said to self and family, "why should I not play for Nick Saban." Really that simple.
As long as Nick is there, they will always be a highly ranked team. I used to put Frederick on my side and show him how Alabama works. Every coach should. They work plays differently because their kids are in shape, fast, and disciplined beyond their opponents.
When you break it all down. Nick gets the best kids then makes them better.

Wait a minute...now I may have no idea what an octonian actually is but I do know what first is. Who posted a story about Feury and octonians first around these parts?
It's all relative Iggy, and certainly it depends upon what dimension you posted it in.
From "Elegant Universe", (Published 1999) here's my quick cutting and pasting and hopefully short explanation of why these eggheads came up with String Theory in the first place and why they remain so attached to it:
Pg 182) String Theory is the only way we know of to merge general relativity and quantum mechanics.
pg 13) We could go on but the idea is clear: the universe is the way it is because the matter and force particles have the properties they do. But is there a scientific explanation for why they have these properties?
String Theory offers a powerful conceptual paradigm in which, for the first time, a framework for answering these questions has emerged.
The particles in Figure 1 (atoms, electrons, protons, neutrons, quarks) are the "letters" of all matter. Just like their linguistic counterparts they appear to have no further internal substructure. String Theory proclaims otherwise...if we could examine these particles with even greater precision---many orders of precision beyond our current technology---we would find that each is not pointlike, but instead consists of a tiny one-dimensional loop. Like an infinitely thin rubber band...a vibrating, oscillating, dancing filament...
Pg 130) The size of these strings---The Planck Length? ...a millionith of a billionith of a billionith of a billionth of a centimeter(10-33) if we were to magnify an atom to the size of the known universe, the Planck Length would barely expand to the height of an average tree.
So why the need to postulate super-microscopic dancing strings?
Pages 140-144 (My babbling)---if you apply variations of Euler's 200 year old equation having to do with explaining the vibrations of a violin string, you come up with vibrations that have the properties of a quark, and then octave's up have the properties of electron's, and then octave's up emerge as the properties of a proton, and gravity and etc, ---beguilingly seductive stuff.
I think it is the passion and potential understanding aroused within that seductively interesting idea that keeps these guys so enthralled, but the flip side, IIRC like I believe Feynmann immediately recognized when he begged of String Theory, is what Dumbledore warns Harry Potter about after his afternoon of staring at The Mirror of Erised:
“Can you think what the Mirror of Erised shows us all?" Harry shook his head.
"Let me explain. The happiest man on earth would be able to use the Mirror of Erised like a normal mirror, that is, he would look into it and see himself exactly as he is. Does that help."
Harry thought. Then he said slowly, "It shows us what we want... whatever we want..."
"Yes and no," said Dumbledore quietly.
"It shows us nothing more or less than the deepest, most desperate desire of our hearts. You, who have never known your family, see them standing around you. Ronald Weasley, who has always been overshadowed by his brothers, sees himself standing alone, the best of all of them. However, this mirror will give us neither knowledge or truth. Men have wasted away before it, entranced by what they have seen, or been driven mad, not knowing if what it shows is real or even possible.
And that's all I have to say about that.

4d or not, according to what JackStraw has been posting, what they're uncovering is huge and the corruption goes back at least to the GWB administration and maybe earlier than that. Forget small trash jokes like Watergate, this blows all the collected scandals since the start of the country out of the water. This could permanently impact how people think about the federal government. The only thing I can compare it to is how my parents generation thought about the Depression.
I don't think McCarthy's brain can process the magnitude of it.

