Cuomo's treatment of religious gatherings gets slapped down by the Supreme Court.
Cuomo's dodge of withdrawing the restrictions and then arguing the court did not need to rule did not work. The embittered among us recall that NY State successfully tried a similar ploy last spring with a gun related restriction.

Justice Sotomayor has got to be the stupidest, most political judge on the bench. Cuomo gets the benefit of the doubt because he used the gun law moot strategy again. And, oh yeah, bring up the false equivalence of Trump's "Muslim" ban. WTF.
Roberts "we can kick this can down the road approach" is incredibly wishy-washy and I can see why the majority chose to ignore him.
I think the majority clearly aimed this ruling, not only at Cuomo, but at all the governors and the lower courts. The Constitution still stands and the time for pandemic accommodation is over.
The court admits that they are not public health experts yet seems to imply that public health experts are either unaware of the Constitution or its understanding is beyond their expertise.

Chaim Schwartz , an ultra wealthy man in Israel, had the most beautiful daughter.
But, there was a problem. Everything she touched would melt in her hands. No matter what, Metal, Wood, Stone. Anything she touched would melt.
Because of this, men were afraid of her. Nobody would dare marry her. Chaim was despaired. What could he do to help his daughter?
He consulted doctors, scientists and anybody who could solve this problem.
Finally one of them said, "If your daughter touches one thing that does not melt in her hands, she will be cured."
Chaim was overjoyed and came up with a plan.
The next day, he held a competition. Any man who could bring his daughter an object that would not melt in her hands would be given billions of dollars to marry her.
Three extremely intelligent and handsome young men took up the challenge. Yossi, Duvie & Yaakov.
Yossi, brought a very heavy steel rod, But alas, when the she touched it, it completely melted in a matter of seconds. Yossi sadly went away.
Next was Duvie. He brought a beautiful diamond, knowing diamonds were one of the hardest substance in the world and would not melt. But alas, once she held it in her hand, it melted. He too was sent away disappointed.
So now, it was Yaakov’s turn.
He was very nervous & shvitzing. He approached Chiam’s daughter & said, “put your hand in my pants pocket and feel what is in there."
She did exactly what he asked.
She felt something very hard.
She held it in her hand, squeezing it
as hard as she could.
It did not melt & remained extremely hard.
Chaim was overjoyed. Everybody was overjoyed.
She was finally cured. Nothing never, ever melted in her hand again.
Yaakov married this beautiful girl and they both lived happily ever after, raising a wonderful family.
Question: What was in the Yaakov’s
pants pocket???
Answer below ↓
M&Ms of course!
They melt in your mouth, not in your hand.
What on earth were you thinking?

