The whole point of impeaching is to get someone out of office, so I doubt the founders would have a problem with someone resigning.

That's certainly my opinion, and from my reading of the Federalist Papers and the notes on the Constitutional debate, the opinion of those who wrote the Constitution. However, a passel of legal scholars signed on to a letter saying that allowing someone to escape impeachment by leaving office would frustrate the Founders' design. Coincidentally, perhaps, the great majority of said scholars were liberals or never-Trumpers. Not that I would ever suggest their legal conclusions were influenced by their political leanings.

Indeed it does. As I mentioned on Jan 24th:

The Cornell University's Legal Information Institute has an annotated Constitution. Under Impeachment, it says:During the debate in the First Congress on the “removal” controversy, it was contended by some members that impeachment was the exclusive way to remove any officer of the government from his post, but Madison and others contended that this position was destructive of sound governmental practice, and the view did not prevail. Impeachment, said Madison, was to be used to reach a bad officer sheltered by the President and to remove him “even against the will of the President; so that the declaration in the Constitution was intended as a supplementary security for the good behavior of the public officers.”

Also, it's fairly widely held that the disqualification wouldn't prevent someone from being elected to the House or Senate; and held by some that it wouldn't prevent someone from being elected President. Those holding the second opinion argue the phrase “Office of honor, Trust or Profit under the United States” only applies to appointed offices, and that the office of President, which is an elected branch of the U.S. government, is not an office "under" the United States.

Thanks. It strikes me that having Congress hold that the voters cannot elect who they chose is undeniably anti democratic. On what theory should a possibly temporary majority, even a supermajority of the Congress be able to deprive the citizens of their vote? The whole notion that the “elites” (such as members of Congress) get to limit the people in their choice of leaders seems antithetical to the principles of the American Revolution and self government. If we had wanted an aristocratic that made decisions for the rest of us we would have remained loyal to the British.

Obviously not every choice that “we the people” make is a good one. But that is how democracy and self governance works. If the voters WANT Jack the Ripper as president, there is no cure for that if you wish to remain a democratic republic. You either trust the voters or you don’t.

We have a democratic republic. The voters chose their leaders by a democratic process and the elected representatives make and enforce the laws; this makes our country a republic. I assume we agree on that.

As far as residency and age restrictions go, I would make the same argument — let the people decide. Sure, electing a teenager as president seems farcical but in the end you have to trust the voters not to do something that stupid. Artificial guardrails are not going to protect a country who would wish to do such a thing. But 35 is just arbitrary. It is entirely conceivable that a particularly talented 34 year old would be an excellent choice. Again, having a bunch of long dead people decide in the abstract what choices we ought to make seems like a bad idea. We have to live with the consequences and not them. It’s almost certainly a good idea to have some level of maturity in the chief executive (although we may have overshot the mark this time) but an abstract good idea should not be a hard and fast rule.

Same thing on residence. It’s probably a good idea to not elect carpetbaggers or people with limited experience with and allegiance to this country. But one should trust the voters to give such considerations their proper weight. If we don’t trust the voters the whole theory of governance collapses.

And, not to put to fine a point on it, regardless of the meaning of the text, there is no justification for allowing Congress to decide whether people can chose Donald J Trump as president. Those in Congress who do not want him to be president again are perfectly free to try to persuade the voters not to elect him. But the voters and not the Congress should decide.

I don’t want a president with divided loyalties either. But the NBC clause or any reasonable variation of it is not really going to advance that goal and can only limit the choice of the voters.

Do you fear the Ted Cruz has divided loyalties? After all, he was — as you would expect by his formal name of Rafael Cruz — born in Canada. Some Dems have argued that he is prohibited from being elected president. Most scholars, including most left leaning ones, disagree, but the possibility for mischief exists.

Imagine someone born in a foreign country to non citizen parents who comes to this country at age six weeks and is raised totally as an American? Why should they be disqualified? Why not let the people decide? Why would there be any basis to doubt their loyalty as compared with someone born in, say, Scranton Pennsylvania who shows abnormal deference to the interests of the Chinese government?

