Since section 1 of the 14th amendment still seems to be of interest, I'll repost something I put at the end of the prior thread (in response to the "and" argument).

The first "and" in section one of the 14th amendment could simply mean that kids of those with diplomatic immunity and popped out in US didn't automatically become US citizens. As far as Congress goes, section 5 of the 14th amendment grants Congress "power to enforce, by appropriate legislation, the provisions of this article." Thus, one might argue power in Congress to define the scope of the subject to the jurisdiction clause in section 1. One might counter argue that section 5, in this context, would simply allow Congress to pass procedural and evidentiary rules to establish place of birth.
