The Times reports on decisions at the DoJ to decline to defend two laws. One is the Affordable Care Act. The other, which apparently has experts divided, involves a technical dispute (what makes this a Federal and not state-level offense? See BACKGROUND below.) about a 1996 ban on female genital mutilation (hard to feel the political wind blowing from the right in favor of overturning that ban, inspired by immigrant behavior, but here we are...)
Sparking my ire is this ahistorical diatribe, my emphasis:
While there are important differences between the two cases — Republicans have attacked the Affordable Care Act in the courts for years, while legal experts are debating whether the circumcision law is defensible — critics were troubled by what they fear is an emerging view inside the Justice Department that it is up to the Trump administration, not members of Congress, to decide whether a law has merit and should be enforced.
“Imagine a world where an administration of one party passes a law and then a different president effectively invalidates it by having the Justice Department refuse to defend it in court,” said Joshua Geltzer, the executive director of the Institute for Constitutional Advocacy and Protection at Georgetown Law School.
“You want elected lawmakers to draft laws, not lawyers at the Justice Department,” Mr. Geltzer said.
Wow, to imagine that I'd have to imagine a President explaining he can't act until Congress changes the current law and then imagine that same President reversing himself after the legislative effort stalls and unilaterally instructing the DoJ to simply exercise its prosecutorial discretion and decline to enforce the law. Unthinkable!
Or if that memory is too raw, what about that other Clinton legacy project, the Defense of Marriage Act? The DoJ cut that loose as well in response to a shift in the political winds, that time from the left.
For the Times to pretend even for a second that this is a new problem under Trump is absurd.
BACKGROUND on female genital mutilation issue:
In drafting that law, Congress relied on its power to regulate interstate commerce. Lawmakers had increasingly used that authority to overcome the fact that they cannot simply make local crimes federal matters, no matter how evil, unless they violate some federal power that Congress wields.
“For this to work, Congress has to show that there is some connection between the criminal conduct and interstate commerce,” said Mr. Dellinger, now a partner at the O’Melveny & Myers law firm.
But in 2000, four years after the female circumcision law was enacted, the Supreme Court examined Congress’s use of the Interstate Commerce Act in drafting the Violence Against Women Act. In that case, United States v. Morrison, the government lost in part because the court had greatly narrowed Congress’s ability to use its power over interstate commerce to draft criminal laws.
Last year, in the first court case involving the genital mutilation law, the judge in Michigan cited the Morrison case to rule that Congress had failed to clearly draw a connection between interstate commerce and the practice of female genital mutilation.
In his letter to Ms. Feinstein, Mr. Francisco sent a list of possible changes to the law to strengthen the connection with interstate commerce and keep the ban on female circumcisions in place, like outlawing the use of the banking or telecommunications systems to perform the act.
“Essentially, the Justice Department is urging Congress to fix the law before a case gets to the Supreme Court, where there is a good chance it would be struck down,” Mr. Dellinger said, adding that the government’s action in this case was appropriate. “The constitutional fix is relatively straightforward, and should be uncontroversial.
Nothing is uncontroversial. This will be portrayed by some nutter somewhere as an attempt to attack immigrants and embarrass Ilhan Omar.

As we now know, in sworn testimony given in the United Kingdom, not even Christopher Steele would vouch for the dossier's accuracy. And equally damaging, in testimony before Congress, FBI lawyer Lisa Page stated that, contrary to standard FBI procedure in counterintelligence operations, the Trump campaign, purportedly the target of Russian infiltration, had not been warned of the Kremlin's nefarious efforts because the FBI did not deem the Steele dossier reliable enough to compel such a warning.
Page's testimony sets up an irresistible line of inquiry. If the dossier was not reliable enough to justify a warning to Trump's campaign about the Kremlin's plot, how could it even remotely serve as the basis for obtaining FISA warrants to spy on the campaign? By her benighted testimony, Page has framed the issue nicely and invited a full vetting of who, what, where, when, why, and how the dossier was used to dupe the FISA court.

Buckeye – I feel for you. I had pretty severe sciatica last year. It developed in March and finally resolved in May. During that time, I couldn’t stand up or walk more than a couple of minutes until the pain on my left side became unbearable from my hip down to my feet. I slept on my right side on the couch. I was working remote in a double wide temp office about 4 hour drive away and fortunately, sitting and driving created no significant pain. I managed to walk from my temp quarters to my vehicle, drive, walk into my office, and function. Same think for the trips home.
After 1) waiting (give it a week and see what happens) 2)Chiropractor, 3) therapy, 4) silicone shots, 5) the back surgeon rescued me. Much prayer from numerous friends - family also involved. I had a bulging disk and spinal bone spur that were challenging the sciatic nerve for the left side. I was walking around the block within 2 days after surgery. I have mild sensation in either my thigh, calf or hip most of the time, but I will NOT complain as I experienced what real pain was about for a little over 3 months.
So the message from here is don’t give up. Continue to pray and find the right medical formula to put this in the rear view mirror.

