The "pull quote" concerning the Obstruction dodge was Comey saying "The whole purpose of the SC law was to insulate the political leaders from having to make hard prosecution decisions so that The People can have confidence..."

I thought it was to facilitate the investigation of areas that could not be done by the investigated departments because of their inherent conflicts of interest. But since the SC by the law serves at the pleasure of the AG and therefore the AG's boss, there was never an intention of setting the SC up as an 4th branch of government unguided missile, and if the "problem" is the AG or his boss, then the recourse is for Congress to impeach either of them.

Comey's construction simply puts the notion that the entire Justice Department not being under the Executive on steroids, it seems to me.

My man, that will never *ever* pass muster when a voter, any voter, in an affected state pushing that proposal sues.

Our system involves indirect election as a *fundamental* part of our checks and balances. You can't by compact effectively make it a direct election, majority rule system.

I don't see how it's unconstitutional, CH. US Const. Article II, Section 1, Clause 2 provides that state legislatures determine how electors are chosen. It seems to me that choosing electors who covenant to vote in accordance with the national popular vote is well within a state legislature's power under the US Constitution. A subsequent state legislature would not be bound by this procedure. Am I missing something here?

CH, if the state's voters elect a legislature that awards the electors to the popular vote winner, that's representing the state's voters. The state's voters can throw out the state legislators who vote for that system in the next election.

RG, if you want to look at it as individual votes, looking at it from a national perspective, the electoral college itself dilutes individual votes. For example, in 2016, the importance of a Trump voter's vote in Michigan was more important than a Clinton voter's vote in California. Which individual votes it dilutes may vary from election to election.

Where do inalienable rights come from, RG? Accordingly to the Declaration, Nature's God. But to secure those rights, we enter into these government arrangements that are full of compromises. The electoral college is one of them.

On the state level, a state that was worried about diluting votes would award electors proportionately. I don't think any state abides by strict proportionality (my recollection is that Nebraska and Maine award two electors apiece to the overall popular vote winner).

In any event, I think this proposal could hurt Dems. Do voters really want to cede their electoral votes to the popular vote winner? To me, on the level of each state, it's a policy argument.

As to a challenge, I think the appropriate challenge would be in Congress. That is, Congress could be petitioned not to certify the winner if the winning electoral votes came from states with the system of awarding electors to the nationwide popular vote winner. I don't think this is an area in which a federal court should intervene.

See, TK, you're not the only one who disagrees with me on how the US Constitution should be interpreted in selecting our POTUSes! :-))
