I had high hopes for a real eye-opener on taxing the rich, but it hinges in part on whether you think Bill Gates is even more knowledgeable on this topic than Alexandria Ocasio-Cortez:
For practical reasons, Bill and Melinda Gates don't want lawmakers to get bogged down in arguments about the top marginal rate, which is currently 37 percent. "If you focus on that, you're missing the picture," Bill said in a recent interview with The Verge.
"In terms of revenue collection, you wouldn't want to just focus on the ordinary income rate, because people who are wealthy have a rounding error of ordinary income," he said. "They have income that just is the value of their stock, which if they don't sell it, it doesn't show up as income at all, or if it shows up, it shows over in the capital gains side. So the ability of hedge fund people, various people — they aren't paying that ordinary income rate."
Instead, he suggested, we should be more progressive with "the estate tax and the tax on capital, the way the FICA and Social Security taxes work. We can be more progressive without really threatening income generation." That idea might find favor with Sen. Elizabeth Warren, who has floated the idea of a wealth tax on households worth more than $50 million.
I still say, above a high threshold impose mark-to-market accounting to end the eternal deferral of unrealized capital gains taxes. But to avoid forced sales to pay the bill (and to create a buffer account against possible future losses) allow payment of the taxes over ten years.
Mark-to-market accounting is already part of the tax code (eg, futures and index options, not to mention the charitable deduction for appreciated assets with a long term gain.) This idea side-steps the Constitutional puzzle of Warren's wealth tax.

Ah yes the Old Amtrak days...rather than trying to hop on the back of a train to get a thrill as a kid, I was now an adult traveling with husband & strangers to places I had not been to before ....It had to be one of my first trips from South Station so by the time we reached CT I was feeling bored but still anxious. I had also warned hub to just stick with a cold beer but no.. he didn’t listen. The rum & cokes soon warmed the cockles of this young heart. I glanced about the car seeing my fellow passengers reading, writing, or with headsets on, while my hubby started to snore ... then, suddenly, out of my throat came the spirit of Peggy Lee! As I started to sing a 3rd Sinatra tune I witnessed the magic spread from seat to seat, car to car. Many more voices started to chime in! Our Grand finale was NYNY. I can’t compare that experience to getting bus loads of people to squeal like pigs coming back from the Topsfield Fair but it sure made 4hrs on track a FUN ride.

Section 1256 [the tax section dealing with future contracts] is premised on the doctrine of constructive receipt because the taxpayer who trades futures contracts receives profits as matter of right daily. Id. at 157, 1981 U.S.C.C.A.N. at 256. Under this doctrine, "[i]ncome although not actually reduced to a taxpayer's possession is constructively received by him in the taxable year during which it is ... made available so that he may draw upon it at any time...." Treas.Reg. § 1.451-2(a) (as amended in 1979).

Because of the unique accounting method governing futures contracts, the gains inherent in them are properly treated as constructively received.
I can't agree with the first paragraph, even if it's part and parcel of prevailing law. Although a futures account reflects balance daily on current value of open contracts, it doesn't afford a greater access to those funds than a margined security account does - both balances allow the investor to borrow down to their maintenance margin levels.
Since it's an apt explanation of why securities accounts should not be treated as futures accounts, it's worth looking at WHY futures accounts are marked to market - I remember when they weren't. Back then, traders could use futures markets to ensure they paid little or no taxes on investment for a year by putting on a "tax straddle" sometime in mid-year and unwinding one side of it on the last trading day of the year and then, albeit with one day's of trading risk, close out the position on the first day of the year.
It worked like this. You're a metals trader and that's all you do - make short-term trades in gold and silver. But come August or September, you'll put on a huge straddle in some market you don't know a thing about, except that the market tends to take long, slow advances or declines in price. And you don't care which. So you buy 50 contracts of, say, next year's March soybean oil while selling 50 contracts of November soybean oil. The margin required to do such a trade is not large, as the position is effectively hedged by being both long and short. In the real non-Wall Street wise guy world, a trade like this is absolutely effective for farmers and processors to reduce risk in their business; for you, though, it's just a way to beat the tax man. So, on the last day of business for the year, you see that you're making $125k on your long May, and losing $138k on your November shorts - it's not even because the difference between delivery month prices will fluctuate due to various market positions. You buy in your Novembers and wipe out a good deal of your profit for the year, and on the first trading day in January you sell out the Mays. In this example the trader has lost roughly 13k, but he's happy to have his tax burdened reduced by much more than that; if the loss side was less than the gain side, it would have just been extra gravy.
So, the feds finally figured this out and made all futures positions marked-to-market. This is so, so, so much different than people holding long-term positions in stocks where they often don't intend to sell ever, leaving their dividend-paying stock to their spouse and/or kids. Trying to tax those gains (or allow deductions for those losses) year by year would be a nightmare, a disincentive to business in that a new and harsh tax system would need to be adhered to, and a general government asset grab (the kind conservatives particularly do not like).