A non lawyer summarizes the GA complaint. For those willing to read 3 pages but not 109 LOL.
Else scroll on by
"I will try to TLDR the GA one… which is still gonna be really long.
We have evidence to show dominion system not only designed to be and clearly capable of being easily manipulated but that such motive and opportunity was demonstrably available in certain counties, particularly Fulton post 10pm “leak” bs story which was also a false cover to get watchers removed. Lots of outlining how insecure the logs (even when they do exist) are etc. We have evidence to suggest some 96,600 (basically the same number of Biden-only absentee ballots if you guys recall) absentee ballots were requested and counted, yet never recorded as having been received by the county boards of elections by the voters involved [pure-harvested-illegally]. Additional opportunity and allegations of fraud via failure to verify signatures and check security mechanisms with regard to absentee envelopes. Expert statistical analysis yada yada demonstrates at least 96,600 ballots were illegally counted.
We got standing cause person we’re filing for is not only a GA resident and voter but a Republican nominated elector for the State of GA. He brings this action to set aside results and decertify the results for potus office. Another plaintiff here resides in another county and is voter and R nominated elector for GA. … on and on for a couple more R electors and also the Ass.Sec of GA GOP . Not only do they have standing they don’t have to show how people\ballots would have spoke without what’s being alleged only that enough ballots were irregular such as to place the result in doubt.
Kemp named because he bought the system and signed off on the 150m$ budget – against (hilarious) the warnings of Dems and FatCrazyBitchAbramsWhoWillNotGoAway™, and related couple choice quote from them included talking about how they’re insecure and can’t be trusted. [nice touch!] Raffensperger is named cause mf is sec of state charged with carrying out election laws as passed by the legislature, yada yada. They go on to lay out the courts jurisdiction and venue etc to attempt to negate passing of the buck etc and layout some other basics of GA statues and constitutional law and federal case cites that apply here.
Goes on to detail GA law as passed by the legislature about how absentee ballots are to be handled, env. marked when arrived, signature verification, and what to do if with unsigned or otherwise non-compliant envelopes etc. Goes on to talk about the “Settlement” aka agreement with Abrams bs and how it violates what legislature set forth.
Affidavits from various folks that most or none of shit that was supposed to be done was actually done, and envelopes no where to be seen\found on site. Tells of primary 2020 situation where they DID follow the rules to check this shit and many many ballots were thrown out when following the rules and tons were thrown out for being late. So.. it’s not like “they couldn’t”, because they’d done it just months prior, they just chose not to. Also goes on to call out opening the outer envelope for ballots prior to election day, when legislature clearly said that it could not be done till 8am on election day – yet SOS had them opening them up 3 weeks before hand by decree\his own rule, and delegated signature matching to partisan based training provided by Democrat Party Agencies – another clear violation of legislature statues.
Goes on to call out the BS audit\recount..as an unlawful one because it wasn’t an audit at all and for various other reason we’ve all heard already – mostly denied meaningful access and that in many\some cases it wasn’t even a “hand count” but yet another machine count (apparently in some cases even using the dominion systems again), along with citing\naming some of those who will testify to this.
Goes on to detail a “pattern of fraud” and not just “mistakes” along with lots of details most here have heard before but for which she has witnesses\affidavits, strange ballots, the markings, lack of envelopes, repeated miscounts of biden only piles, trump votes witnessed placed in biden piles (and not just singular instances), putting trump votes into Jorgensen and “novote” trays, hostitlity toward only R-watchers,etc, whole host of shit, even what appeared to some as counterfeit watermarks that were off-color from the rest . Some of this apparently even went on during Early voting claims one voter and witness, for which complaint was files but never responded too.
I could go on but this is long enough, most of the rest just provide more color around stuff already mentioned with excepts from affidavits etc, including some nuts and bolts talk about the ImageCast Central part of the software and how to easily track and fk with it. Things like what gets move to the memory card from the machine is simple folder copy or in case of upload it just uploads a given folder… anyone wanting to delete votes\ballots needs only goto the folder before copy\upload and delete the files they want using basic os delete file functionality and then clear the recycle bin (they were using win-10). There process to move stuff to cards is …drag\drop copy process. Then lots about motive opportunity etc and that these Dominion systems were designed with all this shit in mind etc – though they only have one DoD related witness for some of this, other parts they attempt to back up in other ways.
Oh and there wasn’t even a small leak as updated reports indicated, it was a overflowing toilet not even in that part of the building in the end, which sent everyone home – while 6 people stayed around alone with the computers for hours.
Lots of Dr.Briggs and Matt Braynard and Eric Quinnell stats analysis mentioned about missing and unlawful ballots after doing some sampling, etc.
….ok really I’ll stop now.
In any sane court all this shit would trigger at least a temp injunction and some period\access to discovery.
Hey did you know _all_ 900 military ballots out of Fulton were supposedly for Biden. I could believe 75/25…maybe but 100%, come-on-mon, it wasn’t even that bad in DC. 20,311 registered people who voted don’t appear to even live in the state – and that’s just what was known via national change of address notification database (or having been registered to vote recently in a different state as well – yet they voted in GA).
Other items beyond just decert asked as immediate relief.
-impounding all voting machines and software for inspection.
-no machines be used to tabulate any further voting that are not certified by federal and state law.
-The settlement agreement be ruled in violation of state laws.
-some other shit already made clear above
-36hr of video cams from state-farm arean between hours of 12am nov3rd to 6pm nov 4th. [though they fked up the wording of that in the filing imho]"

Surprisingly, the deaths of older people stayed the same before and after COVID-19. Since COVID-19 mainly affects the elderly, experts expected an increase in the percentage of deaths in older age groups. However, this increase is not seen from the CDC data. In fact, the percentages of deaths among all age groups remain relatively the same.
“The reason we have a higher number of reported COVID-19 deaths among older individuals than younger individuals is simply because every day in the U.S. older individuals die in higher numbers than younger individuals,” Briand said.

jimmyk, the complaint seeks a number of alternative reliefs:
1. An order that GA's results be decertified
2. Order prohibiting absentee ballots and mail ballots that do not comply with GA's election statutes not be counted
3. Elimination of all mail ballots
4. Disqualification of GA's elcetors counting toward the election
5.An order that Kemp decertify the results
6. An injunction against transmitting incorrect results to the EC
7. An order requiring Kemp to transmit results that Trump won
8, An impoundment of all voting machines
9.An order that no vote received by mail be included in the count
10.A declaratory judgment that GA's system violates the Electors and Elections Clause
11. A similar DJ that GA's system violates the 14th Amendment
12. A DJ that there must be a remedy for the improper absentee voting and mail in voting
13. Immediate seizure of all voting machines
14. Immediate production of all security camera videos.
I may have missed a couple and I definitely paraphrased some, so take it all with a grain of NaCl

"Briand also noted that 50,000 to 70,000 deaths are seen both before and after COVID-19, indicating that this number of deaths was normal long before COVID-19 emerged. Therefore, according to Briand, not only has COVID-19 had no effect on the percentage of deaths of older people, but it has also not increased the total number of deaths.
These data analyses suggest that in contrast to most people’s assumptions, the number of deaths by COVID-19 is not alarming. In fact, it has relatively no effect on deaths in the United States.
This comes as a shock to many people. How is it that the data lie so far from our perception? "
"When Briand looked at the 2020 data during that seasonal period, COVID-19-related deaths exceeded deaths from heart diseases. This was highly unusual since heart disease has always prevailed as the leading cause of deaths. However, when taking a closer look at the death numbers, she noted something strange. As Briand compared the number of deaths per cause during that period in 2020 to 2018, she noticed that instead of the expected drastic increase across all causes, there was a significant decrease in deaths due to heart disease. Even more surprising, as seen in the graph below, this sudden decline in deaths is observed for all other causes."
People who were going to die of something else got nudged by Covid.
Because of CDC reporting rules and financial incentive Covid deaths are a lot like mail-in ballots. One can manufacture as many Covid deaths as needed.
Oh, and Happy Feargiving.

