Old Lurker

Federal judge orders reinstatement of Acosta Press Pass.

We are doomed.

Old Lurker

WH really really should cancel all briefings until this plays out in court.

Dave (in MA)

Put a bouncer on the Press Secretary's staff who can make sure Acosta stays in the back of the room.

Narciso79

Re assuange they were fine with him when he compromised diplomatic communications sources and methods but you go after one anointed pol and its ragnarok.

Jack is Back!

Let him in but refuse to call on him. But I am still interested where in the Constitution it even calls for a WH press corp, briefings, pressers, etc.

If I was Trump, I would have Mattis, Zincke, Kelly, and Pompeo, alternate doing the press briefings. Let Desi mouth off to those guys.

Buford Gooch

I think I might agree with both sides here.
"selfish, greedy, corrupt, spineless, fearful and bad." "socialist, angry, hypocritical, uniformed, power-hungry and violent."

Both are talking about leftists, correct?

Old Lurker

By going to court, the press has thrown down a constitutional challenge that no POTUS can let stand. I hope Trump knows that and responds in a nuclear fashion.

Tom Bowler

Some of us Republicans view the Democrats as the anti-American party -- at least the leadership of it.

jimmyk

From ext's zerohedge link on the judge's grant of a TRO on Acosta's pass:

Kelly then criticized the Justice Department's defense of how it revoked Acosta's pass, and said that the White House's account of Acosta "placing hands" on a White House intern was of "questionable accuracy."

How the hell was that "questionable"? This is like the Zapruder tape:

Narciso79

The Fujimori options seems more appealing every day.

It would logically follow from this judge's reasoning that public school teachers can't punish kids for disrupting class.

jimmyk

henry, I'm guessing Acosta was never punished for anything.

Meanwhile, big surprise, Cisneros (D) has overtaken Kim (R) in the vote "count" out in CA.

Narciso79

No they don't, it's part of constructivist education models imported from germany.

The lib press is now trying to blame the loss of the House on President Trump. Here is the article by Ron Brownstein:

PLUS, it is being pushed by Never Trumpers.

Of course not. Blame the weather forecasters!

All you had to do was look at the weather west of New Jersey and see that perhaps you had better salt the roads.

Extraneus

I don't see how that judge's ruling stands. "Due process" is required to revoke a "hard pass"? Imagine the logical outcomes that would result from such a legal precedent?

The judge is a Trump appointee, btw.

https://en.wikipedia.org/wiki/Timothy_J._Kelly

Old Lurker

We can all think of actions that can be taken to punish Acosta and make them all miserable.

But to repeat, the issue is now way above that level and the right of POTUS to control his WH and his own messaging must now be restored or true hell will result in years to come. Nobody should have the right to enter the WH grounds without the consent of the POTUS.

Narciso79

Well he's a dook graduate too, and Georgetown law I assume he was the finest mind on hatch's staff, sarc.

Dave (in MA)

If they give the pass back they should tell him Trump licked it.

Extraneus

Would the ruling apply to Mar a Lago, too? Trump Tower?

The Infamous Ignatz

Due process?
Isn't the last part of that phrase "...of the law"?
What law was invoked to kick a jerk out?
And how does one go about due process in kicking a jerk out?
If some creep on a WH tour manhandles the docent do they have to schedule and convene a hearing before the SS can bounce him out into the shrubbery?
Are Accost-us the jerk's rights superior to a WH tour jerk's rights?

GUS

Imagine Corey Lewandowski had behaved like Jimmmmmmmmy Accosting. FAINTING COUCHES.

Frau Edith Steingehirn

jimmyk - how does that work in a courtroom? Does a judge have to allow someone to keep talking and control the proceedings? I don't think so.

Put "Desi" in the back of the room and never call on him again.

Old Lurker

In the "real world" (like commercial leases) we use language like "at the sole discretion of Landlord whose opinion shall be final, Tenant shall..." If the tenant does not accept that, we don't sign the Lease.

Surely something like that is printed on every pass issued for the WH?

Arguing about whether the contact was whatever is arguing about a minor point that has nothing to do with the central issue.