I think it is just foolhardy to try to draw up a set of rules in the abstract that will prevent the voters from making foolish choices that will not also prevent them from making excellent ones. Whether someone is “qualified” to be president is a judgment call on the basis of all the facts and circumstances and is not susceptible to being determined by some checklist drawn up in a vacuum.

Let the people decide. Having elites limit the choices available to the people — and that is all the NBC is — is not likely to lead to better choices, may lead to worse ones and in the end undermines the whole concept of governance by the people.

Of course you are right that we have a constitutional republic. You are correct that the point of the constitution is to restrain slender or temporary majorities — or even larger or more persistent ones — from doing anything they want, particularly in derogation of the rights of other citizens.

But some restrictions on the will of the people are more defensible than others. If Congress wants to establish a state religion, the Constitution prevents that and rightly so. But to the extent that the Constitution empowers Congress to tell people that they cannot vote for Trump (and I don’t think that it does) I do not think that is a wise provision.

I would draw a distinction between the kinds of laws Congress can pass — which absolutely needs to be restrained even though the will of the majority is thwarted — and Congress limiting who people are allowed to vote for. I do not favor untrammeled democracy where a majority can do anything it wants. But I think that the voters should be free to elect whoever they choose, even if the elites in Congress disapprove.

Totally agree. For a little while I had thought that McCarthy was stiffening his spine a bit, but only with DJT as a back-up.

He reverted back to his milquetoast persona when Pelosi got the speakership back, and he strikes me as nothing more than that.

Furthermore, cathyf did the timeline a couple of weeks ago and I find a lot of the stuff CNN is saying about comments and tweets don't agree with it, so I am discounting the entire thing.

By the way, there wasn't a huge crowd to welcome Pence back to Columbus. The Indy Star ran a small story but in all actuality, the welcome was lukewarm at best.

Pence could just as easily have delayed accepting the count until some of this other information came to light. Pence was given a lot of responsibility and spotlighted throughout the 4 years of the administration, far more than most VP's
are. He could have done the country and his President a service by at least making some sort of statement.

I will tell you now that if he decides to run in 2024, he will not win this state, unless something comes to light to prove my opinion wrong.

Peak stupid is not letting people get back to work when you have protected the most vulnerable, created a regimen for those others who do fall ill, and keeping all other Americans out of work will impoverish the middle class and the retired by eating up their pensions through inflation.

Tossing borrowed stimulus money at voters may allow politicians to get past the next election — we doubt it — but at what price.

The velocity of money — the speed at which each dollar changes hands is declining precipitously. That means people are not investing in the productive economy and debt is skyrocketing.

That happened during the Great Depression and during World War II. The only way out was to inflate the currency, meaning those on fixed income got screwed.

You don’t want Mom and Pop to be screwed. You don’t want small business to be screwed. You don’t want your children to be screwed.

It’s time to rip the veil from the Administration’s fantasy that they can print enough money to get us out of the mess they have created. We have seen nothing from Washington politicians that shows they care about anything but their temporary hold on power.

I always assumed that one would have to make many difficult decisions that would be hard to explain. Who knew you could delegate to committees to accomplish every thing on the first day by EO and that other people would explain them for you?

The velocity of money is a good thing to talk about in an editorial. Sending money to people who don't need it is an essentially useless measure. They won't spend it. They'll find a way to invest it. That won't jump-start the economy.

Middle-class folks will spend it immediately, or expecting further economic hiccups, will instead save it.

The poor will spend it immediately. My sense is that many of the poor are illegals and aren't eligible, yet, for any of the proposed aid.

I mean the press issues articles about millions of people that are unemployed, food insecure or behind in their rent payments. Just by the way our economy is structured I expect that the majority of them are illegals.

Maybe I'm being harsh, but right now they are a drain on the economy.
