General Colin Powell is urging the U.S. military to recall Michael Flynn and put him on military trial for sedition. It's the latest reminder that pardons aren't magic wands, and the legal pushback against Trump and his co-conspirators is just beginning.

As much of a piece of trash I consider Powell to be, I didn’t expect him to call for nonsense like that.



Why am I unsurprised?


Long one:

Yesterday, I posted about the Supreme Court having no record of my papers. Suddenly, I then received a back dated PDF from the Court by email that was apparently snail mailed on December 17th. (See image above.)

The Clerk, Scott Harris, has made a decision not to docket my case. Is it because I failed to follow a Supreme Court Rule? No. It’s because Scott Harris – the clerk – has made a legal interpretation that a citizen plaintiff is barred from suing a State in an adversarial capacity. And that judicial decision by Harris is wrong based on precedent of the United States Supreme Court cited in my papers.

As I made clear in my filing, the Eleventh Amendment only prohibits citizens from suing a State for monetary damages or equitable relief. But citizens have been allowed to name states in various other adversarial proceedings. For example, see California v. Deep Sea Research, 523 U.S. 491 (1998):

“As Justice Story explained, in admiralty actions in rem… the language of the [Eleventh] [A]mendment is, that’ ‘the judicial power of the United States shall not be construed to extend to any suit in law or equity.’ But a suit in the admiralty is not, correctly speaking, a suit in law or in equity; but is often spoken of in contradistinction to both.’’ 2 J. Story, Commentaries on the Constitution of the United States §1689, pp. 491-492 (5th ed. 1891).” California v. Deep Sea Research at 502.

Additionally, in an adversarial Bankruptcy proceeding, a citizen was allowed to name a State, according to the precedent of Tennessee Student Assistance Corp. v Hood, 541 U.S. 440 (2004), where the Supreme Court stated:

“States, nonetheless, may still be bound by some judicial actions without their consent. In California v. Deep Sea Research, Inc.,523 U.S. 491 (1998), we held that the Eleventh Amendment does not bar federal jurisdiction over in rem admiralty actions when the State is not in possession of the property.”

So, as both of these recent precedents clearly illustrate, the Court has made clear that while the Eleventh Amendment prohibits a citizen from suing a State in a case at law (for monetary damages), or in a case for equitable relief (injunctive relief), other legal procedures are available to citizen plaintiffs.

In my case, I sought a pure Declaratory Judgment, and I intentionally avoided asking for injunctive relief. The United States Supreme Court has stated in multiple cases that a Declaratory Judgment is neither a case at law or equity, but the Supreme Court has never stated whether a citizen is prohibited by the Eleventh Amendment from bringing a pure Declaratory Judgment action against a State.

This issue was the novelty of my case. And determining issues of first impression are the very purpose of the Court, not of the Clerk’s Office. The clerks are supposed to make sure litigants follow the Rules. Court Rule 17 governs original jurisdiction actions. It does NOT anywhere prohibit a citizen from filing such an action. It simply says “see Eleventh Amendment”. I did see it. I did address it.

Clerk Scott Harris has no authority to act like a Judge. I followed the Court Rule. No Rules were broken. If the Justices don’t want to hear the case, they can say so. But a clerk does not have judicial authority. This is why the Clerk’s Office on multiple occasions has been forced to admit there is no Court Rule against my filing this action.

I intend to appeal the Clerk’s decision not to docket my case. Since this pertains to an original jurisdiction action, the Supreme Court has appellate jurisdiction over it. I am hoping another attorney will represent me in an emergency application to stay the Clerk’s illegal usurpation of Supreme Court judicial authority. Last time I checked, Scott Harris was not appointed by a POTUS, nor confirmed by the Senate.

Furthermore, this is now the second time in my career that a SCOTUS clerk tried to be a judge. A clerk refused to docket my application to Justice Souter back in 2008 when I challenged Obama’s eligibility on the basis of his being born a British Subject. The clerk then erroneously claimed that I failed to get a prior judgment from the New Jersey Supreme Court. He was famously proved wrong.

That case was eventually docketed and referred to full conference of the Court after the public made a lot of noise. I have the trail of ever changing docket screenshots to prove it. I am preparing a post detailing all of my interactions with the Clerk’s Office, supported by visual evidence.

They ran three weeks off the clock, folks. Three precious weeks. Had this case been docketed, President Trump could have intervened, but they stopped it cold. Why? Read the Supreme Court’s unanimous decision in Foster v. Love. That’s why.

