The FISA court is in a tough spot. They only know what the government tells them. There is no adversary party to point out the exaggerations, disingenuous statements, or downright lies on the application. They have to balance their duty to protect suspects from illegal surveillance with the need to detect and prevent crime. Law enforcement is always going to be able to film flam the court if they are determined to do so and do it on a small enough scale.

Yes, the gatekeepers should have protected the gates better, but it’s hard to be a gate keeper when the security guards are telling you that they need through the gate.

I think the easiest way for the Senate to handle this is a quick vote for dismissal. Any Republican that publicaly argues against this is in for a brutal beat-down.

The "I'd like to hear witnesses argument" belongs in the House. Dismiss the charges as inadequate and send it back to the House. Let them call for the witnesses to appear and render testimony.

Agreed, but the FISA court clearly doesn't have a mechanism to protect the innocent. It has no procedure in place to prevent abuse or fraud.

It's really a conundrum, I recognize that we need a FISA court for our defense, but it's built on an honor system, where in at least one case, the honor was missing.

I would suggest that they need an intermediary that doesn't trust the FBI.

I don't believe this at all. First of all, buying into it being a "tough job" is just errant nonsense and pretending the ruling class work harder than us stiffs in the private sector. Any middle manager could do it better than she does.

The FISA court judges are appointed by the freaking Chief Justice of the Supreme Court. These are people who - supposedly - are highly experienced, vetted at the highest level, and theoretically are wise far beyond the average person or even average judge.

They don't get to use the excuse that it's a difficult job, or that they can't distinguish legitimate threats from flim flam.

KK, I did wear #64 as a guard until they moved me to tackle in HS. When we pulled we were taught to stay low coming off the line and hit the first person you saw with a cross body block. The game has changed so much since we played Kev.

I swear this story is true.

Our first day of freshman practice, our coach excused himself and walked into the woods. He came out with a branch that he whittled down to a switch that he used to smack us in the ass with if we weren't hustling. So one day we were practicing pulling and the coach dressed in tee shirt and shorts played the defensive player on the end. He wanted the other guard to hit him, the first person he'd see coming off the line and turning upfield. Well Billy hit him but not hard and the coach went off on him. "I told you to hit me, now give me your forearm pad and do it again. This time the coach gave Billy a nasty forearm to the helmut, knocking it right off his head and knocking him out cold. He was crazy but we played out hearts out for the guy.

I think Jacoby was a tackle, not they they don't pull, they do. I was just thinking about pulling guards.
