MURDER????

Narciso79

Ah ben crump, should have known, can abc be bothered to say whether its first or second degree

Narciso79

But they dont make it clear by saying 5 to 99 years

The whore was busy sexting a married man as she wandered down the wrong floor of her apartment building. Joe Innocent was watching tv and eating ice cream when the unqualified LEO burst into his home "shouting commands."

He died as a result of her not having a clue how to interact with a suspect. She should have never been on the force.

As I understand Texas law their threshold between murder and manslaughter is the word reckless. If she was celebrating the soon to be wrecked marriage of her adultering lover and started a wild-west shoot to the heavens celebration, and the errant round found its way through the wall and into Joe Innocent's skull, he would havd lost his future due to her recklessness. Manslaughter.

If she points a weapon at him and uses deadly force intentionally it is murder.

She intentionally shot him, there is no question of that.

Manslaughter isn't a possible sympathetic alternative by law, despite her lack of tears on her fake crying face.

She can spend eternity in jail, if that is the sentence, and I, unlike Dead Joe Innocent, will sleep like a baby. Dead Joe, on the other hand, will not know anything about her fate.

IOW, fuck her.

GUS

I sat on a jury for a murder case. I was 22 years old. Dude was drinking at a bar that I actually frequented near my parents home. He worked at the chicken and pizza place 5 or so blocks from my home.
He was goofy and he shot at a couple of cars, hitting one, as they drove past the park and golf course I played on and once worked at. He shot at a jogger at the same park. All this at 6am, all this for NO REASON, other than he was a unloved punk. He then hid in the woods on the Menomonee River Parkway, the very street my older brother lives on now. He shot an old woman 76 year old Grandma, Gladys Redlich. I saw the autopsy photos. A 30/30 with a scope.
THAT is MURDER. He got life plus 30.
In Wisconsin, first degree murder used to average 13 years behind bars. Intent matters. But this cop in Dallas needs to do time.

Whoa! Is this all in the transcripts that the jury had?

hrtshpdbox

Sounds like an awful cop, alright, and very poorly trained. The pertinent local law prevails, of course, but I thought premeditation was usually part of murder. This (awful) cop ostensibly thought she was being burgled (and she's on the wrong floor? Wow, she's dumb), so it's "an accident" in a way, and murder is never an accident.

hrtshpdbox

No, CH, that's part of Adam Schiff's dramatization of it. Heh, just kidding, I don't know much about this particular case at all.

hrtshpdbox

From my one experience with it, I'd say jurors are not particularly....anything (smart, thorough, high-minded, virtuous), and anything is possible once you hand the keys to justice over to nine of them.

Prosecutors say it’s telling that Guyger and her patrol partner deleted the text messages they exchanged that night on the day after the shooting.

Those messages have been recovered.

Corporal Rivera then testified about the racy text messages.

Prosecutor Jason Hermus: “Would you send provocative photographs of yourself to Amber Guyger?”

Corporal Rivera: “Uh, yes.”

One text from Guyger read, “Wanna touch?” around 9:30 the night of the deadly shooting.

At 10:02 p.m., Rivera received a text from Guyger, “I need you. Hurry.”

At 10:03 p.m., Guyger texted Rivera, “I *ucked up.”

Prosecutor said Guyger typed those last messages while she was on the phone with 911 saying she’s shot Jean.

Box,

By the time the Mohammed Noor trial was over I was convinced that he should have never been on the police force and there was no way his superiors didn't understand that as well. Good luck figuring out a way to implement that without running afoul of multiple discrimination laws.

Threadkiller

The whore's sex-mate lied on the stand, IMO:

Senior Corporal Rivera was on the phone with Guyger three minutes before the shooting and he said on the witness stand they were talking about work.

“To the best of my recollection I remember asking about the suspects to see if they ever confessed and I really don’t remember a whole lot about the conversation,” Rivera said.

He should lose his job and pension.

CH, imagine if, in general, police departments have been degraded as much as the FBI has been degraded. If true, the citizenry would never want to call them for assistance, and would avoid them on the streets.

