Do you agree with the Insanity defense?

If mens rea is an element of a crime (there are some crimes that are strict liability, so I assume the insanity defense wouldn't be applicable in those regardless), then it seems like if there is no insanity defense, then an honest jury would have to acquit someone if they could be shown to not have the capability to understand their actions/tell right from wrong.

I'd say the insanity defense is actually a protection for the state, because it gives the option to still lock someone up and protect innocent people from them, whereas without it, if the jury agrees that they aren't mentally competent, they just go free and go back out on the streets.

Among the other revelations in 'Deep State' is that former deputy attorney general Rod Rosenstein had the support of two cabinet colleagues for invoking the 25th Amendment to remove Trump from office.

Stewart claims that it was former chief of staff John Kelly and former Attorney General Jeff Sessions who said they might back it.

Stewart claims that Rosenstein was so concerned about Trump that he twice offered to McCabe to wear a wire to record Trump, not once as previously reported.

McCabe was stunned and when he got back to his colleagues he told them: 'You're not going to believe this'.

That seems like an awful burden to put on a jury. I really think there should be an insanity defense, which a jury can choose or not.

James D, browsers which convert text to spoken words do exist for sight impaired web access. I assume some standardized meta data beneath icons would help. (Instead of a naked PayPal logo or something). Seems less of a hassle than complying with Cal Data Protection (requires California specific pages of the entire site isn’t Cal spec). I guess all those woke SJW marketing design firms need to go to re-education camps and lurn 2 koad or something.

Note, I don’t know is my own UX standard is compatible with sight impaired use, the issue hasn’t come up. I do know of sight impaired users though, I assume they would tell us if we screwed that up.

I heard a discussion of that case. Dominos website is actually quite blind-friendly. You click a few options and the info is read out not just displayed.

But there were a couple pages that fell short. I forget the details but it was something like the page was a photo and there was no verbal description of the photo. Anyway it sounded like a lawyer wanting to make a buck not bad faith on the part of the pizza company

I think making large commercial websites more accessible to blind (or otherwise disabled) people is a good thing.

I think this case is more about making the lawyers rich, and the ultimate effect of a decision against Dominos will hurt millions of small businesses who will have to spend thousands or tens of thousands of dollars to make their websites fully ADA-compliant or face ruinous lawsuits, while ion the end Dominos and other huge companies will be able to eat those costs without much problem.

Like 99% of these things, the end solution won't help the people who actually need it, and it will actively hurt a lot of people who were doing nothing wrong except trying to run their own business, and it will enrich consultants, big law firms and government bureaucrats.

James, the problem may not be the court but the ADA. If Congress is going to pass ridiculous open-ended laws like that, I'm not sure we can expect the SC to declare them unconstitutional. It does sound like the plaintiff is just a PITA agent for ambulance-chasing lawyers.

A true conservative court WOULD overturn open-ended laws like the ADA.

And it would state in the decision that while the goals of the law are good and the court agrees with them, good intentions are not enough when writing legislation, so Congress needs to go back to the drawing board, take some remedial classes in logic and reading comprehension and writing, re-read the Constitution a few times, and try again.

Why do you think not hearing the Domino's case is bad? A blind person is suing because he has no access to the website. There is no law that says they have to have access for the blind. It's an issue for Congress, not the court.