Dr. Birx Has a New Excuse For Violating Her Own Lockdown Orders: My Parents Were Depressed and Lonely Due to My Lockdowns, So I Had to Visit Them Or They'd Die

Dr. Deborah Birx said she took her Thanksgiving jaunt to Delaware because her parents were so down in the dumps, they "stopped eating and drinking" -- a justification ripped by people who said it was her coronavirus restrictions that prevented them from seeing their own dying loved ones.

In her interview with Newsy, in which the White House coronavirus task force coordinator revealed she plans to retire over the scandal of breaking her own travel guidance, Birx complained about how her family had been suffering over her own guidelines.

"My parents stopped eating and drinking because they were so depressed," the 64-year-old complained to Newsy.

"My daughter hasn't left that house in 10 months, my parents have been isolated for 10 months. They've become deeply depressed," Birx said of the need to "recover from the trauma of the last 10 months."

Birx was quickly eviscerated online for being "tone deaf" and for suggesting that it justified her breaking her own task force�s rules even as they had far more significant consequences for many other families during the pandemic.

"My dad died of Covid surrounded by people in hazmat suits. He didn't understand," writer Mark Aldrich replied to Newsy's interview.

How bloody-minded will Democrats be with their precariously thin House majority? We're about to find out as Speaker Nancy Pelosi's caucus considers an election challenge from Iowa�s 2nd Congressional district.

On Nov. 30, Iowa certified Republican candidate Mariannette Miller-Meeks the winner of the district, which extends southeast of Des Moines and is currently held by a Democrat. The margin was six votes.

On Tuesday Democrat Rita Hart submitted a brief asking the House of Representatives to overturn that outcome. Authored by Democratic election lawyer Marc Elias, it says counting 22 mostly absentee ballots would give Ms. Hart a nine-vote lead. The brief asks the House to order another recount and use its constitutional authority to seat Ms. Hart instead.

The destruction of our culture, at the hands of the woke scum, or the SJWs, or the progressives, or whatever term you prefer to describe the enemies of freedom and liberty and tradition and a unyielding morality proceeds apace.

But today I will gleefully ignore them and wish everyone a very merry and happy and peaceful and loving Christmas.

As a Jew, very few things make me happier about living in a (still) Christian country than the Christmas season in America. I have no interest in its religious meaning, but the glorious music, the cheerful lights and decorations, and the effort that so many people make to be just a bit happier and kinder and more invested in their fellow man makes me smile.

Wishing my fish monger a Merry Christmas (don't say "Happy Holidays" to me unless you want a stern lecture) is a joy. And the bagger at the supermarket, who quite obviously wanted to say Merry Christmas instead of the insipid corporate blather that he was taught during orientation, made me chuckle and maybe have a bit of optimism for the future. The nice young lady at my mother's assisted living facility who patiently walked me through a FaceTime session with my mom (because COVID!) deserves to be wished a very Merry Christmas, because she is kind and whip smart and her family (they own a restaurant) doesn't deserve what Cuomo is doing to them.

And even to all of you Morons, who never pass up an opportunity to give the cobloggers (and even Ace) a ration of shit (probably deserved) have a happy and healthy and joy-filled Christmas!

Good morning, kids. Thursday and it's Christmas Eve. I'll try to keep it brief and do some Ace-style "quick hits" but knowing me, I'm sure I'll be rambling once I find my mojo. Along with the continued fallout over the President's ripping the 5,500 page looting of the Treasury disguised as a Chinese COVID relief bill and his counter-offer (hopefully as a stand-alone bill that shreds the other 5,499-ish pages), we have news this morning that Trump has pardoned another 26 individuals including Democrat/Deep State persecuted political prisoners Paul Manafort and Roger Stone. It never ceases to amaze and infuriate me how the Left manages to portray itself as noble, moral and just no matter how obvious their fraud, how egregious their crimes, or how massive the evidence of their failures and guilt. I expect vermin like Paypal Jayapal and Titty Caca AOC (who may very well find herself back at a bar [if they ever open again] due to New York losing a congressional district) to open the flapping exhaust pipes above their chins to spout their bile. But then there's Ben Sasse-hole. I don't think I ever saw a faster costume change than this douchebag. Touted as the cream of the crop of the next generation of young conservatives, it took him about a nanosecond to get on his knees to suckle the length and breadth of K-Street and the Chamber of Commerce. How Nebraskans fell for this cheap punk I'll never know. I'd say he should be primaried but considering the legitimacy of our elections going forward, we're probably stuck with this jagoff for the next half-century or so. If we still exist. If G-d is good, I'll me moldering in my grave well before that and not have to endure that particularly noxious vat of acridity.

