The Minnesota Supreme Court ruled that a person can't be found guilty of sexually assaulting someone who is intoxicated if that person willingly ingested drugs or alcohol.
The ruling was released Wednesday after the case of Francois Monulu Khalil, who was convicted of a third-degree criminal sexual misconduct by a jury because the victim was drunk and mentally incapacitated. Khalil, a Minneapolis man, met his victim after she was denied entry to a bar for being too intoxicated.
The court's unanimous decision was written by Minnesota Supreme Court Justice Pail Thissen. Thissen writes that the lower court's definition of mentally incapacitated regarding the case "unreasonably strains and stretches the plain text of the statute" since the victim was intoxicated before she met Khalil, her attacker.

ssrc stands for Social Science Research Council and it's a tremendous database for behavioral sciences research originally funded with Rockefeller Foundation money.
Interesting that it came up as I was following up on a footnote on the founding of the Tavistock Institute on Human Relations in 1947. That too was a Big Oil/Banking foundation grant.
There funding in the social sciences virtually always means a seminal idea still at the theoretical stage of the sought transformation.
They were behind the original frameworks shifts in K-12 that commenced in 1980.

For people who have been vaccinated and want to give blood, the Red Cross asks donors to know which vaccine they received, otherwise there could be a wait.

The U.S. Department of Commerce is close to signing off on a new rule that allows U.S. companies to work with Chinaâs Huawei Technologies on setting standards for next generation 5G networks, people familiar with the matter said.
Engineers in some U.S. technology companies stopped engaging with Huawei to develop standards after the Commerce Department blacklisted the company last year. The listing left companies uncertain about what technology and information their employees could share with Huawei, the worldâs largest telecommunications equipment maker.
That has put the U.S. at a disadvantage, say industry and government officials. In standards setting meetings, where protocols and technical specifications are developed that allow equipment from different companies to function together smoothly, Huawei gained a stronger voice as U.S. engineers sat back in silence.
Industry standards are big business for telecommunications firms. They vie to have their patented technology considered essential to the standard, which can boost a companyâs bottom line by billions of dollars.
The Commerce Department placed Huawei on its âentity listâ last May, restricting sales of U.S. goods and technology to the company and raising questions about how U.S. firms could participate in organizations that establish industry standards.
After nearly a year of uncertainty, the department has drafted a new rule to address the issue, two sources told Reuters. The rule, which could still change, essentially allows U.S. companies to participate in standards bodies where Huawei is also a member, the sources said.
The draft is under final review at the Commerce Department and, if cleared, would go to other agencies for approval, the people said. It is unclear how long the full process will take or if another agency will object.

From what I read, she was drunk outside a bar, and a guy picked her up. They went to either his or her place and had sex. The Minnesota law was clear that it isnât rape because sheâd gotten drunk on her own volition, but I think he was charged with a lesser offense.

What is WRONG with Americans? My dad got typhoid fever as a kid from drinking water from a Mexican village well on the ranch when he was 7. He survived.
I worked with a guy who survived polio and showed up every day for work in a wheel chair. In the 50's a lot of people died from polio or were partially or completely paralyzed.
I expect public health officials to give clear, concise and truthful information, not curl up in a ball and carry on like the end of the world is near. Good grief!

There was a conversation on my back patio a few months ago discussing the college kids who wanted to radicalize the remaining good colleges not already there and several of the 20-somethings said that it always seemed to be the same ones there at an often substantial discount to create a diverse student body who wanted to then change the nature of the experience they were getting.

I have to laugh,because one of the daughter's summer jobs during college was an unpaid intern at the statehouse in Boston. She lived with an aunt and uncle in the Boston area and we sent her grocery money. The job was to answer phone calls and respond to correspondence. She called us one day laughing about a crazy person who said government agents had implanted a chip in his butt. Ha. Maybe not so crazy now. Of course, it was Boston. Massholes!

I do not know enough to have an opinion on the Minnesota rape case. However, I have a question. I have often heard that hypnotized people cannot be made to do something they are truly opposed to, like kill someone. Is the same true of drunk people?
