Sane people believed that. what is important is evidence so that some of the dimwits finally understand how ridiculous the Russia hoax was.

The idea that a guy who made his money in real estate and construction,who grew up in the Cold War, who has donated to soldiers, who attended Norman Vincent Peale's church, whose sister was a federal judge, and who loves this country as much as he does, would throw in with the Russians, seemed ridiculous to me from the first time I heard it.

Meanwhile, no one ever asked about that half-million dollars Bill Clinton was paid for one speech in Moscow.

Legal Insurrection is not as hair on fire as most commenters on the amicus brief entry by J Sullivan: Sum up FTA:What would be less unusual is if Judge Sullivan appointed counsel to represent the government’s (former) interest, now that the government has changed it litigation posture. That happens approximately once per term in the Supreme Court, particularly where no party any longer is defending lower court decisions. In SEC v. Lucia, the Supreme Court “invited” a specific amicus counsel after the SEC switched its position, and there no longer was anyone in the case defending the lower court decision.

Here, the decision to drop a case post-guilty plea is highly controversial, so perhaps Sullivan feels the need to have SOMEONE argue against it since both the prosecution and defendant are on the same side. Sullivan may, in a sense, be conducting a beauty contest to decide who to appoint to argue the government’s (former) position.

In a worst case scenario, Sullivan doesn’t want to drop the case and is creating as much of a record as he can. It would ultimately be an act of futility, since Trump almost certainly would pardon Flynn in this scenario, but that might be the preferred path for Sullivan given his expressed disdain for Flynn. Make Trump do it.

Professor Jacobson (see clarice's 8:36 AM link) describes the usual move that a court takes when one party is no longer contesting and the court, for one reason or another, thinks a matter still needs to be litigated. That move is to appoint alternate counsel to argue the matter. As Jacobson points out, such a step, while unusual, is not at all unprecedented. As I mentioned earlier, the better course for Judge Sullivan to take, if he wants to continue the proceedings, is to appoint alternate counsel (as opposed to inviting amici). The problem is that the DOJ filing is so overwhelmingly persuasive on prosecutorial misconduct that the DOJ motion should be granted without further ado.

Re convictions at the Brennan, Rice, Clapper level (much less the Clinton, Obama level). Google "Jim Mora playoffs" and when you find the clip, substitute "convictions" for "playoffs". That is my view about the chance of convictions for the high level kahunas. That view is not Ledge like, it's simply the way things be.

You want to project onto current members of your guild standards that you, yourself, have.

No judge who erupts with that "Traitor" crap in open court from the bench gives a "Flying F" about crossing T's or dotting I's.

That's as hilarious as thinking Nancy Pelosi or the Ghost of Paul Ryan care a whit about the duty of Congress to manage our budgets and debt.

Life COMPLETELY NORMAL down here in the SC low country. Restaurants open, people out and about, shopping at stores, beaches full of happy, maskless humans. So glad we came down!

Unseasonably cool--just in the 60s today--but dry and sunny (except for this afternoon). Shrimp tonight; crabs tomorrow.

More people than I have ever seen this week (which we were here for ten years during in the past.) Families, and groups of college students on the beach; if I owned a place,or my parents did, I'd do shutdown here, for sure, and I am guessing that is what I am seeing.

I am way behind, so I am reading yesterday’s posts. Miss M I remember when Jeffords switched parties, because my mother swore she would never buy Cabot cheese again. I still think of her anger about that when I have the option of buying Cabot cheese. Unless it’s my only option I do not buy it.

And about Dan Q. When I was in college I exchanged a semester in DC at American U. It was a study of govt and two days internship. I started at Jack Kemp’s campaign as an intern. The guy in charge of us was god-awful. I left and went to the Nat Wholesale Grocers Assn. Random, but actually a great internship. At a conference I met Dan Quayle. He was absolutely handsome, and not stupid. Year’s later it was an education to witness what the press did to him.