Speaking of rigged elections, White House advisor Peter Navarro has written a comprehensive report that goes into great detail on specifically how the 2020 election was stolen. For anyone claiming there's no evidence, it's all speculation and conspiracy theories, etc. etc., Navarro really lays it out.

This is election fraud at the retail level. Voting illegally, or voting twice, or in multiple states, is a felony. These allegations are easy to verify -- but so far, no court has allowed the Trump team to provide the lists of voters Navarro cites. And states controlled by Democrats have systematically refused any outside examination of their voter rolls and screamed "voter suppression" whenever groups such as Judicial Watch have forced them to hand over the evidence in the courts.

Then you have the cemetery vote -- at least 8,000 of them in Pennsylvania, and probably more in Philadelphia, Milwaukee, and Detroit -- and "ghost" voters who were added to the voter rolls on Election Day by poll workers. In Michigan, for example, thousands of people who showed up without ID were assigned birth dates in 1900 and allowed to vote. This is fraud organized and carried out by others.

In addition, Navarro describes multiple cases of wholesale fraud, especially in Wisconsin and Michigan, where election workers were caught on camera or by multiple eyewitnesses who submitted sworn affidavits running batches of ballots repeatedly through tabulating machines. "Evidence of these particular kinds of "ballot stuffing" are present across all six battleground states," Navarro notes.

It's a must read, unless you're a Democrat or Ben Sasse-hole, but I repeat myself. In any case, Eric Croomer the security director of Dominion is suing Sidney Powell, Lin Wood and Trump Campaign. Well, discovery should be lit. Bring it on.

Getting back to the Chinese COVID Lung Pox, a Taiwan factory that just happens to be the second largest in the world that produces the ingredients for HCQ suddenly went up in flames. Hmm... Anyway, I thought HCQ was poison so what's the big deal (sarc)? Elsewhere in the world, President Trump drew a very bright red line in the sand after a Farsi missile attack near our assets in Iraq. Whether Trump has four weeks left or four more years and four weeks left, the Iranians are making a big mistake if they think he is not going to do anything in response.

Lastly, in his final broadcast for the year, Rush Limbaugh was particularly open and honest about his health. For long time listeners, he does take this opportunity to thank his audience but all things considered, many people sensed something a bit deeper and more urgent in his words and his tone. Diagnosed almost exactly a year ago with stage four lung cancer, he admitted that his doctors did not think he'd make it into the fall. That he is still here is a miracle. I hope and pray yesterday was not his last broadcast, and that he is with us for many more years to come.

Anyway, lots of stuff to peruse. Have a great Christmas eve.

Again: Democrat Official Demands People Stay Home and Alone for Christmas, Then Announces She's Travelling to See "Close Family"

Um, if you have to drive on a highway for hours, they're not close family.

They may be family, but they're not family you're in day-to-day contact with, and hence you may infect them, or vice versa.

But she says she knows them -- she knows her family?! -- and therefore The Science (TM) says it's all right.

Mecklenburg County Manager Dena Diorio participated in a virtual press conference in which she discussed coronavirus restrictions. She stated that despite her adominishing North Carollina residents to "stay home and only be around those who you live with" during Christmas, she would be "traveling by car to Durham, North Carolina to see some close family, small group."

Reporters on the call were struck by Diorio�s admission of brazen hypocrisy and expressed confusion about her remarks.

"I was confused a little bit by Dena's answer going to see her family in Durham," said WBT�s Brett Jensen. "Isn't that what we�re not supposed to be doing, by spending only time with people that we actually live with?"

The county manager defended her hypocrisy, arguing that hers is a special situation that should allow her to refuse to follow her own advice. �I know who the family is, I know where they spend their time, so I feel comfortable making that trip,� she insisted. "I've two people in a household, it's not a group. It's a very small number of people and I feel very confident about their safety."

I don't care what your Christmas Throuple Sex Plans are, whore. Stay home with your vibrator "Andrew" (TM).

Jensen pressed, asking if Diorio feels that everyone should be able to use their own discretion when making plans for Christmas. "I'm making a personal decision based on information that I have, and so that�s the decision that I've made and I think everybody needs to do the same," she replied.

How the CDC Voted to Kill Older White Americans, Citing Racial Vengeance as a Compelling Governmental Interest

No one has any obligation of loyalty to an eugenics-minded racist government such as this.

