I simply do not know--I think the admission by the head of the Bucca Camp that it was in 2009 was reliable and any backtracking later to Obama's credit suspect.

I haven't read the allegations, but It sounds to me like the judge is setting Phillips up to take the fall and letting the WaPo off the hook. I assume his decision will also affect the parameters of what can and cannot be asked in discovery, so I'm not holding my breath for those results.
Perhaps one of our JOM lawyers can opine on whether or not he has actually made it more difficult for Sandman to win much of anything from the WaPo. Phillips has obviously not got any pockets at all, but can you appeal this new ruling further up in the hope of reinstating any of the allegations against the WaPo itself? Seems to me the judge has effectively neutered the whole case.

The discovery phase could be interesting. When did the WaPo know that it's original reporting was wrong? I can't remember what they did, but a retraction and apology would be better than a, "We stand by our sources."

Jim, a poster on FB has pointed out that while the 2009 release was reported in the Daily Mail and Daily Beast, Baghdadi may have been released in 2004, the military having later said the initial report was an error based on a mix up of names. I simply do not know--I think the admission by the head of the Bucca Camp that it was in 2009 was reliable and any backtracking later to Obama's credit suspect.

I haven't read the allegations, but It sounds to me like the judge is setting Phillips up to take the fall and letting the WaPo off the hook. I assume his decision will also affect the parameters of what can and cannot be asked in discovery, so I'm not holding my breath for those results.
Perhaps one of our JOM lawyers can opine on whether or not he has actually made it more difficult for Sandman to win much of anything from the WaPo. Phillips has obviously not got any pockets at all, but can you appeal this new ruling further up in the hope of reinstating any of the allegations against the WaPo itself? Seems to me the judge has effectively neutered the whole case.

Perhaps Barr knows what is going on while the pundits do not? Wray wasn't in charge of the FBI when they set up Flynn. Wray was also technically correct when he said the FBI doesn't spy on anyone. When you have a legal search warrant to conduct surveillance against a criminal suspect that is not "spying". Pundits like Jim Hoft and Sundance tried to mislead people into believing Wray contradicted Trump when in reality he just explained what the FBI did when they adhered to legal law enforcement processes.
