Jane,

Sorry about your eye and having to sleep on your stomach. I can't stand to sleep on my back, so I imagine the feeling of frustration and discomfort is about the same. I hope it heals quickly!

Narciso

He grew up in rural poverty to urban squalor, by age 6, thats around the time he met his grandfather.

If anyone missed the childhood parts, do rewatch when you can. That part was very illuminating and you don't want to miss out on his descriptions of his grandfather.

So hubby hears from red who has checked next door that 3 remaining fleers supposedly went in direction of a street near here that is a dead end. Ga 400 bisected it so they are all fleeing into a funnel. That street was one I walked yesterday and hubby frequently does so he decides to "go walk."

Sure enough he sees a running man who fits some of the known characteristics and watches him go into another street. It dead ends into a lake and against a gated community that is walled. He then sees parked cop cars and tells them what he saw so they go off in search of the running man who I guess can refer to himself as a "jogger' in nontraditional attire much like arbery.

If you are fleeing from cops up a highway that bisects between 2 interstates the highway functions to turn most of the streets into cul de sacs and deadends, it is hard to successfully escape. One more exit and they could have disappeared, but I guess they were worried about the construction around the 285 interchange.

Meant to quote this:

But it appears that A.G. Barr and Michael Horowitz are leaving nothing undiscovered and fully intend to proceed with criminal prosecutions. If those who did the crimes under Obama's orders and direction have to hire hugely expensive attorneys, perhaps even sell their homes, as General Flynn had to do, they will be angry, very angry at Obama's getting a pass. They will tell all on each other and on him.

Obama will be helpless to stop it. He will not be able to deny anything in the courtroom, and more truth will come out than if he himself were on trial. He will have to watch his own destruction.

Then for his final, exquisite humiliation: Trump pardons him. 😂

The timing and the positioning after retina surgery are completely dependent on what was done surgically, where the defect physically is on the retina (some people have to stay on their side), what was injected to stent the retina to the back of the eyeball (oil/air) , and the surgeon's best estimate as to how long it is going to take to start to heal in place.

So it's pretty much unique to each person. Nothing set about it at all.

(I finally asked one of our post op nurses why I was overhearing such variable post op orders recently.)

On more important matters, a few weeks into the lockdown I noticed the burners on my Viking range top were not burning evenly and two of them were flaring a lot on one edge. Last Thursday I find their website, email the stove model and serial number along with a description of my dilemma, and the very next day I get a response with the replacement part number and a telephone contact. From the Bee (today) for all y'all train junkies:

U.S.—Wearing masks has become a big part of life these days as we try to protect each other from infection, but one group has found this particularly troublesome: engineers, who now have a big problem telling responsible citizens from train robbers.

“When you drive a train, there is one thing you always look out for,” said engineer Hubert Pearson. “Train robbers! So as you go down those rails, you’re always looking side to side for people with bandanas over their faces -- but that’s everyone these days!”

Pearson said that the other day while transporting goods, three men on horseback with masks on and waving guns around ran up beside his locomotive. He thought he was going to get robbed, but it turned out they were just Texans showing off their new gun purchases to each other while practicing proper social distancing (on horseback).

“Second, the reputation of the judiciary is in jeopardy. As the Chief Justice memorably stated at his confirmation hearings, the function of a judge in our system of government is to “call balls and strikes, and not to pitch or bat.” The district judge in this case has abandoned any pretense of being an objective umpire—going to0 far as to suggest that a criminal defendant who succumbs to a coerced and unfair plea bargain should be prosecuted for contempt.
In the midst of a national election season, with unprecedented acrimony on all sides of the civic debate, the district judge has dragged the court into the political hurricane—cementing the notion that judges are politicians in robes who use their authority to thwart what they consider the “corruption,” “impropriety,” and “improper political influence” of another one of the political branches.
Confidence in the rule of law, and the willingness of federal judges to administer it impartially, will continue to erode, if this Court fails to put a swift end to this spectacle.L