Capn, I got a professional e-mail yesterday from someone who does PROFESSIONAL work for one of my biggest clients. She seems to be capable, but does not seem to understand that you EARN your business and your clients trust by acting in THE CLIENTS BEST INTERESTS. At any rate, she was responding to an e-mail from me and a colleague at our company, in which we provided her with architectural drawings that she could use to further HER CLIENTS ability to LEASE from OUR CLIENT. She works for our client sometimes too,
Anyway, on her electronic signature sign off, she states that she is a DISADVANTED BUSINESS by virtue of being FEMALE, and she has been funded by the SMALL BIZ ADMIN as SUCH.

Spurs look lackluster. I am a big Harry Kane fan, but, he's a center forward striker. He needs help.
Son, the Korean, is quite good.
Lewandowski, is the last guy you want using his feet inside the box. Well Lewandowski and Mo Salah. Quick feet, STRIKE, like a rattle snake.

Gentlejim

I haven’t followed the case much so I have no opinion as to guilty or not. Murder does seem a bit of an overcharge if the “oops, wrong apartment” is accurate. Maybe Voluntary or Reckless. Different states have different elements of crimes. Box is correct that juries are strange animals as I’m sure Clarice and Jane can attest.

James D.

By the time the Mohammed Noor trial was over I was convinced that he should have never been on the police force and there was no way his superiors didn't understand that as well.

I think there are probably a lot of people on the police force who shouldn't be on them (starting with the people at the top, most likely), and the training doesn't help.

GUS

Gentlejim, I completely understand TK and A-Bob and others, who are sick and tired of criminality or behavior being 2 or more standards. However, the fact is, this Officer, made a MISTAKE, that led to a disaster and a death. The criminal culpability should reflect the circumstances. She had no criminal intent. SHE HAD NO CRIMINAL INTENT.
So someone who DOES have CRIMINAL INTENT should be viewed and punished differently. I THINK?!?!?
You know a little about me G-JIM, and I am ABSOLUTELY PRO-BLUE. Both of my BELOVED "little" brothers are LEO's. As you know and LIVE, being a COP is tough and is a BIG responsibility, but intent matters.

Jane

GentleJim,

The jury wasn't out long. Less than a day. My guess the case was heard in an "I hate cops" neighborhood.

I watched her testimony. No excuses, nothing but tears and sympathy for his family. She was well aware of the devastation she caused with no intention to cause it.They might as well have given her the death penalty. It would have been easier on her.

GUS

The DALLAS COP and the IMPEACHMENT TRAIN, have a common denominator.
If the COP in DALLAS is guilty of a crime which is has a penalty of up to 99 years, then we are judging her conduct as equal to or worse than many many many HEINOUS EVIL people. And if the SNOWFLAKES who believe they are special and need to save the WORLD, think TRUMP is horrid and evil.....
HOW DO THEY JUDGE SOMEONE WHO ACTUALLY IS????

Jack is Back!

Well, Michael Connolly has made millions off of the trials, tribulations and inco mpentancy of the LA Police Department especially the top echelon. And I can't him just imagining all that. HIs Harry Bosch series is a must read for any one interested in the inner workings of a dedicated police officer/detective and his internal police obstacles.

clarice

Jane, Texas apparently doesn't require intent. It does seem at variance with most of the murder statutes I've seen.

As for FNC..only about 1.5% of the people even watch TV news and of that number even less watch them.

It's like bitching about the numbskulls on The View.

Should her mistake get her more or less years that Noor's mistake?

Jane @ 4:08

She may have had no intention to cause the victim's death, but she also had no intention to act carefully or to take seriously the responsibility and power she was given.

Frankly, I'd like to see the people who trained and supervised her face some liability, too (just as in the Noor case). If they thought she was competent to be given a gun and set loose on the streets with the power of the state behind her, then they ought to pay a price, too.

Clarice,

Did you see that tweet about TV viewership: The top watched show on TV is "The Masked Singer" at 2/12 percent of the viewing audience (people with TV's) and all news programs are a finite fraction of that. This idea that the American public are all up in arms about impeachment is ridiculous.

GUS

Tk, that's a very good question. I think a lot of our opinions are based on our viewpoint of the officers involved, and whether they were/are worthy of being a cop in the first place.
Being a SOMALI immigrant is not a reason to DISALLOW someone to become a LEO, but, the notion of SOCIAL JUSTICE and AFFIRMATIVE action, blur the line between COMPETENCE and PREFERENCE.

