One of the mantras I hear constantly spouted in the current efforts to suppress freedom of expression is that there is no basis in the constitution to challenge such efforts (so that challenges must be on other grounds, such as antitrust). In fact, if a litigant can make the case that the state encouraged or impermissibly aided private speech suppression, there is a constitutional claim.
I don't know whether a litigant could develop a record in a federal district court to meet this standard. Even if it could be shown, for example, that Biden, Shumer and Pelosi aides were in contact with Google, Amazon and Twitter, that might not be enough. However, I would hope that investigations would be made as to whether the relationship between Big Tech and the Federal Government is sufficient to bring state action into play in Big Tech freedom of expression suppression situations.

What henry is linking to is an article that points out that Nancy Pelosi, in a letter to colleagues, solicited opinions on Section 3 of the 14th Amendment, which allows for the expulsion of Representatives supporting an Insurrection by majority vote.
Does that mean she is thinking about the expulsion of the GOP members who voted that the election results should be questioned? Maybe someone will ask her the question. Expelling 140 members would look so drastic that I don't see it. A member's vote isn't an insurrection.
This also could be warning some of her GOP colleagues that future actions could have consequences, or could be directed against the Representative who live-tweeted her location.

It’s impossible to act as though Republicans are republican, especially while its leadership makes clear that it doesn’t care one whit about the party’s own foundational principles. And so I'm out.
One other thought. If the Dems fight impeachment on the grounds that the January 6 speech incited the rioters -- they will and should lose. The timeline does not work.
If they ground it on the totality of Trump's actions to challenge the votes by his claim blatant voter fraud (when none has been proven in any court), they have a better argument and one that may be worth having in the Senate. Still doubt they will get their removal plus prohibition against holding future office.
So an impeachment trial worth having is whenever an opposing party decides the president has advocated something that hasn't been proven in court.

Even the stolen election, if left at this point (sound and fury and words, words, words), is just a he-said-she-said and will go down in near history as a myth, rejected, as they say, by all 50 courts.
The shame will be that for four years we had a patriot in the WH who had access to everything that will never, now, be accessible from the outside.
That will be the lost opportunity of the Trump Era.

What henry is linking to is an article that points out that Nancy Pelosi, in a letter to colleagues, solicited opinions on Section 3 of the 14th Amendment, which allows for the expulsion of Representatives supporting an Insurrection by majority vote.
Does that mean she is thinking about the expulsion of the GOP members who voted that the election results should be questioned? Maybe someone will ask her the question. Expelling 140 members would look so drastic that I don't see it. A member's vote isn't an insurrection.
This also could be warning some of her GOP colleagues that future actions could have consequences, or could be directed against the Representative who live-tweeted her location.

One other thought. If the Dems fight impeachment on the grounds that the January 6 speech incited the rioters -- they will and should lose. The timeline does not work.
If they ground it on the totality of Trump's actions to challenge the votes by his claim blatant voter fraud (when none has been proven in any court), they have a better argument and one that may be worth having in the Senate. Still doubt they will get their removal plus prohibition against holding future office.

Let's turn this around. Suppose Trump prevails in getting the GOP to reject the electoral college votes and somehow manipulates the system to get term #2.
I would resent having my vote stolen. I would be in the streets. I am not a gun toting type, but I would support efforts to reject a steal like that.
Trump, by sheer vehemence and repetition has convinced many that votes were stolen, without doing much of anything to prove it in court. He doesn't even bring the arguments. The Courts just hear technical arguments about election law based on some theory that state regulators are not allowed to regulate.
The results of that -- we've seen. So, yep, the discussion IS worth having.

The absolute coldest I have ever felt i.e. teeth chattering and uncontrollable shivers was during the winter I was deployed to Desert Storm. The temperatures ranged from 90-100+ during the day and at night dropped down to the 60s. Until that point I never realized you could get cold in the desert. Having "frozen" my ass off when it was in the 60s, I can't imagine what sub-zero temperatures feel like in that part of the world.

How about the equator at sea level? You would never think to pack a down jacket but my 2 years in Kalimantan, Borneo, Indonesia proved me wrong. Since it was 120F with 75% humidity during the day nightfall would bring 70F temps that felt like below freezing because of the quick differential. We played bridge outside on the terrace and even the native guys had North Face down parkas.
Oh, and then are the torrential rains, monsoons, actually, that feel like ice storms when temps drop.
