All presidents have positive policies and experiences in office that are character defining.

What is more appalling is the campaign to defeat him via dossier and Clinton campaign and the Mueller investigation to discredit and marginalize his presidency.
All these pundits and Dems Nadler comes to mind saying Trump will lie tonight in his address when he hasn’t even heard it yet.

William Douglas suffered a severe stroke yet insisted on participating on the court despite being obviously incapacitated. He finally gave in an retired almost a year later after the court deferred taking cases in which his vote might make a difference.

Douglas and Thurgood Marshall were probably trying to outlast Republican administrations, as both finally retired in the year prior to an election year. We got Stevens for Douglas anyway as it turned out, though Thomas for Marshall more than makes up for it.

Roberts diminishes the court and disrespects the people of this country by allowing RBG to participate from her sickbed.

We all know reading transcripts is nothing like being present for testimony, and if she doesn't have the capacity to appear in court, she most likely doesn't have the capacity to be making decisions.

I know she autovotes with the other gals 97 or 98% of the time, but still--if she can't drag her fanny in, she needs to recuse herself. And if she doesn't, Roberts should for her.

It was TOTALLY INAPPROPRIATE to take her vote three hours out from anesthesia for her procedure. There was no way on earth she was not under the influence of mind altering drugs still when she voted.

Lots of old people have measurable cognitive loss for weeks (many, months) post op/ hospitalization.

How long has it been since she's been nodding off any time after four pm? Years, right?

Looks like the "Remainers" whipped her in parliament:

...MPs who oppose leaving the European Union without an accord won a vote that created a new obstacle to a no-deal Brexit.

The 303 to 296 defeat means that the government needs explicit parliamentary approval to leave the EU without a deal before it can use certain powers relating to taxation law.

Beats the heck out of me what's going on over there.

I think even worse than that "failure to oversee FISA judges who report to him" was his active legislation from the bench with rewriting O'care so he could call it legal, which first, gave us the O'care weed which is going to take forever to pull out of the garden, but just as bad or maybe worse, signaled to every other judge in the land that rewriting laws so they can be upheld (or shot down) is just fine in John Robert's third branch of government.

Daddy, I mentioned that I got and read the 11th installment of Bernard Cornwell's Saxon tales which covers the fight to assemble Wales, East/West Anglia, Londeen and the rest of the southern end of the "big island" into the first use of "England" as a unified country...leaving the middle north area of Northumberland (Uthred's base of operation) for future tales, and the resolution of Ireland and Scotland both of whom were assimilating their own Viking settlements and still always fighting with those English heathens from their south.

My point is, looking at the century after century going on a full millenium of bloodshed it took to assemble the UK and then to keep it from French, Spanish and Germans all of whom wanted to eat their lunch time and time again...makes it truly remarkable that they caved to those same peoples now calling themselves the EU without a whimper and in much less time than a number of their wars took start to finish.

Truly remarkable.

And our Founders probably think the same about us, post WWII.

But permitting a vote from a hospital bed in NYC is beyond comprehension. So get sick and miss work, sure. Even get paid for that, fine. But you don't get to punch the clock as if you were really there.

I agree in principle, OL, but what is the law on this?

If Roberts can legally prevent her from voting on cases where she isn't present, then he certainly should. But I'm not sure that he can. Reading about William O. Douglas, it sounds like the best that the Court could do after his stroke was to simply defer cases where his vote would be consequential.

If some 39 year old justice was on bedrest for premature labor with a placenta previa and hospitalized for fetal monitoring and to be close to the c section room if she aburpted and started bleeding, AND had heard all the arguments before coming in and participated however they do post arguments and all, and it was just time to record the vote---that is one thing.

But an 85 year old ALREADY fuzzy thinker (apparently) pumped full of drugs to render her comatose to endure an endotracheal tube and having her chest opened and her lung resected, three hours post op---that is completely different.

People often don't even know what year it is three hours out from the OR, let alone what she'd be voting on.

Porch, WO Douglas was at physically least present at the court when they worried about those votes.

I have no idea what the written rules are and won't bother to look. But if she was allowed to vote while not in the room and under circumstances unknown to the other justices, then what would prevent any justice from voting on every matter from wherever they felt like being at each vote? Take Scalia out hunting at an important vote and hold a gun to his head until he phones in a vote contrary to his own wishes... And so on.

Porch, you are conflating the problem of an aging justice refusing to resign with the very different problem of allowing a justice to vote on a matter from a hospital bed in another city.

Sure, the CJ's hands are tied on the former, but there have probably been many instances where some justice would have liked to vote from someplace else for some reason of personal convenience.

Professor Garrow concluded that it will take an Amendment to the Constitution, imposing a mandatory retirement age on justices, to provide a solution. (The reason an amendment is necessary is that the Constitution guarantees Justices life tenure, in order to guarantee their independence.)

If the Congress flexed a little muscle, it could no doubt get the Supreme Court to voluntarily provide all justices' health information on a regular basis to a select joint committee of the House and Senate. Moreover, editorials urging that a particular Justice should resign might have some persuasive effect — for the justice would know from them that his or her remaining on the Court would tarnish its image.

Hope everyone enjoyed the holiday season. I got back from two weeks family vacation in Hawaii last night. The vacation was a blast but Clemson kicking Bama's ass last night ended the vacation on a sour note. I now know what it feels like to be a Tennessee Vols fan and that is not something I ever wanted to experience. Congrats to Clemson on their championship season. If Bama can't win then having a Bama alum winning the championship is the next best thing.

Ms. Veselnitskaya, a pivotal figure in the investigation into Russian interference in the presidential election, was charged by federal prosecutors in New York with seeking to thwart an earlier Justice Department investigation into money laundering that involved an influential Russian businessman and his investment firm.

The money-laundering case was not directly related to the Trump Tower meeting. But a federal indictment returned in Manhattan seemed to confirm that Ms. Veselnitskaya had deep ties to senior Russian government officials and rekindled questions about whether the Kremlin tried to use her as an intermediary to Donald J. Trump’s campaign.

Ms. Veselnitskaya, 43, is believed to be in Russia, according to the United States attorney’s office for the Southern District of New York

One third of the power We the People consented to lend to our government resides in the Judicial Branch under the control of a handful of unelected humans who serve for life. That right there is grounds for a good bit of concern and has been since the Founding. Adding to that two hundred years of debate is the secrecy in which the court operates. Slide a case through the mail slot and sometime later an answer will slide out under the door. In these days of warranted distrust and immense skepticism, this is not the time to fuel that fire by letting her vote while drugged out.

Will Television Networks Cut Away From Trump's Border Speech?

Media prognosticators and veterans don't think the networks will ditch the speech or fact-check errors or claims on-screen. The networks won't say if they will.

President Donald Trump is making his first Oval Office address on Tuesday night, and the nation's biggest broadcast and cable news networks have all decided to carry the speech, which the White House has promised will focus on immigration, border security and the government shutdown.

But, with a president known for his mendacity, will the networks take actions to counter any factual errors the president might make when arguing for his $5.7 billion border wall? If so, what would such an in-the-moment response even look like?

They're all in 'cause they know the border wall is popular. They should have just surrendered and got something for their precious dreamers.