Andy McCarthy said: "We’ve had a lot to say about Deputy Attorney General Rod Rosenstein’s failure to comply with federal regulations that require showing a factual basis for a criminal investigation — i.e., reason to believe that a crime was committed — before appointing a special counsel, Robert Mueller. But Rosenstein was just riding the tide. The FISA warrants show that this practice of launching a criminal investigation in the absence of a crime long predated Rosenstein and Mueller. "

Posted by: Captain Hate | September 15, 2018 at 08:40 PM
Captain Hate,
I saw a post today by Imperator Rex which discussed this very thing.
His opinion was that with the corruption and bad actions being so wide-spread and for so long, Trump was moving very deliberately and slow. Removing everyone in Justice, FBI, and other agencies would effectively decapitate the government and cause wide-spread panic.
In my opinion, Trump is moving methodically.
1. Remove Deep State funding. This would include stopping foreign money, stopping crime syndicates which pay off people in agencies and Congress, going over budgets and asking about slush funds and mysterious projects, etc.
2. Remove influence of the media and press. This has been well underway and continues. This also includes Hollywood, who are losing influence by the day.
3. Get Americans up to speed on what has been going on, although gradually so that people don't panic.
4. When all of these are far enough along, drop the hammer.
This is why those of us who are already well aware of what's been going on get impatient. It's a plan which makes sense to me if it is what is really going on. Of course, it's only my theory.
Posted by: Miss Marple (the real one) | September 15, 2018 at 08:41 PM

I see that Dershowitz has raised fears about the Manafort Plea Deal, whereas Andy McCarthy 2 columns back has said there's nothing there so don't worry a bit.
Without any inside knowledge I gravitate to Dersh's worries because Dershowitz, being a lawyer who sued the Boston Garden because he slipped on the wet floor of the toilet at some Celtic's Game, Dershowitz knows full well how unethical Lawyers can be, whereas how many times have we seen Andy M show up on FOX and Friends explaining how he never dreamed his former colleagues in the DOJ would do whatever their latest egregiously unethical and illegal act was. My general recommendation to Andy M is that he has somebody tattoo the name Ted Stevens backward on his forehead so that every time he looks in a mirror he reads the Ted Stevens, and his memory is triggered about how the FBI/DOJ intentionally coached their "Star Witness" to lie under Oath, thereby handing the Senate Seat to Mark Begich and giving Obama his 60th Vote for ObamaCare.

Ignatz,
I have discovered that what I need to do is keep my brain from overtime thinking. If I am lying in the quiet and dark, my brain starts running on finances, family problems, plans for yardwork, etc.
What I try to do is listen to something on live feed which distracts me and keeps my brain enough occupied that I am not overcome with worry. Last night I listened to the hurricane coverage, which put me to sleep fairly quickly. Some nights I listen to videos playing one after another from the White House YouTube site. In addition, some nights I also play a game on my iPad which is geometric and has no characters or plot.
The WORST thing for me is staring off into the dark and quiet.

He's supposed to be a politician. Isn't the proper and competent politician's response to say "I don't think this is really about how post-hurricane deaths are measured, which is a relatively new and uncharted discipline. This is about a biased media's attempt to manipulate and abuse a tragic natural disaster in the service of their favored political agenda."

I've been reading some of the "look-back" articles on the 2008 financial panic. Most of them are clueless after 10 years of possible reflection and studies that ensued from the event.
They point with childish simplicity at this or that, completely missing the point. 2008 was the worst financial panic that the US had ever seen. It was a near-total collapse of all the markets at once. Pointing at this or that aspect just doesn't cut it. It might suit your worldview or your politics to decry some aspect or other.
None of them look at Ginnie Mae, Fannie Mae or Freddie Mac as the ones who set up the panic in the first place by adopting Michael Milkins' junk bond concepts and applying them to the home mortgage market.
But if any of them did that, you would realize that only happened because Congress allowed it to happen. They exhibited no oversight of those agencies and their increasing stupid schemes that brought in low-quality borrowers. In fact they encouraged it by forcing banks to make riskier loans due to the "Community Banking Act" of 1977. "Activists" complained every time a banking license was up for renewal that whatever the bank's name was they weren't doing enough business in inner cities.