I did, JiB. That was the basis for my post.

So, in a few days, Frederick as a V Former (Junior) has a chance to meet with 50 universities at College night at Canterbury. Poor kid is undecided about engineering or biochem/biomedical. I told him to pick out the top 5 you want to talk too since it is only an hour.

I really feel for him, how can a 16 year old kid in his Sophmore year even understand what the world can be in 2 years? I was lucky, I was an offspring of a senior USAF officer and chose a ROTC university that had a program I thought would fit me. But how do kids in their sophmore year make those decisions?

Any experience is helpful.

Captain Hate

"Everyone keeps saying it's a "sudden avalanche". I don't see it. I see a steadily increasing continuum all the way back as far as I can look - to Reagan. I can remember back to Reagan.

The Reagan years were the first indication of a Uniparty and a Deep State. Reagan caught opposition from both sides. Bush continued that - and Globalism started to creep in as well as the first open indications of a Political Class. Clinton ramped up Federal Intervention. "W" expanded the Police State. Obama simply turned everything up to 11 and initiated Public Unrest as a strategy for change. And Trump, being the first Outsider and even more of a black sheep than Reagan, has seen all the previous turned against him.

I don't see a seminal moment - I see an increase of all these two leading to this moment in time. I don't think there is a "trigger". Just more winning tactics from the Left and their Establishment Right Frenemies.

GUS, she intended to kill him, in that this wasn’t accidental. She did not premeditate to kill him. But none of that matters because nobody says she did.

This was criminal negligence. My understanding is if there are aggravating factors a manslaughter charge can be upgraded to murder. That’s apparently what happened here.

Jack, I've thought about your wonderful son Frederick, as I've heard about his maturation the last couple years. I wish him the best, and I'm sure that regardless of which school he chooses, he will be a winner, a great student, and be a fantastic MAN at the end of it all.
I'm just a regular guy from Wisconsin, and I have only one child/offspring. My son is VERY well rounded. His victories, stumbles, injuries, and achievements, are HIS. Mrs Gus guided him with love, faith, religion, kindness and UNCONDITIONAL LOVE at EVERY STEP OF THE WAY. She is wonderful.
I loved my boy more than I could have ever imagined loving ANYTHING. The LORD gave me a certain wisdom, to know how to be a FATHER, and the disciplinarian, as well as a loving MAN that he could always count on and lean on. Most of his upbringing, I would HAVE to be the BAD COP, when necessary. That hurt, because, I had to be tough, when I wanted to be gentle. My boy will be a success, because the foundation of his life, has been about, FAITH, LOVE, GOD, and always giving of himself to others, without expectation of anything. I pray for Frederick, but JACK.....YOUR BOY, will make you proud.
CUT HIM LOOSE BROTHER

hrtshpdbox

She did not premeditate to kill him. But none of that matters because nobody says she did.

So not first degree murder, then? Wiki says first degree is "any intentional murder that is willful and premeditated with malice aforethought" Second degree murder, they opine, is not premeditated.
https://en.wikipedia.org/wiki/Murder_(United_States_law)
Sure, I know, wiki. But it seems to me there must be some kind of difference between planning and executing a cold-blooded killing, and mistakenly thinking you're outside your apartment and shooting at what you perceive to be burglars. Cop or not has nothing to do with it.

jimmyk

I don’t know the law enough to say exactly what the right charge should be. I think definitions and laws vary by state. But certainly not first degree murder, as it wasn’t premeditated. One could argue that she showed reckless disregard for life, which I believe sometimes can raise a charge from manslaughter to murder. The fact that she’s a cop, who should know better, and was sexting, makes it look worse for her. And weren’t drugs or alcohol involved? I’d say she ends up with something like 10-20 years.

James D.

Great question, Henry!

I’d ban family of any federal office holders or appointees from doing business with any foreign companies, period. And from lobbying, or working for any company that has any federal contracts.

JiB,

Poor kid is undecided about engineering or biochem/biomedical.

I think you worry about this too much. The first year for any of these is very similar, and usually declaring a major is not required. It may make a difference on the school (Eng. vs Liberal Arts), but usually transferring is easy. So is changing a major, if that is necessary.

I'd suggest choosing a solid school where both of you are comfortable with the academics and the culture.
