Lots of interesting data and differing points of view.

But, for me, one of the intro talks stood out. A guy named Arthur Milikh, from Heritage Society, gave a talk on Hate Speech that was really lucid and really made a lot of stuff fall into place for me.

I've gone and made a rough transcription of the talk. I realize that some folks are uninterested and some already have a clear understanding but I figure there will probably be one other person who, like me, will find this fascinating LOL.

It's not an exaggeration to say that there's a multi-part front unifying to crush the freedom of speech in America. Public opinion polls support this and the entities that are doing this are very strong.

The universities since the 60s have begun to have a new teaching on the freedom of speech and there are at least two generations of young people who, opinion polls confirm, want to limit the freedom of speech. Also, we are constantly pressured by other nations and especially by the UN to circumscribe our understanding of what speech is, and what is and is not permissible. And then, there is Big Tech. Which has become, whether you like it or not, THE public forum for deliberation of issues both political and non-political.

The question is: where does this go?
What can we predict and think through of what might occur, given this enormous front.

Now, I'm not a lawyer, I do political theory so my goal is to take a step back and think through what "hate speech" actually means. "Hate speech" is a misnomer. It gives you the impression that those who want to criminalize or outlaw hate speech want to get rid of hatred as such. Or, what they want to do is get rid of ALL hate speech. But that's not true. It has to do, as I will explain in just a second, with the logic of oppressor and victim. That the oppressor's speech should be reduced and maybe taken away, and that the victims, the marginalized should have free rein to speak. I think that's a dangerous situation.
For that reason, hate speech has very little to do with racial epithets. Oh, it has a little to do with that, but not much. It does not have much to do with Holocaust denial either. Those are the "public presentation" of what hate speech is but there's an entire theory beneath it which I'd like to explain to you.

It's worth reminding ourselves why we even have the freedom of speech at all.

This may sound a little lame and stale since you guys are all in law school, but there are philosophic reasons why we have it. The first reason is that speech belongs to yourself because your mind belongs to yourself.
It's yours and the highest use of that mind is the pursuit of the truth. That is from the Enlightenment tradition and the Founders.
The second reason is the most obvious one that you already know--self-government. You cannot have self-government, a free people cannot rule itself unless there are genuine public
deliberations on the common good. This new hate speech regime undermines that understanding.

The third, which is my favorite, is how the freedom of speech affects our character. I'm from Russia, I was born there and there isn't really the freedom of speech there. And you see that reflected in the character of the people. They're not used to having this need to persuade other rational beings to their side, to make arguments. On the other hand, this freedom of speech develops in us a capacity to be persuaded.

This is a delicate rare thing which blooms once in a while and can disappear.
That character of the public is what we are fighting to preserve.

We in the US are basically the last holdout in the western world from those restricting those who speak hate, as they like to say.

All of Western Europe has banned it. They have vague formulations. The law says they want to prevent the incitement of hatred. Not the incitement of violence, the incitement of hatred.
And they claim, I am quoting the law, "hate speech can also be concealed in statements which at first glance may seem to be rational or normal".

So what kind of speech are we talking about?
The kind you already have a grasp of: speech that is deemed racist, anti-trans, homophobic, xenophobic, anti-religious. In Belgium it includes sexist speech and the law says "any speech or gesture intended to express contempt." Contempt is criminalized.

What are the punishments? Well, fines, obviously. Homes have been raided, arrests have been made, lives have been destroyed through lawsuits even when they are not convicted. A Belgian politician was banned for 10 years from public service. Canada too has these laws.

Maybe you would would think these laws would work. Maybe they would stop hatred.
These laws are draconian. But the truth is: they don't. I'm Jewish. If you are Jewish and you live in the UK, you are 13 times more likely to be the victim of violent crime, as a Jew, than in America even though anti-Semitic speech is criminalized.
These European societies are full of discrimination. The laws simply don't get at the thing that defenders claim it will get at.

Now, you may look at America, and say "Things are great here! We have the Matal vs Tam decision. We're safe. And, it was unanimous." You'd be wrong to think that. Not only is this front building, as I've said, this multi-faceted front, but there are some precedents already in the law that will be used exactly for this purpose. The two I have in mind ... I'll get into this in a second but you should track the use of the word "dignity" in sexual liberation cases culminating in Obergefell. There you will see this use of "dignity" that says you have the right to create your own identity and others must respect that identity. And the law can demand that others respect it, and that your speech will harm that identity. The other obvious place is in anti-discrimination laws. The EEOC already has regulations that certain kinds of speech in workplaces are violations of anti-discrimination laws. Those two legal paths will be pursued, I think, in the future.