Yes they agonizingly miss the point, instead of looking Into the abyss, they look away, instead they blame deregulation (A dodge as you notice, one particular set of regulations, are implicated)

I loved The Prisoner and still do.
Nothing remotely like it has been made and the time anything could be has long since passed.

boatbuilder,
This is akin to how I would go to choir practice back inthe 80's and be all exhausted, and then when we were done, I would be all energized. I think it was because when you are doing choral singing, you have a host of things to concentrate on: notes, breathing, pronunciation, timing, volume, etc.
By the time I left rehearsal, I would feel all energetic. I assume it was because my brain was distracted from everyday worries.
I think my insomnia problem is related, which is why I choose things which occupy my mind passively (listening) without making me do heavy duty thinking.
It's enough that I follow along with the talking and pretty soon, I am getting drowsy.

boat: the outboard ballast is way heavier and slower. actually had to weigh-in to compete in this event. 605 is the crew limit. my goal was the mendoza line and i hit it on the number. only thing i did well on all week other than the post race parties.

Big Robertson Davies fan here.

Although this is barrel aged in Wild Turkey casks, at only 6% it's not the booze bomb that the stouts tend to be and is a refreshing Porter for the stultifying heat in the last weekend of the summer. Although we aren't directly impacted by the hurricane, that massive stationary low pressure system keeps cold fronts from continuing their east to west movement and stacks them up to the west of here and doesn't let them flush this pukey air away.

jim,
What are your thoughts as a finance guy on the response by the feds to the panic?
I'm pretty sure you probably disagree with my laissez faire, libertarian, let the idiots and the whole place burn so the survivors can start fresh perspective.

Yeah, I was like Danger Man, Danger Man? Oh, you mean Secret Agent Man!

Also I am afraid I agree with our rude pest E. D. that neither Ryan nor Andy McCarthy are dense or naive. They are active protectors of the swamp.
As obnoxious as some of you find E. D. ignore him at your peril.

Nixon was trying to engage in the path not taken, ala Templars strategy for Malaysia, or something akin to the strategy that galula had laid out.

So the media never exaggerates?
Too funny.

Well it goes without saying that you continue to live up to your impeccably high standards in the post-race parties.
It's reassuring to know there are some things that can forever be counted upon in this increasingly chaotic and unstable world.

Yes Marty has picked up some insights along the way, his Adrian monk persona gets in the way of further headway.

I'm glad McCarthy is starting to see the light, but he did a lot of damage casting shade for Mueller as a stand-up guy.

It didn't take too much coaxing to convince Vanderbilt Poofter to partially submerge his body in liquids.

It appears to me that considering the reputation. Of players like Geithner Paulson and co, they behaved awfully strangely, their job was to serve as a,life guard but they were strategically awol.

House Intelligence Committee Chairman Devin Nunes said this week that Democrats and the media are likely to be “frightened” by the information contained in Trump-Russia documents that Republicans are asking President Trump to declassify.

Well, Captain, I ignore every post that begins with "Tommy Boy." And most of the others. I finished junior high school about 45 years ago.

I have consistently heard the same from folks on the ground--state and local teams are receiving above and beyond support from the federal level. Thank you @realDonaldTrump @fema and all involved for helping NC and SC get on the road to recovery.
============================
The retweet goes to President Trump's comment to Brock and the FEMA thanks for all of the support.

Iggy,
It was so bad the FED had to deploy tools it had never used before, didn't know they were allowed to use, probably broke several laws in the process or had some extremely clever lawyers pointing out that it may not be allowed but it isn't explicitly barred.
Actually, I'd be fine with a hands-off, to the victor go the spoils approach, if it had only been the institutions involved.
And I think the FED was trying to that. They were going to let Lehman Brothers fail. They were in talks about how to save Lehman Brothers by some other financial entity, but when private talks broke down, they didn't try to impose a settlement.
There was an earlier investment firm that the FED helped (the name eludes me) and I think them got to thinking that that wasn't a good precedent. Something they should be doing on a day to day basis.
Let me know if you can remember the one before Lehman.
One thing I do remember about Lehman was that their leverage ration 25-30:1. That's not an investment bank. That's a hedge fund or a badly run casino.