To those unfamiliar, I am a Lurker from the Libby days back for my bimonthly contribution. Still working full time (semi-retirement is in the not too distant future) so it is hard for me to stay current on comments to be able to make any real-time contribution. Try to read at least 200 comments on each blog, but usually stay a day or so behind. I find this site provides great current insight on what is happening. Lucianne is my other daily go-to. These pretty much keep me familiar and educated with (national) current events. Mrs. Sidwhite is impressed by my knowledgeable discussions when TV news is a day or two late to discover significant events.

Yes Buckeye. My boss and I had discussion in September when the TDY in San Antonio was coming to a close. I would reduce workload just enough to hold on to employee benefits by the end or 18. That's been moved out a couple of months a few times and I expect we will be nearing '20 when it happens. Starting 2 month TDY in Plano north of Dallas next week. Oh well, golf and fishing next year.

So a hot shot college football coach holds up his college by threatening to go work in the NFL for big bucks unless the college matches the ginormous pay.
Since there are only "a few" NFL coaching slots and they are all filled, but there are hundreds if not more college coaches playing the scam, perhaps the colleges should just say "sorry", this is all we pay coaches and make the scale similar to a professor level pay...
The best coaches are always going to want to coach the best teams, nobody is leaving 'Bama for HicksVille U, so what's the risk?

He lost the first one in the hurricane a couple of years ago, but he is going great guns now. Been there about 4 years and I have only been down to wet a hook once! As you know,Lewiston,Maine has a large Somali population. Any "incidents" are seldom reported by the Maine media,but last June they had no choice. A (white) man was killed during a brawl at a Lewiston park. The police have arrested three suspects,including a 13 year old. The brawl was some sort of turf battle about who "owns" the park. At the time,witnesses told police a gang of 30 Somalis and Congolese attacked a group of white people. The police did a very thorough investigation,including a search warrant for a videotape of the brawl. One of the men arrested is now 18,so his name has been released. Emmanuel Knurunziza has been charged with manslaughter after telling police he threw a rock that caused the blunt force trauma that killed the man. The other suspects are charged with simple assault for stomping on the man and causing other serious injuries. The man's (Donald Giusti) family aren't happy with the simple assault charges. To their credit,the family sound like decent people and have held vigils with the Somali community. Law enforcement obviously walked on eggshells during the investigation. The man arrested for manslaughter was found 300 miles north of Lewiston in a northern Maine town. He's been wandering around the state for 10 months. Another interesting fact is that an interpreter translated English into Lingala (a Bantu language) during his court appearance. How long has he been here? Did he attend school?
Are officials "allowing" certain groups to claim turf and turning a blind eye? If this is happening in Maine,I can't imagine the issues in larger cities.

Those are player badges, caro. Each invitee gets one and it's usually worn on a hat or belt. They change each year and are quite coveted by collectors.
The tee markers are pine limbs cut to shape. It's a cheap and easy method of manufacture, and they're still used by quite a few clubs.

It's been a whole six days since I got back from our trip to Italy and I am finally starting to feel normal. Work this week was a bear. I don't know how people who travel a lot cope with jet lag. Last night Mrs. and I sat down to watch a BBC mystery and both fell asleep without ever finding out who dunnit.
Also came back to find out that this year's Yankees really stink. The management is blaming it on injuries but it is really a poorly put together team with a questionable manager and pitching coach. Oh well, it's too nice a day to be inside.

They just showed Jack:The Masters on CBS before the telecast coming up now. In it they chronicled his history of winning 6 of them including the famous 1986 one. But they showed at the end, the par 3 contest a few years back where his grandson caddied for him and made a hole-in-one on the 9th hole.
When the ESPN guy asked Nicklaus his most memorable moment he has ever had at the Masters, Jack just point to the 9th hole. That is true grandfather.

Usually a combination of really want to do and must do give you a sense of accomplishment.
Last night we attended what will be one of the last high school rugby games my nephew will play in.
He will also play in college next year but the sheer joy on his face as he lifted players up to capture or hunkered down in a scrum was wonderful to witness.
Many of my brother-in-law’s closest friends were there from high school were there to cheer on his son.It was a multi-generational celebration.

Hard to believe a Samoan Morman, Tony Finau has a chance to set a new course record and finish at the top on Saturday. But he is a player. Saw him at Shinnecock, a great game tee to green.