Another Bob

“ These world-wide headlines are only one wave of the tsunami of invective that crashed into General Flynn as a result of the district judge’s
31

intemperate comments. A defendant facing sentencing is entitled to a judge who does not express “disgust” and “disdain” in a courtroom filled with reporters. Inflaming public passions against a party, particularly a criminal defendant, and encouraging prosecutors to vastly increase the charges against him, is the very antithesis of calling balls and strikes.
Nor was this the end of the matter. The district judge’s latest actions— failing to grant the Government’s Motion to Dismiss, appointing a biased and highly-political amicus who has expressed hostility and disdain towards the Justice Department’s decision to dismiss the prosecution, and the promise to set a briefing schedule for widespread amicus participation in further proceedings—bespeaks a judge who is not only biased against Petitioner, but also revels in the notoriety he has created by failing to take the simple step of granting a motion he has no authority to deny. This is an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop. In truth, he is way out in left field.”

Jane, did I miss some new info about your eye?

lyle

Nixon wasn’t charged with any crimes, was he, Rocco?

Porchlight

Jane,

I remembered Bolton from Thomas's book, so I was waiting for it, but I don't believe he was mentioned.

I think they edited it so that as few political people are mentioned by name as possible. For example, though the Judiciary senators at the confirmation hearings are shown, Thomas names none of them (to my recollection). Maybe Biden is mentioned once. Mrs. Thomas mentions Kennedy. That's it.

It's quite effective. You see and hear them talking, but Thomas himself doesn't single them out.

The entire thing is Thomas talking, with the exception of the interviewer (I assume the director) asking a few questions and Mrs. Thomas sharing some of her recollections.

Extraneus

And what's to pardon if no crimes been charged?

I'm pretty sure Nixon was pardoned prior to any charges being brought against him.

As for the legal arguments, I think she has hit a “Grand Slam” in attacking Judge Sullivan’s orders appointing Ret. Judge Gleeson, and Judge Sullivan’s statement that he will allow amicus briefs to be filed. She makes a strong and well supported argument that both actions are inappropriate and unlawful. Her argument is based on points of law I have never had a reason to research, so the case law she cites is new to me, but I find it highly persuasive.

Simply put, she points out that allowing the filing of amicus briefs or appointing amicus counsel is expressly allowed under the Rules of Civil procedure, but the Rules of Criminal Procedure are silent on those issues. She then turns to a significant volume of case authority which holds that where language is included in one set for rules, and excluded in another set of rules, statues of construction that guide interpretation require that the court to conclude that the exclusion was purposeful. The conclusion that must be drawn is that when the Courts and Congress drafted and adopted the Rules of Criminal Procedure, they did not allow for the filing of amicus briefs on purpose — and as a result allowing such briefs is a violation of the rules. She notes case law that says the rules are binding on the courts just like they are binding on litigants who appear before the courts. She then points out that the authorities cited by Judge Sullivan in issuing his order that he will allow amicus briefs are completely unsupported, as he relies on 1) inherent authority, 2) a citation to the Civil Rules of Procedure, and 3) the Fokker Services case in the appeals court where amicus briefs were allowed — which is specifically provided for in the Rules of Appellate Procedure.

Re: TKs Redstate link above:

Shortly after the recent document production RedState had an article about how Sullivan,in a hearing where he required Flynn to be sworn in to restate the guilty plea, went on record during a the hearing questioning or stating he was not convinced about the “material” false statement test of the lying charge. He then accepted a “Restated guilty plea”. Then later, after accepting the plea, repeated on the record that he still needed convincing of the materiality of Flynn’s statements. RedState claimed this mistake itself negates that plea.

RedState claimed this mistake itself negates that plea.

That article was by the same author, Sid. I have read one counter argument to that take. Originally Flynn was before another judge who had to recuse himself. Contrearas or something like that. If the issue of materiality was resolved in that court it is possible that by the time Sullivan took over, it no longer needed to be addressed.

The counter argument was in a comment section of a site that doesn’t come to mind. I apologize for not having a link. I found it interesting.
