Prof. Jacobsen of the Legal Insurrection blog has been targeted by the progressive community at Cornell. The short version is, criticize looters or BLM and you're deemed to be a racist hater unfit for campus life. Don't expect the dean to stand tall for free speech or academic freedom. "Racist" is the Ace of trump right now.
Jonathan Turley blasted Cornell.
I will say - between COVID, on-line classes and the end of free speech, those Ivy price tags seem mighty high.
One side wants primarily to be able to go to their jobs, to maybe open their own business, to raise their children as they see fit, and most of all to basically be left alone.
The other side wants to force everyone else to live by their (constantly changing) standards, to tell other people how to raise their kids, to decide what kinds of jobs and businesses other people can have, and to continually revise history and force everyone else to agree with them.
That leads to my mantra that I mentioned before:
1) do as I say, or I’ll kill you.
2) leave me alone, or I’ll kill you.
Gittin close.

--This morning, the U.S. Supreme Court ruled against ADF client Harris Funeral Homes and redefined 'sex' in federal law.--
I'm assuming only Gorsuch, Alito and Thomas decided not to become the legislative branch.
Does anyone think in 1964 Title VII was written to encompass homosexuals?
If it wasn't then it would seem to me under the Constitution's separation of powers it would be up to the legislative and executive branches to write and pass a new law covering them.
If this is a conservative court...
OTOH I guess Roberts was right when he said there are no Obama, Bush or Trump judges. There are actual judges and actual activists.

"The Supreme Court ruled Monday that a landmark civil rights law protects gay and lesbian people from discrimination in employment, a resounding victory for LGBT rights from a conservative court. The court decided by a 6-3 vote that a key provision of the Civil Rights Act of 1964 known as Title VII that bars job discrimination because of sex, among other reasons, encompasses bias against gay and lesbian workers. A ruling on similar protections for transgender people is expected soon."
More "emanations" from the Roberts Court.
They could have asked Congress to pass a law if they so desired. Instead they unilaterally extended the law in a way that Congress couldn't possibly have intended.

It's like every formal institution in this country [SCOTUS today] is daring us to knock the block off their shoulder because they think our prior restraint is indicative of future performance.
American institutions used to be exceptional; THAT was our exceptionalism, not that we Americans are exceptional or exceptions to the general rules of human nature.
Just as in every society there are some of us who are busy bodies, some who are thieves, some who are power hungry. And there is the majority which largely just wants to be left alone.
The former are loud, active and perpetually angry about their lot in life and the disinterest others have in being ruled or victimized by them.
The latter are by nature more quiet and passive.
But, as in essentially every human society, when the former gain a momentum that makes them believe the others' passivity is a sign of weakness and is etched in stone they begin to push to see how far they can go.
Formerly our exceptional institutions prevented that universal dynamic. With the capture of the formal institutions by the power hungry, that temperance of the urge to power is now gone.
However the country's institutions are varied and many are not formal at all but are equally powerful societal institutions and traditions. The left has been much less successful in changing or capturing them. Their response to that failure has been to demonize and defame those institutions but that hasn't really weakened them. If anything it has strengthened them as redoubts of the sane and American among a sea of prog internationalists.
Will the sane and passive be pushed to the point of armed rebellion? I believe it's inevitable and that the sane will prevail. It's certainly not guaranteed and people like TK who think it will not prevail nor even occur may be proven right eventually.
But I doubt it. When I listen to the anger and obstinacy building in my formerly passive and peaceful church going friends and then consider the millions of much less passive and peaceful deplorables not nearly so inculcated with turning the other cheek as my friends, I think it's inevitable there will be, absent the unlikely political resolution of this impasse, a violent resolution of it.
If there is and the sane prevail, one of the first steps should be the forced and if necessary violent unpacking of the Supreme Court. Most of the justices have utterly failed in their one job of defending the rule of law as described in the Constitution. The proper fate of one who utterly fails at ones job is to lose it. And when your actions contribute significantly to the occurrence of a civil war, sometimes that fate entails losing your job and gaining a prison cell, or worse.
No sane person wants a civil war. But it is the nature of man to be at war with himself. Societies and the governments they conjure are designed to preclude the need for war, either through force or cooperation. The left appears to have decided they prefer the route to a peaceful society through force.
The rest of us must therefore decide whether we will acquiesce and deny our heritage of self governance and live as subjects or whether we will live as free men.
That's the one and only good thing about the left; it distills everything down to its simple, basic essence: Liberty or servitude/life or death.
The left denies God and places themselves in His place, but in a way the result is the same, just opposite sides of the divide;
Deuteronomy 30:19;
I call heaven and earth as witnesses today against you, that I have set before you life and death, blessing and cursing; therefore choose life, that both you and your descendants may live;
God and Satan both force the same equation on us all. Usually individually but sometimes, as now, as a choice of whether our society and way of life will live or die.

