If Ms. Cooper gets an all-white Upper West Side jury she is toast - the prosecution will argue that only a racist could vote to acquit.
Back in Realityville, Mr. Cooper did threaten her dog and she will claim she had a reasonable fear of Bad Things About To Happen. Was her fear in fact reasonable, or motivated by her racist, hate-filled heart?
Well. If the DA wants to create a environment of "If you see something, say something, but don't mention the race of the alleged perp", this is the right track.

As our host suggests, now we have to fear that if we report suspicious behavior that turns out to be innocent, we will be charged with a crime. Just like cops who use force when they judge it necessary will be charged with a crime by prosecutors with 20-20 hindsight. The end result, predictably, will be more murder and mayhem.

This is probably a naive question but how do we square arrest and pretrial incarceration with the presumption of innocence?
And if the state fails to gain a conviction why is the person arrested not awarded compensation for being incarcerated?
The bar to a successful malicious prosecution suit is extremely high, but even in the case of simple mistake the person's life was still severely disrupted and his freedom taken from him.

And the bar to a malicious prosecution suit should be a high bar if we ever want anyone arrested ever again. If prosecutors and cops are personally on the hook for making a mistake, what's the one foolproof way of ensuring no mistakes?
My proposal was not to end innocents being accused. That is inevitable. The purpose is to compensate those caught up in that inevitability.

But unless it's criminal, we usually aren't on the hook financially for something we mess up at work. So the standard would have to be Duke Lacrosse-level malfeasance. Otherwise, as Iggy says, prosecutors will be reluctant to charge even clearly guilty people who might get off through jury nullification or a technicality. And then we'd have the opposite problem of guilty people who get the double gift of getting off, plus getting "damages," like the Central Park 5 scum. Or imagine Bill Ayers getting compensated after getting off on a technicality.

Monday's new deaths were the lowest Monday since March 23rd which was the first triple digit Monday and literally about two days after new deaths came up off the base line of single and double digit totals.