Today it's cold, but sunny, as it was yesterday. (We didn't get that St. Louis snow, thank goodness.)
So, the mayor has 20 crews out doing cold-patch asphalt to potholes (or as the circles I grew up in, known as chuckholes).
This has been the worst year I can remember for these things. My son and I even know where some of the worst ones around here are, and he says things to me like "Don't forget about that big one over on 31 by the Kroger."
Even our poor little street, which doesn't get much traffic, requires weaving back and forth like a slalom skier to avoid them, and we probably won't get patches until late spring.

MM, the only thing I can think is that by declaring the emergency he takes a decisive action that will reassure the base. An "event" in other words. The alternative of just proceeding by moving appropriated money in the ordinary course of business will become background noise so he loses the sizzle.
I remain confused why he didn't veto and force an override (except for the chance that wouldn't occur fast enough to avoid a shutdown but that could have been helped by a one week CR "so we can read this thing...") My concern is that there will be 1,1067 places for litigation in those 1,107(?) pages of Dem Drafted Law, and as the case moves through the courts, the argument is going to be that a POTUS has EmO powers but only as limited by laws, and, your honor, just today the POTUS signed a new law which takes those powers away as to a wall because P.496, 603,797,1100..."
And signing it bothers some in the base so those worriers will, well, worry.

Those two threads posted by Narciso79 and myself seem to indicate that while there is a lot of smoke and noise about the emergency declaration, the other money from the DoD and other sources can be used and construction will continue.
Larry Schweikhart's source says that they cannot file a lawsuit until they actually use the EO money. I am not a lawyer so I am taking his word for it.
What I want to know is why the GOP isn't asking the democrats what possible excuse they have for blocking this. They should be put on the spot.
They know this is a national security issue, which is why they keep saying it's a made-up crisis. Crime statistics and welfare costs tell a different tale. I think they should be questioned repeatedly about this, because as I have said before, I am convinced the democrats are getting money to block Trump's actions, and it comes from the cartels and possibly Iran (LOTS of Middle Eastern people have been apprehended trying to sneak in).

Lurkersusie, part of the problem is no one should trust law enforcement— they are on their own side, not the victim’s side. (This is a simple matter of legal responsibility, not a condemnation of law enforcement per se).

Captain Hate, in this article the author says McCabe might be telling the truth about Rosenstein.
I wonder if there is stuff we don't know about which makes people think it might be true. I have no idea. My general impression of Rosenstein is that of a guy who sucks up to whoever is in charge. That may be unfair, but that's how I feel.

One of the reasons we don't tax unrealized gains is because they aren't static...and because they aren't and may never be realized.
How would the system work if one has to pay $1 million in taxes on unrealized gains on say your Sears stock. Thirty years later does the government owe you a check for $1miillion because your unrealized gain is now a realized and irretrievable loss?
And I'm not too clear on when this tax is triggered...or how often it's triggered. People's fortunes wax and wain, are they taxed one year but not the next? Is the tax a once in a lifetime event? It might function as an estate tax but don't we kind of already do that?
How bout instead we spend this energy forcing the Feds to live within their constitutional mandate which will result in a vast decrease in the need for taxes.

It seems unlikely to me that the president would not know definitively whether his deputy AG was involved in a coup attempt.
If that is true, and it is very difficult for me to imagine a situation in which it is not, it is also inconceivable to me that the deputy AG would still work for the guy he plotted to overthrow.