Last week is suggested somebody write a book placing human challenges like wars, slavery and income inequalities and life spans et al into a 2,000 year time line. Maybe then the nonsense like "this is our WWII" and all the other woe-is-me-isms can go away.
Today the second book I'd like to see is a simple "As we were all taught in K-12, THIS was the compact we used to launch the country in 1776 and for which thousands of our parents and forefathers fought and died" vs "and THIS is the current status of that Compact after 250 years of changes done to it through the front door, through the back door, and through all the ad hoc unconstitutional shenanigans..." Title could be "Whatever you might think, THESE are your rights as of 2020"

"It's like every formal institution in this country [SCOTUS today] is daring us to knock the block off their shoulder because they think our prior restraint is indicative of future performance."
It's not a given that the sane will prevail. Like the Southern men and boys in Gone With The Wind, we all have qualitative ideas like conservatives are more intelligent, conservatives own guns, conservatives have firmly established principles, etc.
But we can be weighed down by sheer numbers. And, like the North having all the factories and most of the railroads in 1860, etc, the Progs have the universities, the media, the big corporations and on and on. I don't counsel despair but keep in mind that we may be doomed before we begin.
It HAS happened before in history.
They won't come for our guns. They'll chip away and disarm one community at a time, for example.
"Now's the time to spread your voice.
Time's to come there'll be no choice"
By far the biggest chance of avoiding armed conflict will be a solid victory in November. Even then the GOPe will waste no time negotiating away any advantages but it will be a rebuke to the Dems.

the board explained something to the effect of since it’s the legal name of the community & on all the paperwork, documents, etc, it would be EXTREMELY expensive to legally change the name.
There are probably hundreds of subdivisions with this as part of the name. I know it's quite common in Hilton Head, Amelia, etc. So... imagine how expensive this new campaign is going to be.

The obstructive governor, I believe, is also the one who broke quarantine to have a closed jewelry store bring her jewelry.
The director at the cemetery told them the governor had guidelines in place: Five family members would be permitted to leave the parking lot to say goodbye. This wasn’t acceptable: Joseph was leaving six children alone, not including his wife, parents, and brother, who is married with children of his own.
So they waited. On June 1, the governor allowed restaurant dining room food service to return at 50 percent capacity, and on June 9, the Department of Veteran’s Affairs resumed limited military honors and a return to funeral services within local guidelines.
When they tried again, the family was told the new order would allow for six family members to stand six feet apart from each other in a tent they had not asked for. The honor guard would be limited to three soldiers instead of the customary seven firing a three-shot 21-gun salute. His widow would not be permitted to hold her children when they accepted their father’s flag.
“‘I’m not trying to argue with you,’ Phillip bitterly remembers the director telling him when he asked for their family circumstances to be considered last time they spoke. “‘Just listen to me.'”
The guidelines, she said, are from the governor.
“And,” Phillip paused, gathering his emotions, “to see all this, this ‘Breaking News: Governor has allowed for beer gardens to open up at 50 percent starting today… Starting Monday, indoor service at 50 percent…'”
