I agree the multiple count trick is abused, but how about this scenario: A guy murders someone. Prosecutor believes evidence supports premeditation, goes for murder 1. No question the guy did the shooting, it's on video, etc. The jury decides there's reasonable doubt about premeditation. So the guy just gets off? Or the prosecutor can't bring a murder 1 charge without essentially absolute proof, because of the risk that a jury won't see the evidence as sufficient?

My sister the nurse had a credit at a nursery and came to pick me up to let me use part of it to get some stuff.

No shrubs of anything that would work with our house, so got annuals and perennials, which I will plant when it cools off this evening and tomorrow.

Our side of town had a lot of immigrant German gardeners in the 20's and so there are a lot of greenhouses on this side of town; most are family owned through several generations.

She told me the places she normally buys from were completely empty. She has never seen that before. One of the employees at one place told her that they had been swamped, and they assumed it was because the lock down earlier in the spring drove people to gardening, as it was one of the few things people could do, since sports, movies, restaurants, clubs, and shopping were out.

You're going to be at much more risk when the cops stop arresting black people, assholes.

When I was a kid in NYC, my father and uncles knew some cops. They'd get the call from dispatch about a crime in progress, and if it was a black neighborhood they'd take their time and show up 20 minutes after all the blood was on the ground and it was just a matter of writing up the report.

It wasn't simple racism. Because they had no support from the mayor and upper brass, it just wasn't worth the risk of trying to stop a crime in progress in a black neighborhood.

Everyone knows that this will happen again now.

At the greenhouse/nursery we went to, they had their obligatory social distance signs. No clerks were wearing masks, and about 1/3 customers were. It's in the mid-80's, and I cannot imagine wearing a mask around out in the sun. Ugh!

You can charge a guy with one thing or a thousand and not solve the issue of imperfect juries nor is citing a renegade jury a useful tactic in looking at this issue. They will sometimes convict the innocent and free the guilty and those cases are not solved by overrcharging but by competent appeals.

In the example given, if the jury is not a renegade and decides there isn't sufficient evidence for Murder 1 then the prosecutor should not have charged Murder 1.
The standard of proving guilt beyond a reasonable doubt is there to protect the innocent and to the extent multiple charges defeats that standard it is not doing justice but defeating it.
Proof beyond a reasonable doubt is one step short of absolute proof and it's the prosecutor's job to determine where that line is. If the line is blurred it shouldn't be in favor of the state's ability to throw some guy in prison the rest of his life.

No she didn't and people in the comments didn't seem to get it either. She retreated and went behind the counter with the clerk, pointing her gat at the thief the whole time. After he left she came back around and followed him out.
She should have shot him when he approached her with a knife at first or later when he was threatening the clerk.
Whether she didn't because she's useless or because cops are now afraid to take out armed criminals because of the current looney tune atmosphere I don't know.

Does anyone else remember listening to that Kentucky/Texas Western game? I was just a kid of 15 (this was way before March Madness and was just a two week tournament of 16 teams) and was cheering for Kentucky just because they were a traditional power and when you're a kid lacking a rooting interest in any team it just seemed natural to cheer for what was billed as the better team.

It was obvious, even over the radio, from the opening tip that Texas Western was the better team. Kentucky could get nothing going on offense. I thought at halftime that Rupp might be able to make adjustments but whatever he did Don Haskins more than compensated for. It was total domination.

If someone is suspected of jaywalking, charge them with five felonies. Judges as a rule do not stand up to this. So whether one jaywalks or not, it is a lot easier, less time consuming and costly to plead to the jaywalking offence.

But seriously, what we learn from that is that NYT readers oppose getting control of the streets. Cotton never recommended violence, just helping local officials restore order. With their revulsion at that, the elite left has admitted to actually favoring anarchy, while polls have shown massive support for restoring order.

This can't possibly end well for them personally, either, because they all live in places where violence will be tolerated. Other places, predominantly Republican, will be more peaceful and safe, and normal people will naturally gravitate to them. How can that be good for Dems?

I think the whole thing will blow up like a giant exploding cigar in their faces.