Femall. No briefing by anybody until SCOTUS rules. Don't like that?, complain to CNN.

henry

Breifing? lock out the press facilities entirely. Make them stand in the street outside the fence like the rest of us.

Frau Edith Steingehirn

CNN is the news outlet that did not publish the truth about Saddam Husein's reign of terror. Their carpy excuses revealed them for the crooks they are.

henry

Even Mexicans think the caravan is full of assholes:

Pushing, shoving, kicking and a couple of blows broke out between masses of residents and migrants, illuminated by the crescent moon and mobile light towers, set up by authorities on the beach on the U.S. side of the border. More than three dozen municipal and federal police watched, separating people and trying to prevent the situation from devolving into fistfights and chaos.

Even his wife doesn't want Acosta around: Sharon Mobley Stow m. 1994; div. 2017

Porchlight

If they give the pass back they should tell him Trump licked it.

Heh.

I heard a guy on the radio making a pretty okay case for why the hard pass revocation (at least the way it was handled by the WH) wasn't constitutionally kosher. I didn't really buy it but it seemed like it might be good enough for a judge to go with.

matt - deplore me if you must

Simple. The WH will now establish a code of conduct if there isn't one in place and the procedures for booting rude reporters. They just screwed themselves.

Old Lurker

Frau "CNN is the news outlet that did not publish the truth about Saddam Husein's reign of terror. Their carpy excuses revealed them for the crooks they are."

Frau, it is no longer sufficient of focus on Acosta or even CNN because all the others including Fox have joined the fight on Acosta's behalf, so that demands a global meeting of the minds.

Jack is Back!

Of course, the irony in all of this, is that the annual WH Press Associations, black-tie and do lie event where one Barack Hussein Obama dissed DJT like no one ever has, was the catalyst for his 2015 escalator ride to announce his intentions to run for POTUS.

You giveth, and you taketh.

Old Lurker

Exactly my point, Matt.

Porchlight

Good point, JiB. You play games, you win prizes.

Of course Acosta loves all this and so do the rest of the MSM.

henry

Is a disfunctional Congress a feature or a bug? If they make it easier for Congress to do stuff, isn't that the worst of all possible worlds?

Unfortunately, a structural problem is harder to fix than a people problem. In the House of Representatives, we have an opportunity to get rid of bad people every two years via elections. Reforming the legislative process and realigning incentives is more difficult. The reality is that Congress cannot get anything done because it is not equipped to get anything done. It is no longer a tool suited to its original purpose of making laws and providing oversight. It has instead become a theater used by both parties to stoke the outrage of their base. We must reform the processes and power structures of Congress, or we will further tear our country apart.

Narciso79

Fmr judiciary committed counsel,

jimmyk

Timothy Kelly is the judge's name.

Frau, great idea:
how does that work in a courtroom? Does a judge have to allow someone to keep talking and control the proceedings?

The WH's lawyer should just interrupt, and continue talking when the judge says, "Let's move on," or whatever. And when the judge threatens him with contempt, say, "But, your honor, you seem to have decided that rules for decorum are unconstitutional."

Old Lurker

"Your honor, I want to challenge you on something you said last month..."

GUS

and the Bailiff tries to stop Accosting from jabbering on and on and on, and Wee Jimmmmy shoves him aside.

Right?

Maria Butina, alleged Russian agent, asks DOJ to dismiss charges

Prosecutors have claimed that Ms. Butina forged relationships with American politicians while attending college in order to create private lines of communication between D.C. and Moscow that could be used “to penetrate the U.S. national decision-making apparatus to advance the agenda of the Russian Federation.”

Arguing for dismissal in a 28-page memorandum, Ms. Butina’s legal team claimed that their client’s alleged conduct was constitutionally protected, and that the federal statute prohibiting unregistered foreign agents is “overly broad” as applied against her.

“The government does not allege that the Russian Federation employed her as an intelligence officer or foreign agent in any traditional sense,” defense attorney Robert Driscoll wrote in the filing. “The government contends Maria is a Kremlin agent because she shared her memorable American happenings and naïve, youthful optimism for better Russian-American relations with others, including an individual claimed to be ‘Russian Official,’ who did not employ her, pay her, request her to pursue better relations between the two countries or exert any control over her daily activities.”