The committee openly acknowledged that its initial plan [of vaccinating younger minorities who didn't need the vaccine] would result in more deaths than "vaccinating older adults first." But, the panel said, the plan would reduce racial disparities--something they deemed more important than saving lives--because essential workers, unlike adults over 65, are disproportionately black and Hispanic, the two groups that have borne the brunt of the pandemic.

How did the committee reach that conclusion? According to meeting minutes, presentation slides, public statements, and even civil-rights directives, the now-scuttled plan didn't come out of thin air. Rather, it reflects the reductive, racialist worldview that is rapidly gaining ground in education, media, nonprofits, and now the U.S federal government--a worldview with concrete policy implications and concrete human costs.

That policy agenda was seeded by outside consultants like Matthew, who told the New York Times that racial inequality "requires us to prioritize by race." But it was also seeded by the CDC itself, which in September hosted a series of trainings on "racism, sexism, and other systems of structured inequality," in direct violation of President Trump's executive order barring such programs from government agencies. And it was even seeded by the chairman of the CDC committee, Jos� Romero, who said in July that minorities "need to be moved to the forefront" of the vaccination line.

The result was an explicitly race-conscious plan that would have prioritized shrinking the case gap between races over saving the most lives.

This plan contained glaring double standards, such as an assumption that age-based policies would be discriminatory but that race-based ones wouldn't be. It relied on omission, distortion, and equivocation to make a highly contentious judgment seem self-evident, building bureaucratic consensus upon shaky foundations that were anything but apolitical or science-based.

That consensus coalesced in September, when committee members met to discuss their framework for "vaccine equity and prioritization."

One nasty, dishonest step the CDC took was to claim that arguments against discriminating against the elderly were in fact arguments in favor of discriminating against the elderly.

They took HHS' concerns about denying ventialtors to old people based on their age and perverted them into arguments in favor of denying care to the elderly -- in the interests of racial "justice."

The HHS office, however, was worried about triage plans that discriminated against the elderly, "such that older persons might automatically be deemed ineligible for life-saving care without any individualized assessment." The president of the American Geriatric Society concurred, saying that age-based criteria "disfavo[r] older adults regardless of their function and health relative to COVID-19."

The CDC committee thus took two statements that championed the interests of the elderly and used them to justify a plan that would disproportionately kill senior citizens--implying that age-conscious alternatives were discriminatory, even as the race-conscious plan passed with unanimous support at a subsequent meeting.

If the comfortable Republican Establishment will not even raise a cry out outrage over the calculated murder of their own parents (or own selves!) -- and trust me, they will not; their liberal friends and/or spouses would call them "racists" for opposing race-based murder -- then what is the point of supporting this party?

Sometimes I wonder if it would just be better to support the left on the theory that at some point, the upper-middle-class white weakling class will eventually revolt against Woke #AntifaGovernment.

But will they? I don't think they will.

No corporate donor money in doing so, whereas there's a lot of corporate donor money in just accepting the agenda of the Woke #AntifaGovernment.

Meanwhile, Dr. Birx says it's your fault she had to lie about her Thanksgiving plans, so now she's retiring.

"I will be helpful in any role that people think I can be helpful in and then I will retire," she went on.

"I will have to say, as a civil servant, I will be helpful through a period of time, and then I will have to say, this experience has been a bit overwhelming. It has been very difficult on my family... I think what was done over the last week to my family."

Oh, I can't get enough of this lie. They're always claiming that when we're criticizing them, we're really "attacking their families," and that's out of bounds.

No, Birx. We're attacking you. Your family did not issue orders to us and then violate those same orders and then lie about having violated them.

You did. Not them -- you.

The infectious disease expert, 64, was outed on Sunday for not following her own travel guidance when she was joined by three different generations of family at one of her vacation properties on Fenwick Island in Delaware the day after Thanksgiving.

She was roundly criticized for not following her own orders after publicly urging Americans in the days leading up to Thanksgiving to limit gatherings to "your immediate household."

By "immediate household" she now says she meant "people outside your immediate household."

So again, that's on you, Racists.

And even if you think everything will be just wonderful, keeping private communication private is a quintessentially free man's behavior. It doesn't matter if you are swapping recipes or plans for thermonuclear devices; it isn't anyone's business but yours and the recipient.

