henry,

I think the main reason for the discussion of tax rates is for the democrats to cause envy in the hearts of voters, who will be encouraged to think that raising the tax rates will take in money that will go directly into their pockets. This is what they always do.

Elizabeth Warren Apologizes to Cherokee Nation for DNA Test

Senator Elizabeth Warren, the Massachusetts Democrat who is running for her party’s presidential nomination, has apologized to the Cherokee Nation for her decision to take a DNA test to prove her Native American ancestry, a move that had angered some tribal leaders and ignited a significant political backlash.

The apology comes as Ms. Warren is set to formally kick off her presidential run this month after recent visits to early nominating states like Iowa, New Hampshire, and South Carolina. It also comes after repeated calls for her to apologize from tribal leaders, political operatives, and her own advisers, who said her October decision to take the DNA test gave undue credence to the controversial claim that race could be determined by blood — and politically, played into President Trump’s hands.

Any eminent domain lawsuit would be limited to the question of the price which the landowner ultimately gets paid for the land taken for government purposes. It would not prevent the taking itself. This is not Kelo (and even then the landowner lost the effort to prevent the taking).

Daniel Henninger in the WSJ argues that Trump should announce his support for a pathway for the Dreamers in the SOTU next week.

The vast majority are kids here through no fault of their own, and Henninger thinks it could cause the Democratic Party to implode. Trump has already repeatedly offered to work to solve the issue and he currently has @ 30-35% support in the Latino community, much higher that AA's. Putting that issue smack dab in Pelosi's face on national TV might cause her to have a seizure right on the spot.

Henninger argues that most of them are already American and that while there may be some blowback from the right, most of us would stay with Trump regardless.

The reason for asking the eminent domain question is because I have read the Democrats plan to file lawsuits against Trump if he tries to use DoD funding to pay for the border wall. I don't think upgrading obsolete fencing would fit the legal criteria of an eminent domain issue.

Tom M, dividends aren't clipped and the type of bonds that are (bearer bonds) are just about nonexistent at this point.

I'm unclear on the point when you discuss corporate perks; yes, the rich get richer and they perform various sleight of hand maneuvers at tax time to improve their lot even further. In terms of the outrages Americans can see all around them these days, it doesn't even rate. Further, the progressive tax code means the high-income earners pay a greater percentage of what they earn (not just more based on the fact that they earn more, at the same percentage). And, of course, we know that the top sliver of earners pays most of the taxes the government takes in.

To skew the soaking of the rich even further by asking holders of long-term stock positions to start paying tax on unrealized capital gains would not only be a minefield for taxpayers and accountants, it would be unfair, even to the very rich. Say you own 50,000 shares of ABC and 50,000 shares of XYZ, each position worth roughly the same. At the end of the year (say it's a year well past your original ten-year tax period for the stock), you find that ABC has gone up 20 percent and XYZ has declined 20 percent. If you pay your 15% cap gain on the increase of ABC, will the government just say "ah, don't bother, we're even because of your XYZ loss", will they let you amortize the loss going forward, or will they give you no break at all and just take tax in a year where your overall stock valuation does not increase?

If you did own those two stocks, you'd want to leave them tax-free to your spouse which is, thankfully, the way the law is right now.

I would guess there will also be environmental suits, and maybe even some sort of cockamamie civil rights suit. But eminent domain doesn't seem to be an obstacle, at least from a legal perspective.

Tom R

That will be a good question to ask when Mueller starts indicting Clinton supporters. So far, the indictments are only aimed at Trump supporters.

After seeing how the Obama administration targeted only conservatives, IMO it would have been extremely bad optics for Trump to go after Hillary and her supporters right off the bat. His campaign pledge to "lock her up" would be portrayed as a dictatorial move on his part.

Assuming Mueller were to one day start indicting Democrats involved with the Steele Dossier, the optics look much better from a impartiality perspective that his investigation indicted both Democrats and Republicans. A lot better chance of getting convictions that way.

It gets tiresome to always have to have CONCERN over the children of illegals.

How about we put AMERICAN citizens front & center for once.

No, Janet you are wrong to grant the progs superior concern over the children of illegals. What Obama unleashed was the largest Democrat human trafficking campaign since the slave trade was abolished. Before DACA, illegals who were parents left their children safely at home with relatives and sent money back to care for them. A few would get the kids here later after they had settled in and figured out how to bring them safely. But Obama turned children into objects, de facto entry visas and work visas, or, in the Spanish slang, a permisso. So parents have hauled their own children, or non-parents have grabbed street children or orphans, and dragged them on a dangerous journey because Obama and the Democrats have lured them into trading children for legal status.

This is utterly despicable. Some children have died along the way. Many, many more have witnessed unspeakable horrors. Little girls have been raped. Children have watched their mothers get raped, or watched them trade sex for safe passage from corrupt officials and cartel gangsters. They've seen people fall from train cars or trucks and get crushed. They've seen people left to die in the desert after an infected cut or sprained ankle rendered them unable to continue on. They've been robbed by gangsters, and watched, terrified, as people got killed for not turning over their valuables fast enough. Almost the entire Mexican side of the border is controlled by various cartels, who think nothing of torturing and killing completely innocent men, women and children for being relatives of rival gang members, or having the wrong name, or simply as a way to terrorize others.

The Democrats tell us to think of the CHILDREN... Ok, fine, I'm thinking of the children, and I'm thinking that the Democrats are despicable people doing horrific things to these children.

Extraneus

Thanks, Janet. I didn't know that.
