I thought she was far too quick on the trigger. She stood in or near the outer apartment hallway shooting at shadows inside what she mistakenly believed to be her apartment. She had no family or friends inside that might be in danger. Step into the hall, count to ten, and get backup.

As I understand Texas law their threshold between murder and manslaughter is the word reckless. If she was celebrating the soon to be wrecked marriage of her adultering lover and started a wild-west shoot to the heavens celebration, and the errant round found its way through the wall and into Joe Innocent's skull, he would havd lost his future due to her recklessness. Manslaughter.
If she points a weapon at him and uses deadly force intentionally it is murder.
She intentionally shot him, there is no question of that.
Manslaughter isn't a possible sympathetic alternative by law, despite her lack of tears on her fake crying face.
She can spend eternity in jail, if that is the sentence, and I, unlike Dead Joe Innocent, will sleep like a baby. Dead Joe, on the other hand, will not know anything about her fate.

I sat on a jury for a murder case. I was 22 years old. Dude was drinking at a bar that I actually frequented near my parents home. He worked at the chicken and pizza place 5 or so blocks from my home.
He was goofy and he shot at a couple of cars, hitting one, as they drove past the park and golf course I played on and once worked at. He shot at a jogger at the same park. All this at 6am, all this for NO REASON, other than he was a unloved punk. He then hid in the woods on the Menomonee River Parkway, the very street my older brother lives on now. He shot an old woman 76 year old Grandma, Gladys Redlich. I saw the autopsy photos. A 30/30 with a scope.
THAT is MURDER. He got life plus 30.
In Wisconsin, first degree murder used to average 13 years behind bars. Intent matters. But this cop in Dallas needs to do time.

Sounds like an awful cop, alright, and very poorly trained. The pertinent local law prevails, of course, but I thought premeditation was usually part of murder. This (awful) cop ostensibly thought she was being burgled (and she's on the wrong floor? Wow, she's dumb), so it's "an accident" in a way, and murder is never an accident.

I haven’t followed the case much so I have no opinion as to guilty or not. Murder does seem a bit of an overcharge if the “oops, wrong apartment” is accurate. Maybe Voluntary or Reckless. Different states have different elements of crimes. Box is correct that juries are strange animals as I’m sure Clarice and Jane can attest.

I watched her testimony. No excuses, nothing but tears and sympathy for his family. She was well aware of the devastation she caused with no intention to cause it.They might as well have given her the death penalty. It would have been easier on her.

So, in a few days, Frederick as a V Former (Junior) has a chance to meet with 50 universities at College night at Canterbury. Poor kid is undecided about engineering or biochem/biomedical. I told him to pick out the top 5 you want to talk too since it is only an hour.
I really feel for him, how can a 16 year old kid in his Sophmore year even understand what the world can be in 2 years? I was lucky, I was an offspring of a senior USAF officer and chose a ROTC university that had a program I thought would fit me. But how do kids in their sophmore year make those decisions?
Any experience is helpful.

This was criminal negligence. My understanding is if there are aggravating factors a manslaughter charge can be upgraded to murder. That’s apparently what happened here.

Jack, I've thought about your wonderful son Frederick, as I've heard about his maturation the last couple years. I wish him the best, and I'm sure that regardless of which school he chooses, he will be a winner, a great student, and be a fantastic MAN at the end of it all.

I don’t know the law enough to say exactly what the right charge should be. I think definitions and laws vary by state. But certainly not first degree murder, as it wasn’t premeditated. One could argue that she showed reckless disregard for life, which I believe sometimes can raise a charge from manslaughter to murder. The fact that she’s a cop, who should know better, and was sexting, makes it look worse for her. And weren’t drugs or alcohol involved? I’d say she ends up with something like 10-20 years.

I think you worry about this too much. The first year for any of these is very similar, and usually declaring a major is not required. It may make a difference on the school (Eng. vs Liberal Arts), but usually transferring is easy. So is changing a major, if that is necessary.
I'd suggest choosing a solid school where both of you are comfortable with the academics and the culture.

Jack,it has been over 20 years since the daughter looked at colleges and everything has changed. We did the New England college tour and she just knew that the college she decided on (Saint Anselm) was *the* one. This was before St. A's had established the NHIOP. (Mamas don't let your babies grow up to be lobbyists,ha) She applied the fall of her senior year and was accepted before Christmas. My only advice would be to trust Frederick's instincts.

State by state, statutes define what the legal term MURDER or RAPE or ASSAULT means.
The passion and reasoned thoughts of many of JOMers' illustrates that, IDEOLOGY or POLITICAL agenda, does not CHANGE the pain and suffering of VICTIMS, nor does the STATUS, RACE, or GENDER of the alleged PERP, change the result of the INCIDENT.

Marlene, I agree with you. My visceral, and experienced, considered opinion vis a vis my CHILDS' College decisions, is that......IF THE UNIVERISTY or COLLEGE, is selling ......TOUCHY FEELY non-definable...BULL SHIT... as THEIR #1 Reason to go there to LEARN........They are bat shit crazy.
Btw. Profs, and/or the multitudes of ADMINISTRATIVE Bureaucrats.....WITH BEARDS....is a TIP OFF....too.