Leaving behind Canada, Europe, and our bubbling-up legal regime I want to lay out the theory behind hate speech. This theory is broadly subscribed to by Twitter, Google and Facebook. Though Facebook is a little more ambiguous. This logic comes from Critical Race Theory professors who developed it. When Big Tech says they have "neutral" policies that's a public claim. In reality they follow the logic I am about to lay out. There are 3 parts.
First, hate speech causes physical harm. High blood pressure, strokes, you name it. There will always be a social scientist who comes along and allegedly proves this. You will become ill from hearing hate speech.
Second is that hate speech excludes people from politics. People don't feel welcome or even celebrated. You may think that everybody has voting rights, everybody has civil rights so what's the problem if someone dislikes you? The theory says if you are a marginalized group there is no reasoning with the majority. The majority's interests are so deeply tied to their power that they cannot hear the good reasons that the oppressed or the marginalized offer to them.
The third claim is this idea of dignity. Everybody likes dignity. But it has a specific meaning. We used to have a tradition in America, well, two traditions. One is that you have dignity because you have a soul. We get that from the Judeo-Christian tradition. The other understanding of dignity is the Natural Rights understanding. You have dignity insofar as you have forethought and reason therefore you can be held accountable for your actions. You are a moral actor.

But this new view of dignity is different. It comes from a guy named Charles Taylor and others "Everybody has the potential for forming and defining their own identity". If you are a marginalized group you have been given a false identity by the alleged oppressor group. Who, in America I don't blush to say because I am quoting them, is the white majority. They all say this outright. You have to liberate yourself from that false identity and create a new identity. And for you to have full dignity your identity must be respected by that oppressor as you respect yourself. Hate speech undermines that self-respect. So all the rainbow coalition of the marginalized are allowed to have an identity, perfectly free speech except the oppressor group who needs to be quiet because their identity itself is oppressive to the marginalized.
And so what you have then, is a one-way street. The marginalized must not only speak up but must speak out and undermine the power structures and the identity of the oppressor. The oppressor group must sit down and be quiet.
And I'll make one last point. This is the most important aspect, in my mind. Under this new hate speech regime factual claims can be considered hate speech. Here's an example: Speaking about affirmative action. That can be hate speech because it harms the marginalized's self-respect. Speaking about immigration, legal or illegal, harms the self-respect of our immigrant communities. Defending traditional views of the family and marriage also harms the dignity of the marginalized.
Even dog whistles, things that seem to be totally neutral like welfare policy could also be considered hate speech.
What you have in this hate speech regime is a total circumscribing of the political issues that a free people can discuss. They are not a free people anymore.
They can't rule themselves. These issues are unavailable to them.

And one last thing. What you also can't question are factual claims about the narratives or mythologies that the marginalized create for themselves. One cannot speak against those even if what you say is factually correct. For example, you guys saw the New York Times' 1619 Project. It's riddled with all sorts of errors. But in a hate speech regime scholars, who disagree on the facts, could not actually dispute these things in public because this is a narrative, a sacred narrative of an oppressed, marginalized people.

DrJ, it is the middle/end of Strawberry season here in SE Wisconsin. My bride and I picked umpteen or Juneteen pints of the delicious berry this week.
She made a years worth of strawberry preserves or jam for her Dad. It was an annual event, this strawberry picking for my lovely wife, and her equally lovely Mom. Dad will reap the dozen or so Mason jars and we'll have a feast on Sunday. It seems and feels odd, for MOM to be gone, but that is the cycle of life.

Weird aircraft. I doubt lasers, no visible ports and nothing (except the center tank) in the cargo space. The ends of the tape runs have small irregular shapes under them. I suspect the tape is just a quick and dirty way of repositioning the shapes without punching a bunch of holes in the fuselage.

There were comments, so I decided to read to see what people were thinking. Most supported her, and there was one commenter who posted about NJ. So I looked it up. I had to go three pages deep after AlJeez to find an article out of the MSM. So. That’s what I see. If it’s Facebook et al the leftists just post. And they spew the propaganda. Narc, I think I have heard of the j list. I am certainly not naive about all this. My point re the Camden article is that we need to fight back against this ludicrousness. There are people who just think this is all a benign and even altruistic attempt to fix things. Grrr. We all know that’s not true. But they have their useful idiots. This writer seems true in his attempt to say this is not the best way. It’s a good argument these days, I think. But maybe not so much when I missed the debate about it here way back when (which could have been a month ago).

I just hate that these slogans get used, and most regular people feel the worst fate of it, no matter your “color.” I love all the colors and smiles and personalities I meet every day, and I will never give that up.

The most interesting argument I’ve heard for wearing masks is if you want a faster fuller economic recovery, you need to make the scaredy cats comfortable enough to leave the house and spend money. Makes some sense as far as it goes.

Also heard that the socioeconomic class that’s cut their spending the most is the upper-middle class. They’re simply not leaving the house. The person who made the claim didn’t cite a source.

i was looking at all the taped on sensors and what looks like some cut outs. very odd.

i'll stick with my first pass guess that it is electronics warfare or targeting model. odd though it would be in broad daylight, whoever is flying wanted it seen.

Sammy, what a great song. My growing up BF, left the AIR FORCE and settled in SO-CAL. Mission Viejo to start, but prolly 6-7 different Orange County places. Tustin, Costa Mesa, Newport Beach, Laguna Beach, Laguna Hills etc etc. He was transferred to Atlanta, and raised his boys there.
He turned me on to great POWER POP and POP music, that would not reach land in Wisconsin for another 8-10 years. The LA'S and THERE SHE GOES, is a song my band has played for 20 years. Sixpence-none the richer did a great version too.
I'm a POP and POWER POP guitarist and singer, for the most part, and I LOVE THAT SONG.