You might have heard the saying, "never send anything in an email that you wouldn't send on a postcard". It's true. Email might be secure in transit - between your computer and your mail server - but it's not guaranteed. And it's even less likely that email is secure at rest: on your computer, on the recipient's computer, or even on the mail server. The document that established a common internet email system was built on earlier work that just wasn't designed for a massive public internet. If we want to be able to send and receive email that we can trust, the two main flaws that we want to address are:

Encryption: How can I be sure that the mail I send is only readable by my intended recipient(s)?

Signing & Validation: How can I be sure that email I receive was actually written by the person who claims to have written it?

For both of these, we can use GPG. Some of you might remember "PGP" - GPG and OpenPGP are the descendents of that and use the same workflow (and often, the same keys). The short story is that Symantec owned the rights to PGP, so the OpenPGP spec was created to establish an open standard that wasn't tied to a particular vendor, and GNU Privacy Guard is a free and open-source project that meets that standard. So, if I mention GPG or PGP or OpenPGP throughout this document, you can pretty much think of them as synonymous.

It's free. It doesn't cost anything to install or use. There's no monthly fee, no service provider. You don't need any special hardware besides your computer.

Once you catch on to how it works, it's pretty easy to use.

You can use it alongside the rest of your email, in the same email account. You don't need a special address or anything.

An Antifa militant who publicized a hit list of Seattle business owners has been identified as a trans nonbinary furry and children's camp counselor who has been arrested multiple times at violent protests.

Mikaele Andrew Baker, 23, of Seattle, tweeted an extensive list of local business owners last week who signed a petition in support of the dismantling of a growing autonomous zone in Seattle�s Capitol Hill neighborhood. The business owners were subsequently doxed and received threats.


"A lot of people tried to reality check me about [the] escalation of violence," Baker tweeted earlier this month. "I am a revolutionary anarchist. I'm not a war-hawk, but I see open warfare against fascists and the state as a necessary evil to achieve liberation."

Adolescent-minded narcissists are forever offering up declarations about their current identities. "I'm a [x]," "I'm not a [y]." Narcissistic children never stop talking about themselves because they don't know anything else.

In June, Baker tweeted on an alternative Twitter account: "What's the point of having guns if you're not going to use them to shoot racists? #seattleprotests #CHAZ.�

Politicians getting Covid vaccinations to “instill confidence” is shaping up to be an epic face plant, making our loathsome rulers somehow look even more out of touch with the country they are aggressively destroying, all in the name of saving us from the Wuhan Flu.

In the various family and social circles of my wife and mine, there are many health care workers and several seniors, along with the normal collection of people with various health issues and stages of disease recovery. Some have had Covid. A few got very sick, but most didn’t. Some have probably had it asymptomatically and never knew it. The husband of one social acquaintance died of it. He was an EMT and was likely infected on the job.

While some seniors and health care workers that we know have stated that they will not take the vaccine, a strong majority plan to do so, and quite a few are desperate for it. (Thank you Donald Trump and Project Warp Speed for getting it rolled out before the end of 2020!)

The passion and anger they feel toward politicians and elites jumping the line ahead of front-line healthcare workers and seniors is the most intense anti-politician hostility I can recall in a long time. These are polite people who don’t discuss politics. They are livid.

The AP reported that “All members of Congress are being offered the vaccinations as part of protocols to ensure the continuity of government operations.”

Continuity of government operations?? Oh no! How awful would it be if our ruling class was home sick in bed and too weak to pass a “Covid Relief” bill that sends $10 million to Pakistan for “gender programs”? Who would tax us and regulate our lives? Who will spend $2,700 of my money to send me a $600 check? If our rulers were sick in bed, who would shut down small businesses deemed “non-essential”?

Who would you rather have unable to work because he is stricken by Wuhan Flu? A front-line health care worker or a member of Congress?

A nice if subdued time, since so many either couldn't come or didn't come due to fears of Covid. Daughter and her cousin made great chili, the cookies were good, and youngest grandson sang a solo of Jingle Bells. We looked at old pictures and bored my daughter-in-law with tales of school in the 50's, when I had 49 in my 3rd grade class. LOL!

Headed home from family Christmas Eve (the seven fishes, although not exactly traditional: mini crab bakes, shrimp cocktail, sushi with salmon and eel, scallops and lobster over pasta, and sardines in the form of Caesar salad).

Learned a couple of new (very old) family stories, including one about an extended relative who was “got gone” by the mob.

A very good night, all in all.

My cousin and her husband are both hyper-competitive, and play board games every night (scrabble, parcheesi, etc) with whoever’s around. So for Christmas I bought them a custom made trophy for the winner to claim each night.