jimmyk, election law is way way outside my fields of experience, but the complaint is seeking equitable relief, meaning the court can fashion some remedy which it thinks will result in fairness. In other words courts are empowered with broad brush to come up with some remedy which would result in a fairer outcome than what took place on November 3rd and 4th. And that includes throwing out the whole thing and telling GA to perform a do over, or a "hindu" as we used to call it playing handball in Queens growing up.

I posted on a previous thread about the typos. That's a product of the Lincoln project threatening attorneys and a shortage of manpower on Powell's team. I have seen many large, successful firms use paralegals to draft complaints, and they are often full of typos. I have seen the name of the court spelled wrong, the names of the parties spelled wrong, misnumbering of paragraphs etc. It means nothing, and Althouse, although she is an attorney, is an idiot if she is stating this has any substantive impact.

Thank you, Jack! Happy Thanksgiving to you, too.
No snow in MN. Pretty mild and misty. The colors are beautiful - so many different browns and tans and greens. Right up my alley.

rich,
I've thought of you several times today. I hope your dad is doing well and that you were able to have Thanksgiving with him.

lyle,
I've asked 'where's Lyle' several times over the past couple of weeks. I'm happy to see you're back -- and I hope to soon be envious of your fantastic dinners and wine selection.
Speaking of wine selection -- though this has nothing to do with wine -- one time SBW posted a comment about using cranberry bitters in a cocktail. For some reason that sounded so good to me. I bought the bitters. Couldn't remember which drink he was talking about ((to be honest, I have maybe one or two Cubra Libres or Margaritas a year, I'm no drinker and really like an icy Stella in the summer)) -- anyway, I've had these cranberry bitters for over a year. Sometimes I wonder if I could use them in cranberry bread. :)
Happy Thanksgiving!

Too inconvenient, apparently.

I'll go with John "Vader" Roberts, at this point.

Jane, (previous thread):
"Just got off the phone with my 95 year old liberal mother. She wanted to know how I felt about Biden’s cabinet. I said; they are old and corrupt”. Good thing she can’t hear."
I burst out laughing when I read this. :)

Last night while I was reading Sidney's Georgia filing I thought that similar suits could be filed in the other swing states. I now see that Sidney has also filed a parallel, not a carbon copy suit in Michigan. It's a little shorter at 75 pages/
https://defendingtherepublic.org/wp-content/uploads/2020/11/Michigan-Complaint.pdf
This one is sloppy too. Lots of these type things that look like cu and paste errors that lost formatting.
"falselyshowthattheabsenteeballotshadbeenreceivedintimetobevalid.Sheestimatesthatthi"
Other than the typos it looks good and includes the claims about Dominion that were included in the Georgia suit, but tailored to the differences in the two different softwares that were used.
It also includes MANY more references to affiants than the Georgia suit.
I can't find the exhibits mentioned in either suit.

Peter, 10:55 a.m., last thread: "Kimmel (remember, I got dibs on punching him out) asks Zero if he had sex with Big Mike after Bin Laden was tapped."
I used the links on newsbusters to try and send emails to Apple and Target. I was successful with Target -- told them they should be ashamed they are contributing to the sewer that Kimmel produces on his show. I never could get thru to Apple -- they're too smart with dozens of options that have nothing to do with a discontented (angry) old lady who wants to tell them to stop sponsoring trash like Kimmel. But I copies their 'home address' (?) and will write a letter.

https://www.nydailynews.com/new-york/ny-coronavirus-cuomo-supreme-court-religion-20201126-4j3jvuiglrekzkqgcgzbdt7bgy-story.html
Gov. Cuomo calls Supreme Court decision blocking N.Y. restrictions on religious gatherings a political statement
"
Gov. Cuomo said a U.S. Supreme Court decision handed down last night blocking state officials from enforcing a cap on religious gatherings in coronavirus hotspots in Brooklyn and Queens is “irrelevant from any practical impact” because those areas are no longer designated virus hotspots.
He said the decision, among the first that includes newly-appointed Justice Amy Coney Barrett, was “really more an opportunity for the court to express its philosophy and politics.”
"Cuomo said the Supreme Court decision won’t affect caps on religious gatherings in other parts of the state designated as red or orange zones."
It's an irrelevant political statement that doesn't prevent me from imposing the same measures elsewhere in NY. I wonder what the Chief Justice will think about that attitude.
This is why I thought the majority issued its' opinion. The governors and health officials are beyond control and need to be reined in.
